Hello there., I am in a bit of confusion here. When I applied for student visa my consultant showed 9 months of experience.
But when I came to Canada my employer was being nice and issued me 1 year experience letter, so except for study visa whenever I applied for off campus work permit, pgwp, and work visa I showed that 1 year as I had that experience letter on me.
But now my doubt is when I apply for PR, which experience should I mention. Should it be same as it was in student visa or should I continue mentioning 1 year as I have that letter.
Also I don't have paystubs for entire year. Have just for 9 months. What do I do. Please suggest

I made a very bad decision of going ahead and applying showing 1 year experience. But did not have paystubs and bank deposits to prove that. My file was refused because of insufficient documentation.

My question is can I apply again with 9 months experience(i won't have to provide any documentation as I won't get any points for that)... don't want to get banned. .please help
If you still have 9 months of work experience as of today, you cannot apply for PR under Express Entry//CEC.

first of all, can you clarify what is the actual amount of work experiance you have? is it 9 months, or is it one year?
If you indeed have only 9 months of experiance, and tried to show it as 1 year ( even with the letter from your employer) than I have to say you should consider yourself lucky for not having even worst consequences than having your file refused. You are lucky that your were not accused of misrepresentation.

it is all written down in the "reasons for rejection thread", around the time it happened.

it was a mistake on their part, they asses me for temporary residence, not permanent residence.. a lot of people were later rejected for the same reason, and got their applications reopened

You were not able to prove ur 1 year f experience that is ur file was rejected. If they had to reject based on misrepresentation they would hav done till now bcoz in study permit and in work permit ur work details r different. Go with what u can prove.

Very sorry to hear about that. PCC from India? Din't you go through BLS for the Indian PCC? Both LOE and the receipt are good supporting documents but wonder why they din't send you a request again or there was no estimated date mentioned on it? Do you have the PCC now?

I just got refused PR for the reason below. I'm a Sept AOR who paid RPFF in Oct.

In your Express Entry profile you indicated as your highest level of schooling a Vocational and Technical
Education Certificate, however the Canadian equivalency of that certificate is that of a Secondary school
diploma. In accordance with paragraph 11.2, I am refusing your application because I have found that
you no longer possess the qualification on the basis of which you were ranked under an instruction given
under paragraph 10.3(1)(h).

Your point score at the time of your Invitation to Apply was: 475
Your new point score is: 350

The lowest point score in the draw that you were invited in was: 469
Following an examination of your application, I am not satisfied that you meet the requirements of the
Act and the regulations for the reasons explained above. I am therefore refusing your application.

When I sent my European Trade Certificate details in to WES they gave me a terrible assessment stating my 5 Year Trade apprenticeship was only equivalent to completing Canadian Secondary School. Based on that my points sat at 350. When I added my Canadian Red Seal Certificate as another form of education my points increased to 475. I guess I got to send in a CSE?

Any advice greatly appreciated.
Sorry to hear about your refusal. May I ask which visa office was processing your application?

Bad news but I will obviously appeal. Please help me.

I got a refusal for my application due to stupidity of CIC.

They said that I got refused due to declaring 2 or more educational credentials but only one submitted. However, it is clear in MYCIC that I only got one with complete uploaded docs.

This is plain stupid.

I checked it all over again but it was really correct.

And even based on my gcms notes, they identified it.

I don't understand why would poorly assess.

It's a cost of delay again.
Sorry to hear about your refusal. May I ask which visa office was it and have you heard anything from them when you appealed?

Hi everyone, my app has been refused , May AOR, and file submitted on 25 may 2015, I dont know what to do now. It came as a big shock after a very long wait. what should I do now can anyone suggest me. :-[

