I have been out of Canada 40 days more than allowed (1095,I was 1113) Will I have a problem with renewal PR card.thank you

I assume you are back in Canada now?

If so, remain in Canada for two years straight without leaving and then you can renew your PR card.

Does this explain why you had to remain outside of Canada for more than three years? Was your father sick most of that time? Are you an only child and was there no one else to take care of your father? Ultimately none of us can tell you of this will work or not.

It would be much safer to remain in Canada for two years straight and then apply to renew your PR card.

To add to @scylla comments processing for PR card renewal based on H&C is a very lengthy process and may not actually be faster while also taking a significant risk.

I largely agree with the comments from others. But to have an idea of the issue, you should really take a look at your days in/out of Canada. If most of your absences from Canada were early after you became a PR, that may mean that you will not have to wait long before being in compliance - when there is no issue.

If (from your numbers) you spent most/all of the first two years since you became a PR in Canada and then left Canada for more than three years straight, that's a different situation.

It also makes sense to think about what you need a PR card for. If you have a SIN and driver's license and provincial health card, there are few urgent reasons to have a PR card save travelling.

Last question please.should I hire immigration lawyer? How you think will be big difference if I apply myself ( renewal PR card) or it will do immigration lawyer.

Have you worked out how many days you would have to stay in Canada to meet the residency requirement?

If it's only a few months, I highly recommend you wait with PR card application until then.

As mentioned before, a PR card application under H&C will likely take significantly longer (many months to over a year), so if getting your new PR card asap is a priority, you might be better off waiting until you can apply without having to rely on H&C.

Did you really for a new health card when you returned to Canada permanently? Did you meet the residency requirements to qualify for healthcare in that province? You need a valid health card and to have meet residency obligations to qualify for provincial healthcare or else you must reapply.

Applying early (eg now) to renew your PR card may not magically solve your issue - and might make it worse in a couple different cases.

Key in this consideration is how likely/how soon you expect to leave again. Especially if what you're really getting at is that you'd like to leave right away and not return for a longer period of time.

If you have the option to return via USA (visa or ESTA passport) then that may be (by far) the best option for you - wait until you have to return home, and then do so via USA/land border.

-As noted, quite likely an H&C request to have one 'to travel just in case' will take quite a bit longer anyway.
-Possibility they will do a 'come to pick it up in IRCC office in Canada' procedure - which might be good if the timing works out, or be neutral or negative to your situation if you're out of the country (and end up having to apply for a PRTD anyway).
-Downside of this and PRTD in general is it might take quite some time, AND be higher risk (PRTD always evaluated on assumption first that you are inadmissible and you're expected to show evidence that you are).
-Applying for PR card now does bear some risk that you will be found inadmissible/reported for non-compliance (and possibly lose PR status completely). Waiting until in compliance removes that risk.

Up to you. Not enough data for others to make reasonable guesses.
