HELLO EVERYBODY.

I STARTED WORKING WITH MY COMPANY ON MAY 6, 2013 WHICH MEANS THAT THIS MAY 6 I CAN APPLY FOR PR UNDER CEC RIGHT? MY NOC IN UNDER CLASS B.

THERE'S JUST ONE THING IM CONCERN ABOUT.. I WENT FOR A VACATION ON FRIDAY, DECEMBER 28, 2013. I WORKED THAT WHOLE DAY, SINCE I HAD EVENING FLIGHT SO YOU MIGHT SAY THAT I STARTED MY VACATION ON MONDAY DEC 30,2013. MY FIRST WORKING DAY AFTER VACATION WAS JAN, 20 2014. THAT MEANS THAT I WAS OFF FOR 3 FULL WEEKS. BUT I WAS PAID LIKE I WAS WORKING FULL TIME.

MY QUESTION IS: CAN I COUNT THOSE 3 WEEKS UNDER MY WORK EXPERIENCE SINCE I WAS PAID FULL TIME, AND APPLY RIGHT AFTER MAY 6, 2014??? I SAW SOME POSTS THAT CIC ALLOW ONLY 3 WEEKS OF VACATION BUT I WAS PAID FOR ALL 3 WEEKS.

MY WORK PERMIT EXPIRES ON MAY 31, 2014. THATS WHY I WORRIED TO APPLY FOR PR UNDER CIC AND AFTER THAT FOR BOWP BEFORE IT EXPIRES.

PLEASE HELP ME WITH YOUR ADVICES, THANK YOU

Paid vacation is fine, you can go ahead and apply for CEC
However I would wait a week just in case of any descrepancies on the VO's side.
You probably won't get your aor in time so research BOWP options (such as applying by paper so you go onto implied status)

An allowance for a reasonable period of vacation time will generally be made in
calculating the period of qualifying work experience (e.g., a two-week period of paid
vacation leave within a given 52-week period in which the applicant was engaged in
qualifying work experience). An allowance for normal vacation time during a period of
qualifying work experience cannot be used as a substitute or proxy for meeting the in-
Canada element of the work experience requirement (i.e., work experience obtained
outside Canada will not be considered as though the applicant had been on a period of
vacation in order to be counted as part of the period of in-Canada work experience).
While officers will account for a reasonable period of vacation time in calculating the
period of qualifying work experience in Canada, each application is considered on its own
merits with a final decision based on a review of all the information available to the
officer at the time of decision.

Hi ljiljka007, I am also almost in same situation as yours.

Thanks "eds1275" for providing the useful info link.

I completed 1 yr working exp two weeks before and during this one year, I travelled two times for total 2 month to offshore and working from there. And during this two month, I was getting full salary paid from my canadian employer.
Can this 2 month considered by CIC to complete 1 year CEC experience?

2) As per CIC link (page 10)
" Note: Work experience acquired while under implied status will be considered as eligible work experience under the CEC, provided the applicant continued to work in Canada under the same conditions as their original work permit until a decision was made on their application for a work permit extension."

Currently I am on implied status as my work permit expired 2 week before and waiting for work permit extension approval and working under same condition, designation & role.

a) If in case, my wp extension application get rejected, in this situation, can CIC consider my implied work experience?
b) Under implied status, Can I apply for CEC PR?

Please help me and provide your suggestion.

Hey everybody,

sorry about caps lock being on. I didnt mean anything bad with it, and Im still relaxed :) Caps lock looked better back then, but now I see it was wrong idea. Sorry again, I wasnt yelling or anything :)

Thanks for all the answers, and help. So just to confirm with everybody :) You suggest me to wait one more week and apply then?

I was planning to apply for BOWP via paper, because of that time gap. I know that I cant get it on time if I apply online :) But seems like they are working faster now, people are saying that they receive AOR in less then 4 weeks. Thats a good news, I guess ;)

One more question regarding to that vacation time.. Does employer have to write something about it in reference letter, for exaple when I was using it and for how long?

If you were out of the country for two months, then this would appear in your travel history. While there is an allowance for paid leave, I doubt that two months would be considered reasonable, and work performed outside Canada's borders doesn't count for CEC.

That depends. Generally, implied status lasts until "a decision is made" on your application. That decision could be either an approval or a refusal. It could be that your application is refused for some administrative reason outside of your control.

But if your application is refused for being without legitimate grounds (applying for something you weren't entitled to, applying to extend a kind of permit that isn't extendable, etc) then there is a good chance that they will consider this work to be 'unauthorized', and therefore not eligible for CEC.

It doesn't matter what your present status is. You don't even have to be in the country. Just make sure you have the required amount of qualifying work experience before you apply.

What about vacation time in reference letter that employer has to write? Does he have to say anything about vacation time, and what?

The letter does not require any specific information about paid vacations. It may be a 'red flag' if you were outside Canada for a significant amount of time when you claimed to have been working here.

I was outside just for 3 weeks, and it was paid vacation time.

I'm just asking because I dont want my application to be returned because of some "stupid clerical" mistake :)

Probably more like 100%.

You can apply for a BOWP before your AOR comes, provided that the AOR has indeed been issued when they open and process the application (I applied by paper to buy some time). The OP may be able to use this technique.
