So heres a plan regrading getting PR in Canada.

My gf is a canadian citzen she is moving back in two weeks and i want to join them. We cant do common in law sponsor as we have been apart for six months but are now back together.

Was thinking of going over for six months thing get married and then apply for PR. My concerns are they might see it that we have done this for other reasons which isn't the case we love each other and are currently engaged just haven't tied the knot yet.

I would do my side of the application in the UK get medical. police record. We have some evidence like the letters to her house as I did live with her for year before we had a break with my name also we have pictures together.

When we get married and we have the certificate then my gf can do her part of the application. I cant work in these six months I know that but my gf would get a job and earn the money for us while im a house husband as she does have a child from a previous relationship and we have built over time a strong bond. My concern is they may think she isn't earning enough etc.

After six months I come back to UK for a few weeks then come over again for another six months while application is still in process.

Problem is they might get funny as I have no job to come back to or a house of mine and they might get funny as to why im coming over again for such a long time.

Would love to hear some thoughts?

Hi!

A few points:

Make sure that the police record is not more than 3 months old when CIC receives your application. It will probably take a month or two to get all your stuff together, so plan accordingly - get your police certificate only when you already think you can send in the application within a couple of months.

Yes, you can apply as soon as you get married and get your marriage certificate. (Heard this can take a few weeks too...)

Start compiling all the evidence you have - pics of you two together, letters/emails/online chats if you have any, letters from friends and family saying they know you two to be in a genuine relationship, etc. We also included receipts of trips we took together, passport stamps to prove vacations together, screenshots of skype to show calls, screenshots of facebook to show our relationship was public amongst our friends (and we also screenshotted comments people left when we changed our facebook status to engaged, etc.) and we each wrote a personal statement about our relationship, our reasons for deciding to settle in Canada, and our ideas/plans about the future.

If you are a UK passport holder, you can visit Canada, and before your 6 months are up, apply for an extension online. Costs 100$ and takes about 4 weeks, fairly straightforward procedure and not likely to be refused. So you don't have to go back to the UK to reenter Canada for another 6 months - although if you want to return, you can of course.

It's a good idea to be honest when crossing the border - just DO NOT say you are "moving". Technically you are visiting. (That means don't bring furniture and appliances... just normal stuff you'd bring for an extended trip.) You could buy a refundable return ticket so that it looks like you're leaving within 6 months. (There's nothing wrong with changing your mind later, canceling your ticket and applying to extend your visitor status.) If they seem suspicious, you should give them to understand that you are only allowed to stay for up to 6 months and will leave or extend your visitor's status within that time, and that you know you cannot work or study. You can say you are getting married and applying for PR outland. As long as you seem to know what the rules are and seem to want to go by the rules, they should be fine.

Good luck! Ask again on the forums if you have any questions. Everyone's supportive and helpful. I just got my COPR (confirmation of permanent residency) today! Feeling good :)

Oh and I forgot:

there is no minimum income requirement for your spouse to sponsor you. She just cannot have claimed welfare or declared bankruptcy recently.

Thanks so much for the advice very helpful.

Could I do my part of the application here and take it with me so when my partner does her bit its ready to send together or do you send them separately?

I saw on the CIC it said the person being sponsored shouldn't quit work until application is accepted Whats your thoughts?

Is it worth leaving my accounts open over here as that shows im intending to return and have a reason to?

With all the eveidence do you print it off and attach to the application?

So you got all your family to write a statement of the relationship and done one yourself?

So at the border I just state that im coming to see my fiancé as she has just moved back we are getting married and I have a application for PR ready to go and she will send it all off upon my arrivial to Canada? And also state I understand the rules and I intend to return or extend my stay close to the six month due date?

Your sponsor sends the whole package (usually in 3 parts - the sponsor's part, your part, and relationship proofs) so you can take it to her.

They say you shouldn't quit your job because there's no knowing (if and) when PR will be granted. I guess they just don't want people knocking on their door saying "I quit my job for this! Come on with the PR now!"

If it's not a big deal, you might as well keep your accounts in your home country open. Who knows, could be useful in the future and sometimes banks don't let you (re)open an account if you're not there so it would probably be good to keep one at home. I'm not sure if at the border they will see a bank account as a reason you will return to your home country, though. (After all most banks allow online banking so you'd be able to access your money without leaving Canada.)

