I think thats not true bcoz i saw on some another forum mid may files approve so dont trust these cic agents give you new information every time you call so call them again on monday me to will call on monday

Ottawa loses legal battle over immigration backlog

Ottawa has suffered a major setback in eliminating its immigration backlog after the federal court ruled the government is obliged to process all applications it accepted into the system.

About 900 applicants under the federal skilled workers' program sued Immigration Minister Jason Kenney for violating the pledge to assess and finalize decisions in a timely fashion.

They asked the court to order the immigration department to process their applications within a reasonable time frame.

In a decision released Thursday, Justice Donald Rennie rejected the minister's argument that the delay is justified because he has the authority to make policies.

“The minister can set instructions that permit him to return some applications without processing them at all, and thus obviously there is no further duty in respect of those applications,” the judge wrote in a 24-page decision.

“However, for those that are determined eligible for processing, the duty to do so in a reasonably timely manner remains.”

In February 2008, the law was changed to give Kenney authority to issue ministerial instructions regarding which applications would be eligible for processing and to remove the obligation to process each application received.

As a result, the litigants argued, their applications were “warehoused” in a lengthy backlog from five to nine years.

Despite the new measure, the court said Ottawa still failed to finalize a file within the six and 12 months Kenney promised — the first ministerial applications have been outstanding between 24 and 52 months.

Immigration has until Oct. 14 to finalize the application of the case's lead litigant, an IT project manager in China.

Although the court falls short on making an order for all 900 applicants, Thursday's decision sets the stage for the prompt processing of the other litigants.

“So long as the applicants are not to blame for the delay, a fair application of Justice Rennie's ruling would require Ottawa to finalize their applications by October 14,” said their lawyer, Tim Leahy.

The decision is final because the court refused the minister's request for appeal, added Leahy. The next step is for opposing counsels to determine how to proceed with the remaining cases

Hi,

Our initial sponsorship application from our daughter in Canada was sent to CIC in June 2011. There has been no acknowledgement of it till date, nor any correspondence regarding providing file number.
Does anyone have similar or different experience in this regard? How long should awarding file number take? Thanks...

i personally think it has a negative effect on parents' files. Sinnce CIC will now have to get back to these skilled workers cases in a hurry. Thus, our parents' files might remain untouched.

Let's all hope for the best. But it is very obvious that Ottawa slowed down for parents/grandparents cases.

Do you guys know by chance if the CIC agents can provide information about receiving request to update the file that was sent by fax ? I mean, I sent them a fax with the request to update my file + my daughters birth certificate and was wondering if they can confirm that the fax was received and added to my file ? Does anyone have similar experience in this regard ?

i agree with you and now it will take more time for further processing .......... well finger crossed.

Did the agent give any reason why?
I am still waiting for the approval. This would be really bad news if it was true.

Do you know guys if the sponsors from Quebec are in the separate queue ? Also, I filed a CAIPS 2 weeks ago, but did not get the answer from them yet...

I heard it usually takes 4-5 weeks to get the CAIPS notes. Sometimes it takes even longer.

yes, Agents by phone can tell you your fax is received. Even if it is in CIC-O office. (confirmed)

I did not get any AOR from the local office either, it has been 2 months since approval/transfer (but I got the file # from Mississauga communications)

Following up on my earlier post (regarding being representative and seeing my address as mailing address with c/o and my name)

Just checked my parents ecas again - out of pure curiosity :-) (using my dad's info and parents' file number). Interestingly, now I see my mailing address (as it was before when it got udpated) but the part "c/o <my name>" disappeared.

Looks like someone updated something again.. But still no communications and still have no idea where our file is. Will try calling again on monday.

He did not explain why and I thought he thinks that I just applied for the sponsorship. But he said that understood my question and comfirmed again that we have to wait about a year in order to get approval for the sponsorship... :(

Hi: I am new to this post. I don't have a file number for my parents. Why I cannot see their info while using IMM5401 payment receipt number and parents' info?
 
I have added my case to the timelines... I want to thank everyone for keeping this forum going. I have been following it for awhile and finally have decided to join it. Seeing that others who sent their paperwork towards the end of May are still waiting for AOR gives me some hope. Although, I sent the documents via Canada Post Priority and paid extra $$ for one business day delivery, the signature was not collected for my package...
