Hello everyone.

I have a spouse OWP as I came with my wife last year while she's studying her master's degree here in Canada.

Last month, we applied for both: post-grad WP for her, and an extending for my OWP, however, at that time she did not have a full-time job! And we found out later that she has to have a full-time job with NOC 0, a or b!
So that means my application to extend my OWP is going to be refused!

I have a full-time job and Iknow if I get refusal and apply again after qualifying for it, it's going to take another three months of waiting. And I know for a fact that I'll not be eligible to work during that time (after getting the refusal and applying for it again).

So, is there any way to cancel my application and apply again now after she has got her full-time job?
They also require to attach three pay stubs, but her first day is tomorrow, so I'm planning to wait for the first one and then re-apply if I could!
Does anyone know if I can call the CIC and explain the issue to them so they might cancel my application or at least open my application for me to upload more documents?

Another question please, if I kept working after getting the refusal until I get the response for the second application, what would happen? What might happen?
Please note that my wife and I are already has our EE profiel with 425 points!

Hi

You can withdraw your application yourself.

You can try applying with just one payslip but don't be surprised if it is refused.

You submitted an incomplete work permit application, so your app can be rejected as such. If you continue working beyond the expiry date of your current work permit and the app is rejected as incomplete, you will have worked illegally. You can expect problems if you do that.

Unless you can submit a complete application (which means the required 3 payslips and everything else) while your current OWP is still valid, you should stop working completely after your current permit expires until you actually have a new valid permit in hand.

As I said, unless you submit a complete application with the required 3 payslips, your app may be rejected as incomplete, which means that you won't have had Implied Status and would have worked illegally. The decision to take that risk is yours.

I understand they are asking for 3 payslips.
But by the time I get the 3 payslips, my application will definitely be refused, so i think my chance with a job letter and a one payslip is much better than having none of these!
I’m going to explain that she just got the job and I have a job and I don’t want to lose it in the letter of explanation.

But again, how can I withdraw my application? I couldn’t find any such option on the CIC website to do that?

P.s. I have a friend who had it worked without any payslips. But he had the job contract.

No idea how long it will take to withdraw.

30 days is not a requirement. You can apply to extend up until your status expires.
