No Steaky. What you listed here are rules for income taxes payable (which you do mention). Residency is a completely different issue. This is why old retired folks spent their time in Florida less than 6 months a year not to lose their healthcare coverage, for example. You simply lose all the benefits if you are outside of the country for more than 6 months.

Well I will call CRA and tell this specific situation and let you guys know.. So according to beachman you are 100% sure that people on parental leave travelling more than 6 months CRA will take their money back right...??

There is no question in my mind that if you are out of the country for more than 6 months, you will not be allowed any benefits whatsoever.

Beachman...So I read more than 183 days outside Canada in a tax year. How about if I live until august this tax year 2015 and away until april 2016 Then I am more than 183 days in tax year 2015 and 2016 right? I am asking this question so it gives me more ideas to ask question..

ok I called revenue agency. They told they can talk only about child benefits and not about EI. So child benefit they may be asked me to refund if I proved to be a non resident. She suggested to me to send a form before I go to determine if I am resident and they will tell you if I am or not depending on what I say there Whereas EI parental is determined by EI people and I already called them last week and they told yes, I can. but I am going to call again and ask them specifically about non resident issue and about refunding.

Even sometimes they give parental benefit to permanent resident of other country.. lol

Your permanent residence is in a country other than Canada or the United States
If you permanently reside in a country other than Canada or the United States, you may be eligible for maternity and parental, sickness or compassionate care benefits if you have worked in a job in your country of residence that is insurable under Canada's Employment Insurance (EI) program.

That form they give you is useless. Also be careful what agents tell you over the phone as most of them are also useless. The final call will be made by CRA. I will tell you this. If this was me I would not leave for longer than 6 months. The odds on this one are against me.

If leaving Canada for 8 months with your child you must freeze your child benefit payments or you; kk be asked to pay them back with a penalty. You also should look at the residency requirement for your provincial healthcare. You may be out of Canada for too long that year to retain health coverage.

I have been in this situation specifically myself and feel as though there is a lot of misleading information in this forum that is not based on facts.

First, lets distinguish that there is a difference between EI and Benefits (such as CCB).

For EI purposes, you can continue to collect your maternity/parental EI, even if you are out of the country for your entire maternity leave. I was out of the country from October 2018 to June 2019 and continue to receive my EI payments. Entitlement and eligibility for EI maternity leave is difference from other forms of EI, in that it does not matter that you are out of the country, only that you must inform EI that this is the case.

"Absence from Canada
Although you can receive EI maternity and parental benefits while you are outside Canada, you usually cannot be outside Canada while you are receiving other types of EI benefits."

On the other hand, eligibility for other benefits (such CCB) is very different.

You can only continue to receive the CCB is you remain residency status for tax purposes. I also continued to receive the CCB while I was on my maternity, as I always intended to return to work after my maternity leave, as well I maintained other ties in Canada that classified me as a factual resident for tax purposes.

However, if your plan is not to return to Canada after you maternity, and you maintain no other ties in Canada, you are not eligible to receive the CCB.

Side note : You are not milking the system if you have been paying into these taxes and meet eligibility requirements.

It is always best to check with CRA to determine if you are eligible to receive CCB when leaving Canada for a significant amount of time. Every situation is individual and there are a lot of “mays” in the description of who is determined to be a factual resident.
