Hi,
I am confused about several of the personal details questions. I am separated for a year and half now from my spouse (not the person I am sponsoring), who was and is my first and only spouse, and I was never in a relationship before that.
My understanding is that for Question 8 a) I should put Legally Separated, and then for b) the date that I was married.
Then for Question 9 (Have you previously been married or in a common law relationship?) I should check No. I assume this only applies for people who have been married (common law) previously to the marriage they are currently in.

Can anyone advise if my understanding is correct on these two?

Extremely confusing. If you are separated for a year and a half from your spouse, then you would obviously have to answer "yes" to Question 9. Why do you think that would be a "no"?
 
Partly because when filling this section the form gives me an error when I choose Legally Separated. It says the answer you have selected is invalid in relation to Question 9 and I must select Yes to question 9 (which I did at first). Maybe the form has problems. And also the boxes to name your spouse in Question 8, seemed redundant since they are very much the same info to be provided for Question 9. But now I see that those boxes are greyed out depending on the selection made in Question 8.
But I get it now.

Are you already common-law with your current partner? Were you sponsored by your previous spouse?

Question 8 is referring to CURRENT marital status for this application. Assuming you are sponsoring a common-law partner, you put common-law.

Question 9 is Yes and you list your separated spouse. You will then need to explain in an LOE that you are still married but legally separated.

You had posted that your partner was a citizen of the UK . Conjugal is typically used when there’s a immigration barrier . What’s the immigration barrier in becoming common law ?

Expect a refusal for conjugal. As your partner is from the UK, you have no legal or immigration barrier preventing your from becoming common-law, regardless of a reported approval for "John and Jane".
