Hi, I am not too sure how to ask some questions that I have about Out of Status and have being given a removal order.

But firstly, I came to Canada in March of 2014 on a work permit. I meet my wife 2 months after and we started dating. We had a real chemistry and we had decided to get married so I can become a permanent resident. However, we did not get married until July of 2015 and by then my WP was expired.

After we got married we started the application and I send back to my country of origin for my criminal record. I waited over 4 months for it, and in March of this year I got a call from a CBSA office to report for a meeting. After the meeting he seized my passport and gave me back my criminal record and my other documents for my PR application.

Long story short , last week I got a EXCLUSION ORDER and was given a 60 day deferral that ends August 8th. Also, they made me sign a document stating I would not be applying for Pre Risk Assessment.

We are very stress and overwhelming about everything that's going on. I am afraid that I will have to leave my wife and step-son and friends. Not too sure what I can do at this point, but if anyone could give me some advise on my case?
They told me that they would be contacting CIC to expedite my application.. Not too sure about that..
Any one have any experience with this?
I realized overstaying was not the right thing to do but I love my wife and would be devastating if I would have to leave her even for a year.

So did cic tell cbsa about your overstay ?
 
I am not too sure. They might have, the CBSA officer told me that they share the same information system
 
I ask because I am also out of status and now of course very worried
 
@Loveactually The best thing to do is apply for PR asap. That's the only thing that will help the situation, aside from leaving the country.

When did cbsa call you? Is it after you sent in your app? Did you receive aor and SA before this happened?

Then you don't have much to worry about. Just lay low for a bit. The OP only got "caught" because he sent out for mail. Just bad luck really. If you have to do something similar, maybe get it sent in someone else's name.
 
What mail did he send out for? Lol sorry I am confused
 
Yeah it's a bit confusing.

Did OP get "caught" because they basically intercepted the criminal check mailing? So they saw this mail ran the name it was addressed to and bingo? Kept it, called him for an interview then seized his passport and handed him the mail they intercepted for him to give to CIC?

Or CIC informed CBSA? Not likely CIC initiated informing them because they do accept inland apps from those that lack status.

In all likelihood CIC will give him AIP before the 60 days is up assuming no other red flags.
 
@Loveactually send for a criminal record and it was sent back in the mail with my name and address. One
adivce I would like to give is never send documents (important ones) in the mail if you are out of status. Why? All packages, parcels are subject to be search at point of entrance at the custom border. I have already received my UCI but they still issued a exclusion order.
 
Oh I see wow. I did my police check also but no issues there. Yeah I will hold off sending anything thank u for the heads up. Hope it works out for u dan12