Yes, like I said, the application is in 3 parts - the sponsor's forms, the applicant (your) forms, and another part that consists of relationship proofs like photos and whatnot.

We got friends and family to write short letters (they were not notarized) - both sets of parents, my husband's siblings and nieces and nephews, his friends who have met me, and my friends who have met him. I think there were about 12 altogether. (I don't think that many is necessary - we were just ultra cautious). My husband wrote a 2 page statement about us, and I wrote a much longer one. I forgot which form it was, but one of my (applicant) forms had something at the end where it said I can write about the relationship and explain why it is genuine, or something like that.

I guess at the border you could say you're coming to see your fiance and you're getting married. Personally, if the border officer seems satisfied with that, I wouldn't volunteer my plans for the rest of my life. Of course, if the officer seems a little skeptical about my plans, I'll say I am planning to apply for PR, and that I understand the rules, etc.
(When I entered Canada in March after submitting my PR application, I said "visiting my husband" and the officer started stamping my passport so I didn't say anything else. But when I went through customs (I had things to declare) the customs guy asked me if I was doing the "six months thing". I don't know if he was fishing around for me to say something suspicious, and I don't know if he was authorized to make any remarks about me into their system, flag me or something, but I told him honestly that I'd already applied for PR and was coming to Canada to wait it out with my husband. He seemed satisfied with that, and stamped my paperwork.)

Thank you so much for the info you have been so helpful.

So how long did your application take to be granted?

You go for six months then just extend your visit?

The plan is for me to be a house husband while she works is this ok do you think as I know I wont be able to work?

I'm Japanese so my visa office was Manila, which has a processing time of 15 months. (That means it takes 15 months for most (80%) of apps to be done.) Luckily it took just under 7 months (after sponsorship approval) and I will be "landing" as a PR very soon. (just have to pop over to the US border and come back in.)

I came here in March, and in August I applied online to extend my visit. I asked for 1 year, and they gave me 1 year. (I've heard sometimes they can give you less than you ask for, but you can ask for another extension again before that extension is up.)

So yes, I've been a housewife for the past months. Fortunately my husband has a full time job so he can provide for us. I've heard of couples being stressed out and not getting along because one can't work and feels helpless, the other is overworked and tired, and money is tight, etc, plus in most cases (except Alberta maybe?) you have to buy private health insurance. So I think it's best to be prepared for stress and anxiety... that said, the London office seems to be processing apps much faster, I think a lot of UK people who applied after I did got their PR before I did.

Good luck!

Just make sure your application is really really good - no missing forms and documents, no missing signatures, no discrepancies of dates etc., because these things can hold it up. Submit good quality proof (photos seem to be one of the best proofs you can submit), and yes, I'd say the personal statement (essay) counts too. You could describe your relationship not only with your fiance, but with her child as well, portraying yourselves as a family.

Be careful that you are not sending an outdated form! If you take your portion of the forms to her and she waits to send everything in, there's a very good chance that at least one of your forms will have been revised by CIC. This often (but not always) leads to the entire application package being returned.

Also, are you aware that once you are married and have submitted your PR application, you can simply apply to extend your visitor's status? This would be a lot easier (and cheaper) than returning `home' for a couple of weeks.

FYI...In your original post you stated that you had in fact lived with her for at least one year previously. If you can prove that, you may be able to apply [now] as Common-Law, since you have met the requirement (in CIC's eyes at least) and your relationship is still ongoing. It would all depend on what the `break' was that you mentioned, in the same sentence:
"... before we had a break with my name also we have pictures together."

Good luck!

I'll just add that if you are coming to Canada prior to submitting the PR app, it's a good idea to pay the application fees ahead of time and have the receipt when you enter.

We are getting married in Canada in November/December so we wont have done the application until were married.

I know I need to do my police check in UK but can I get medical in Canada for a outland application or would this need to be done in the UK as well?

Would it be better to marry in UK or still ok to do so in Canada?

Would I need to get medical insurance when I go over for six months?

it doesn't matter where you get married. either will be recognized as legal marriages. yes, if you plan to be in canada long term as a visitor, it's recommended to get travel insurance in case of accidents or illness. visitors are not eligible to receive governmental healthcare in most, if not all, provinces. alberta and bc may be different, though it's been reported getting approved for healthcare as a visitor requires a lot of untangling of red-tape.

Another question now!

When I apply or when application is pending if I had a loan in the UK I was still paying back would that affect my application in anyway?
