Query regarding online free payment

Hi,

I am Canadian Citizen living exclusively outside Canada and about to sponsor my husband. I am doing my payment on-line through CIC website. I got confused regarding the payment in Family Class.

Sponsorship application (per application) $75.00
Principal applicant $475.00
Spouse, common-law partner or conjugal partner of the principal applicant, or where a transitional provision applies, a family member of the principal applicant who is 22 years of age or older $550.00
Right of Permanent Residence Fee $490.00

I think the first two, Sponsorship application and Principal applicant $75 and $475 are correct but I am not sure between the third Spouse, common-law partner or conjugal partner of the principal applicant, or where a transitional provision applies, a family member of the principal applicant who is 22 years of age or older $550 and the fourth Right of Permanent Residence Fee $490. Which one payment I need to make from the last two? Can someone also confirm me the total payment in all I need to make?

My second query is regarding the refund of my fees. What if I am approved as a sponsor and my spouse does not get approve for the PR? Will I be refunded back?

Please advise.

I paid the fees highlighted in red.
Sponsorship application is for you. That is not refunded if you are declined.
Principal applicant - your husband.
Right of Permanent Residence Fee - you do NOT have to pay this up front. If you are afraid of being rejected, DO NOT PAY THIS RIGHT AWAY. Once he is approved, you will the be asked to pay. It will just add about a month to the process, that is all.

If I remember correctly, the total was somewhere around $1,040 CAD.

My application was refused. Can I get a refund from CIC?
No. Once we have begun to process an application, the fees are not refundable.

Thanks for the information, but when I check on Form no IMM1344E it mentions as follows:

If you are found ineligible to sponsor, indicate whether you want to:

Withdraw your sponsorship application . All processing fees less $75 will be refunded.
Proceed with the application for permanent residence. Processing fees will be retained.

I am confused. Please advise.

I was advised by our Settlement worker to mark "Proceed with application anyway". This signals that you are more serious about the application, apparently (no idea if that's true though).

Check one box to indicate how you wish to proceed if you do not meet the sponsorship requirements.
•If you check the box to withdraw your sponsorship application then
◦the sponsorship application will not be processed. All fees will be refunded, except for the $75 sponsorship fee.

•If you check the box to proceed with the application for permanent residence then
◦the sponsorship application will be refused. None of the fees will be refunded.

Note: Check “proceed with the application for permanent residence” if you submit an undertaking of assistance to support the permanent residence application of a family member or close relative on Humanitarian and compassionate considerations.


In other words, in practically all cases you check the box to withdrawal the application if sponsor if ineligible. You ONLY check the box to proceed if you have a humanitarian/compassionate consideration case.

If YOU are declined, 99% change your principal applicant will be declined as well. If you are declined and you check that box, all of the fees your paid EXCEPT the $75 used to assess you as as sponsor are refunded. If you don't check that box, and they continue to process it if you are declined as a sponsor, you get no fees back.

When YOU are declined, your principal applicant has not even been looked into yet. There is absolutely no way to find out if they are accepted or declined until months down the road. The only way to get ANY fees refunded are for you to check that box, and if you get declined, the fees (except the fee that was $75 used to check you as a sponsor) are refunded.

If you check the box that you want it refunded if YOU are not approved as a sponsor, but you ARE approved, then later on find out your principal applicant is declined, you get no refund.

So, the only way to get any kind of refund WHAT SO EVER is if you indicate you WOULD like a refund on that page if YOU are not approved. Whether or not YOU get approved decides that gets refunded.

You were given some very bad advice...for two reasons:

1. It does NOT, in any way, mean that you are more serious about the application.

2. (most importantly) If the sponsor is denied, there is no way that the applicant's PR will be approved.

I doubted that that as well but didn't think to double check. Luckily, I stood my ground on other things (i.e. outland application vs. inland) even though my husband was ready to take her every word. Either way, thanks for pointing it out, hopefully this helps others. At least as far as I can tell, I will be eligible to sponsor since I don't have any flags in my file (canadian citizen, working with Option C proof, no previous undertakings), so hope it's a non-issue.
