Hi guys i haven't been able to find a any information on this.

My girlfriend is an US Green Card Holder. She doesn't have an passport. She came to visit me in canada on Friday (jan 29), she also got the return ticket for sunday (jan 31). the reason why she got the return ticket was that she feared if she says she is going to visit her boyfriend, they might not let her in Canada. the border agent just look at her green card and ask her when she was returning she said sunday (jan 30). he didn't check her reuturn ticket nor said anything to her, he just let her enter.

My Question is that.
1) since the border agent didn't scan her Green Card, how long is she allowed to stay here in Canada legally?
2) She cancelled her return bus ticket will that be a problem ?
3) we are thinking about getting married in Canada in 1.5 and applying for Her PR inland, will she have any problem ?
4) AFTER A MONTH AND HALF IF WE DECIDE TO DO OUTLAND INSTEAD OF INLAND, WILL SHE HAVE ANY PROBLEM ENTERING US ?
5) is there anything else that i should keep in mind ?

3) No. But don't apply inland. If you do, you will hate life for the next three years.
4) Each time she re-enters Canada she will be reassessed as a visitor. So impossible for any of us to answer.
5) Don't apply inland. Apply outland.

Also , if you apply out land, she can stay in Canada while the application is processed.
She cannot work, nor go to school. Probably will need an extension on her visitor status.
Also no health care.
But as Scylla said.. if you apply inland you will hate your life for three years.
Since she is a green card holder, entering the US would not be a problem,
the possibility of having issues when coming back into Canada is unknown.
We didnt want to take the chance, so my husband who is an US citizen never
left Canada while applying Outland, and that was hard , being that we live in a
border city.

But the remote chance was not worth it.

That's twice now I have seen this posted and it's not true. That rule only applies to "inland" applications.

I believe Gemmie means in the sense that:

An Outland applicant must maintain their status in Canada on their own, independent of their PR application, if they wish to stay in Canada.

Many US-Canada Outland applicants stayed in Canada during the Outland sponsorship by enter on a visitor visa and applying for an extension to stay longer (I got two extensions, last one was for 11-12 months) during the application process.

Visitor/extension doesn't grant right to work or study, but you are free to apply for those kinds of permits if you want. It just won't be automatically given to you by *virtue* of your PR sponsorship.

And if you want health insurance, you have to get your own private coverage.

My husband remained in Canada under Visitor Status from the USA during the entire processing of our Outland Application.
Just before six months, we applied to have his visit extended, and he was given a year extension.
So it is most definitely true.
Now as mentioned.
You cannot work, you cannot go to school and you have no
health care as you are a visitor.

But there is nothing barring a US citizen from visiting and staying in Canada while applying outland.

Oh but there is...the CBSA officer that assesses the person at the border can certainly deny entry if they suspect that s/he will not leave Canada (voluntarily) if the PR is denied. They can also deny entry if the person is deemed to be inadmissible.

Even a U.S. citizen can be denied entry.

Yes, Ponga, you are correct. That is also why my husband did not leave Canada during our outland application.
He has a name hit from the first time he visited and they thought he was coming to stay. Which he was not at the time
and was 2 years later when we actually got married and he came to stay in Canada.
But there is nothing outright that bars a US citizen from visiting or staying during an outland application, and as I did say above,
when you come back into Canada it is unknown if you will have issues with the border.
Cause they all have good and bad days and your going to hell in a handbasket if ya happen to get the one having the bad day.... hence
the poor hubbys name hit...... :D
