Respected Members,

I have always found this forum members so helpful before consulting any other source i post my concern here. and once again i need some valuable suggestions. Please guide me.

- My Parents applied online in 2015 Dec - Visa Rejected
- Reapplied again in Jan 2016 - but made a human error in IMM5257 question 2 (b) and (c), answered NO and submit the application. it was pure human mistake as we submitted the same forms that we filled month ago.
- on 22nd Feb when i was going through forms again realized made a mistake and made Case specific Enquiry but didn't received any correspondence.
- 3rd Mar, received letter from CIC to explain the Misrepresentation IMM5257 question 2 (b) and (c)

I have 2 questions on which i need your expert help and suggestions

1) How can i satisfy visa officer that its Purely Human error not deliberate (what kind of documentation i can provide)
2) they both have received seperate notices so should i reply separate or can combine in one reply for both Parents (both Parents has different File Number and UCI)?

Your kind help is required to help me to proceed.

Thanks and Regards

CIC documents are serious things and any error will be taken seriously. That is stated and understood.

I will assume you are talking about BACKGROUND INFORMATION 2A and 2C.

Be honest about the nature/reason of the error and DO NOT try to come up with excuses.

There is little you can do besides that.

Separate unless otherwise stated.

(Don't try to find hidden meanings or rules, stick to what is written in the documents).

Thank you so very much Jalex23, much appreciated this is really helpful.

I hope they consider my reasoning valid, i will admit its our Mistake and it happened because we didn't re-read question while re applying. Do you think this will be considered as a reason and not an excuse?

Yes

to be honest we will admit our mistake and this happened because we only updated the documents from last application in Dec 2015, never went through the form again just submitted it.

There is little you can do besides that.

Separate unless otherwise stated.
Thanks

Hi,

CIC is referring to the 'previous visa refusals' question..... for which you had incorrectly answered 'No'.

When you reply to CIC.... you must state that you had informed the visa office, through CSEs, on February 22, about this genuine mistake.... on your own.... Also, you informed the visa office well BEFORE you received the Procedural Fairness Letters today.

Also, did you provide any UCI Numbers + mention your parents had previous TRV refusals.... in the covering letters which you submitted with your parents' current TRV applications?

Don't worry

Looks fine.... as Bryanna suggested make sure to include the communication you made to inform them of the error.

Good luck.

[Hello Bryanna,

Thanks a bunch for suggestions and guidance

No i did not provide any UCI numbers or Cover letter for previous refusals but when i made CSE's i attached the refusal reasoning which had the UCI but with Original Application No. Shall i include now with this explanation?

Thank you again for helping me out on this. much appreciated

Yes, please do.

Do draft the reply to these Procedural Fairness Letters very carefully.... give full details about the CSEs. Mention the date/time + to which visa office you had sent these CSEs

You are superstar Thanks Bryanna, really helpful

Thanks to both Jalex23 and Bryanna for your expert advice will follow them. Hope my Parents get Super visa. really appreciated
+1

Hi there,
From personal experience it is better to submit a new application, but carefully verify every single question/answer.
CIC doesn't accept any mistakes and for them to find the mistake is very popular "game". You made mistake - they denied your application and forgot about you.

complicated ... but be genuine and be clear that a preferable solution.

@markabet

This isn't a simple case of a TRV refusal. A Procedural Fairness Letter is a serious matter.... and one should not submit a new application

Agree with Bryanna,

Case is in unusualy complication. Parents cannot apply until decision is made. they could potentially get refusal + 2-5 years ban on misrepresentation.
We have to make sure we tell CIC the genuine reason on missing that part.
Which Both Bryanna and Jalex23 pointed out. Hoping CIC do accept the reason and proceed smoothly with visa.

Its members like you all who help and guide in difficult situations like this. Accept my sincere thanks to everyone who responded/Suggested in what ever their experience is.

Appreciated all here !!

twice same situation same refusals lies in front of me .... and finally after concern with CIC ......

they told to submit new form with correct information and details clearly as happen with the applicants..
+
covering letter of explanation letter for human mistake...

If you don't do it you are abandon and ban for year... so that's a prefer things that you must need to do ...

clarify your self and than apply..

Hi Candy20,

so correct if i am not understanding it correct. what you are suggesting , i need to provide clarification to CIC that i received and then apply again?

Thanks

Is there in letter(letter that you receive from CIC) anything printed that we gave you another chance to submit application again within 30 days ?
if yes ...do two things
1- make a explaining letter or clarification request covering letter
2- fill a fresh correct IMM-5257E form with amendments

and submit both along with letter that you receive to VFS...

or if you receive refusal letter ..
fill new form . covering letter(highlight the mistake and clarify, along with refusal letter) , and supporting documents again..

hope you understand...
