outland new delhi while staying in canada

hi guys!
I am new to this forum, but after joining i feel there is ample knowledge to gain...
I am confused about inland /outland spouse sponsorship process. I am currently on visitor visa in canada.
My concern is that if i apply outland, New delhi visa office will request for my passport after a month or so, then i will have to go back to india.
Is there any other way to avoid such situation.??

If i apply inland, i will not be able to leave Canada during the entire process approx. 18 months..

Yes, you're in a difficult situation since as I understand it your passports are prohibited from being sent across international borders by mail or courier, etc. I believe I recall it has been done however by at least one forum member, but not so recently. I am not sure if it's even allowable for someone else to deliver your passport there for you. But even then, being stuck in a country without your passport for such a long time would not be wise either.

Yes, that is also the drawback of an 'inland' application, (you're not supposed to leave Canada). At least with an inland application you can apply for an OWP (open work permit) simultaneously which you cannot do with an outland application.

Indeed you have a tough decision to make. I'm sure others will throw in their two cents.

There isnt a rule that says "you can not leave if you apply inland". People recommend you not leave simply because if you do happen to be refused entry, for any reason, then your application will be invalidated. Also if CIC believes you are residing outside canada they will reject the application, so it would be inadvisable to leave for a ong period of time (severals months).

I think what sometimes happens is CBSA sees you have a visitor visa, which means you have to leave Canada when it expires. But they also see you have a inland app for sponsorship, which means you wont be leaving canada at all when your visa expires. And so some CBSA officers take that as a reason to deny entry. It's weird, but its very possible to happen and that is why people say it is risky to leave while applying inland.

If you apply outland, then the first step will be having CPC-Mississauga approve the sponsor for stage 1 approval. This takes approx 1 month. Only then is the app sent to New Delhi visa office for applicant processing, and when they would ask for your passport.

So just submit your app around 1 month from when you are already planning to return to India, and you should already be back there by the time they ask for your passport. Then you would just continue to reside in India until your PR is approved.

Actually i have to go to India for some academic purpose on a short trip.

But i have no idea whether CBSA officers will allow me to enter..
Can we get some affidavit or something approved from CIC regarding this? Have you ever heard about that?

No, if you intend to return to India during processing DO NOT APPLY INLAND. Especially if you will be out of Canada for a few months, CIC can simply cancel your inland application. Inland app requires you live in Canada with your sponsor during the entire processing time. Plus there is no guarantee you will even be able to get a TRV to return back to Canada, also in which case your inland app would be cancelled.

Apply outland.

I have read it somewhere that i can even request new delhi visa office to allow me to send my passport after some time as i am residing in Canada. Does it result in the delay of the process or its fine to do so?
