I filled my TRV application and by mistake did the same error where i did not mention about US visa rejection.
VFS replied me back with the letter saying that i misrepresented and asked me to represent myself within 30 days.

It was my mistake that i didn`t read the form clearly and did not declare my last visa rejection.

can anyone tell me what is this Procedural Fairness letter ?

other than replying back as a formal letter, what can I do to state my mistake ?
From my research you can tell the truth in reply that you didn't read the form clearly. Other than that hope for the best.

Misrepresentation or Procedural Fairness Letter are same thing as i understand the things. they lie under same rule of rejection. I could be wrong.

All the best

Respected Members,

I have always found this forum members so helpful before consulting any other source i post my concern here. and once again i need some valuable suggestions. Please guide me.

- My Parents applied online in 2015 Dec - Visa Rejected
- Reapplied again in Jan 2016 - but made a human error in IMM5257 question 2 (b) and (c), answered NO and submit the application. it was pure human mistake as we submitted the same forms that we filled month ago.
- on 22nd Feb when i was going through forms again realized made a mistake and made Case specific Enquiry but didn't received any correspondence.
- 3rd Mar, received letter from CIC to explain the Misrepresentation IMM5257 question 2 (b) and (c)

I have 2 questions on which i need your expert help and suggestions

1) How can i satisfy visa officer that its Purely Human error not deliberate (what kind of documentation i can provide)
2) they both have received seperate notices so should i reply separate or can combine in one reply for both Parents (both Parents has different File Number and UCI)?

Your kind help is required to help me to proceed.

Can you tell us the final decision you got?

Hi,

CIC is referring to the 'previous visa refusals' question..... for which you had incorrectly answered 'No'.

When you reply to CIC.... you must state that you had informed the visa office, through CSEs, on February 22, about this genuine mistake.... on your own.... Also, you informed the visa office well BEFORE you received the Procedural Fairness Letters today.

Also, did you provide any UCI Numbers + mention your parents had previous TRV refusals.... in the covering letters which you submitted with your parents' current TRV applications?
I am in simillar kind of situation.I informed my represntative everything about my previous refusals and sent him the old forms he applied without updating the forms. Now he has sent a apology letter stating that it was mistake by their office and I have attached all the emails I have sent my representative informing about the previous refusal.

Thanks artin2015,
I talked to consultant here and they advice me to apply for Visa again with Proper Cover letter what happened. Because ATIP notes suggests my Explanation to Misrepresentation has not been on File. and by the look of things after 30 days they close the file, it could have been possible (very slim chance) if they have had my explanation they possibly could have granted the visa.

So i am still not sure. very complicated situation.

Thanks for the advice. Appreciated

what will happen if i do not respond to their claim?
You will get a TRV refusal + a 5-years ban for misrepresentation.... if you do not reply to a Procedural Fairness Letter.

If you do respond.... you must have convincing evidence to prove that the visa officer erred in his/her decision.... and that there are no grounds to ban you from entering Canada

Adding to what Bryanna said..
If you do not reply to Mis-representation they will add code "Retired" after 30 days and will put 5 years ban

- I re-applied in hope because my Explanation was not added to my file. so i am hoping there is mis-communication which could be saving in disguise for my Parents.

Thanks

You'll have to give us the full content of your letter if you want help (although obviously not your personal details).

One was mine and the other my sponsor's. Both were obtained from our respective banks.

It's very hard to answer questions when you provide so little details about your situation. Provide as much information as you can. What were you applying for? Visitor visa? Something else? Where are you from? Where is your sponsor from? What is your relationship with the sponsor? Where are you banks located? Did you or your sponsor make any large transactions recently (e.g. large deposits)?
