OUTLAND VS INLAND (Visitor Visa, OWP)

Hey Guys,

Please help. My husband and I got married April 2018 in India. I have now gathered all necessary documents for his outland application and About to send it out.

But looking at some of the INLAND Application forums, I am thinking differently. I am wondering if I should apply for his visitor visa instead and once he comes here to apply for his OWP and inland sponsorship application.

My whole idea behind thinking differently is because he could be with me sooner if his visitor visa gets approved rather than waiting a year apart while his OUTLAND application is in process.

Please advice.

It's really a personal choice but visitor visas have a high rejection rate. Only way to find out is to try applying but it may get you nowhere.

Thank you, but if it does get approved - inland would be a better option? Coz if we do go this route my husband will have to quit his current job.

It's a personal decision, no one can make it for you.

Inland: both applicant & sponsor have to be inside Canada at the time of application. You can apply for an OWP in conjunction with the inland app. The OWP takes 3 to 4 months to process. Frequent travel is not advisable on an inland app. If you are denied re-entry at the border your application will be abandoned. There is no appeal option if you're rejected. Inland applications are processed consistently at 11 to 12 months.

Outland: applicant and sponsor can be inside Canada or outside Canada, together or apart. There is no work permit option with an outland application. You can travel on an outland application and there is an appeal option if you're rejected. Outland apps are generally processed faster than inland. That being said, they've recently switched the outland office from Mississauga to Sydney and it's incurred some delays.

A last question that comes to my mind - if my husband comes here on a visit can his application for sponsorship (INLAND) and OWP be sent within a few days of his arrival or does he have to wait a while on his visit visa and then apply?

You have to be inside Canada to send the application. The spousal application has to be sent with the OWP application. The OWP Takes 3 to 4 months to receive after you apply.
