i dont think they check whether you are okay on language proficiency. They only check whether you fit the ministerial instructions or not.

1.12 Applications that correspond to the Ministerial Instructions
Once it is found that the applicant's work experience corresponds to the Ministerial Instructions,
the CIO will record this assessment in CAIPS and the electronic file will be transferred to the visa
office. The CIO will send a letter to the applicant to:
• notify them that their application is being placed into processing at a visa office;
• request them to submit a copy of their application and other forms, together with supporting
documents to the visa office within 120 days;
• inform them of how to contact the visa office.

R10 prescribes what constitutes “an application” under the Act. The requirements are as follows:
1) a signed and completed IMM 0008EGEN must be submitted containing the name, birth date,
nationality, matrimonial status and current immigration status of the applicant and all family
members (whether accompanying or not) and identifying the principal applicant;
2) the visa, permit or authorization being applied for is specified;
3) the class in which the application is made is specified;
4) a signed statement is included to the effect that the information provided is complete and
accurate;
5) the application is accompanied by evidence of payment of the applicable fees.
6) proof of official language proficiency is attached either in the form of the results of an
approved language test or a written submission. See Section 10 for more information on
language requirements.

Folks
This language thing is killing me. I am now appearing for exam on 21st and then sending the forms to Sydney.

If i claim 16 points them i get 78 points.
So should i go ahead and claim it and send the forms this weeked.
Will save me at least 3 to 4 weeks. Or should i wait.

Looking at folks who have applied without IELTS i am tempted.

Why dont you claim just enough for 67 or minimum 6 points which ever is greater.

I was told that on this forum that when you send in the forms to the visa office, you send in updated forms anyway, so you can update your IELTS to reflect your score.

just make sure you don't make any mistakes between your forms to sydney and to the visa office. you could print out extra ones with just leaving the page with the language proficiency out for now.

I have read the instructions multiple times. (Not reading instructions for any thing is my weakness, but not in this case)
Why i am in a dilemma is, the form asks about english proficiency and then asks if i have written IELTS or CELPIP.
Also the fact that the instruction states i have to send no 'supporting docs' to sydney.

So just being careful. (At the same time getting worried too much)
But as rupeshhari says may be i should just send the form to Sydney

Amrith,
with all due respect, if you have read the instructions, you should understand that : (Don't put yourself in a dilemma and kill yourself).
1) At the Sydney stage you can claim 16 points and also say you have not written the IELTS. However,
2) At the next stage, that is the VISA office stage you will need to prove this either by a written test or otherwise.
3).@ the sydney stage, what they are interested in is whether your NOC is on the ministerial list and whether other factors are fulfilled.

Rupeshari has clearly stated this view somewhere here on this thread.

Again,

If @ the Visa office stage you don't get the 16 points in Language proficiency but achieve a minimum of 67 points all together - That will be fine.