I have now completed the assessment of your application for a permanent resident visa as a skilled
worker. I have determined that you do not meet the requirements for immigration to Canada.
Section 11.2 of the Immigration and Refugee Protection Act directs that an officer may not issue a visa or
other document in respect of an application for permanent residence to a foreign national who was issued
an invitation under Division 0.1 to make such an application if – at the time the invitation was issued or at
the time the officer received their application – the foreign national did not meet the criteria set out in an
instruction given under paragraph 10.3(1)(e) or does not have the qualifications on the basis of which they
were ranked under an instruction given under paragraph 10.3(1)(h) and were consequently issued the
invitation.
Citizenship and Immigration Canada invited you to apply for permanent resident status based on the
qualifications you claimed in your Express Entry profile. Those qualification claims and the
accompanying Comprehensive Ranking System (CRS) points awarded were summarized in your
invitation letter.
In your Express Entry profile you indicated that you had Canadian work experience. The Ministerial
Instructions Respecting the Express Entry System states that For the purpose of this section, Canadian
work experience is work experience that is acquired by the accompanying spouse or common-law partner
of the foreign national in Canada in one or more occupations listed in Skill Type 0 Management
Occupations or Skill Level A or B of the National Occupational Classification (NOC) matrix; consists of
full-time work experience, or the full-time equivalent for part-time work experience, with one or more
employers; and is acquired within the 10-year period preceding the day on which points are assigned to
the foreign national under subsection (1). Furthermore, in order for the foreign national to be assigned
points under subsection (1) for the Canadian work experience of their accompanying spouse or commonlaw partner, the foreign national must specify in their expression of interest the four-digit code in the
National Occupational Classification that corresponds to each of the occupations that the accompanying
spouse or common-law partner has engaged in while accumulating their Canadian work experience; and
the spouse or common-law partner must have performed the actions described in the lead statement for
the occupation as set out in the occupational descriptions of the National Occupational Classification, as
well as a substantial number of the main duties, including all essential duties, as set out in the National
Occupational Classification.
I am not satisfied that you meet all these requirements. You have declared Canadian work experience
with Nexera Wireless under NOC 6221, Technical sales specialist. Based on evidence you provided, I am
not satisfied that you sold wholesale a range of technical goods and services, such as telecommunications
services and computer services, to governments and to commercial and industrial establishments in
domestic and international localities. Furthermore, I am not satisfied that this employer is a wholesaler
that caters to governments and to commercial and industrial establishments in domestic and international
localities. I am therefore not satisfied that you the actions described in the lead statement for the
occupation as set out in the occupational descriptions of the National Occupational Classification nor that
2
you acquired experience listed in Skill Type 0 Management Occupations or Skill Level A or B of the
NOC matrix for this period.
In accordance with section 11.2 of the Act and Subsection 82(1) of the Regulations, I am refusing your
application because I have found that you do not possess the qualification on the basis of which you were
ranked under an instruction given under paragraph 10.3(1)(h). This change in your qualifications resulted
in a loss of points that brought your rank below the lowest ranking person who was invited to apply in
your round, under the Express Entry Comprehensive Ranking System.
Following an examination of your application, I am not satisfied that you meet the requirements of the
Act and the regulations for the reasons explained above. I am therefore refusing your application.
You will receive a refund of the Right of Permanent Residence Fee that you have paid
You must remove your Job Seeker profile from the Job Bank website as you are no longer an Express
Entry candidate. You must also remove any references that you are a candidate for Express Entry from
any private job board websites, if you used any.
Subsection 11(1) of the Immigration and Refugee Protection Act (IRPA) states that a foreign national
must, before entering Canada, apply to an officer for a visa or for any other document required by the
regulations. The visa or document shall be issued if, following an examination, the officer is satisfied that
the foreign national is not inadmissible and meets the requirements of this Act. Subsection 2(2) specifies
that unless otherwise indicated, references in the Act to “this Act” include regulations made under it.
Thank you for the interest you have shown in Canada.
I am so sorry to hear about your refusal. May I ask which visa office was it?

regards

Better to upload the scanned hard copy (WES Stamped).

Note: Wrong thread to ask this question though...

Hi Concorde,

Sorry to hear this. I crossed similar situation. I have not included indian PCC for my spouse as i only included Middle east pcc where i am staying currently.

They rejected next day i submitted my application.

In your case, they should not do that as you have included LOE. However, i suggest to send CSE and also create new profile simultaneously. If they open your application, you can withdraw new one.

I think that cic has a reason to beleive that indian pcc can be acquired within the 2months and thats probably the reason they stated as to you did not put enough efforts to secure one.

Can any other cec applicant comment on this please?

This could help other candidates aswell.

Hi concorde sorry to hear about this situation. To a broader point, can you explain why it takes such a long time to get PCC in India?

I am from Australia and when I order my Federal Police Certificate I get within 15 business days. From what people on this forum write it seems like Police are hesitant to provide the Certificate. Same applies for Indian Universities. From what I read from people's posts on this forum it seems like its impossible to get transcripts sent to WES or other ECA assessing organization. In contracts my Australian University sent my transcripts to 'University of Toronto School of Continuing Studies' in 7 working days.

Am I missing something?
