hello everyone!
here is my story - my gf overstayed her visa for about 2 years by now!
she got married and divorce in those 2 years!
we met 16 months ago! and we are living together for 1 year now(12 months)!
my question is - what is the best thing for us to do now? apply outland under common law? are they gonna reject our application because of my gf status? i am born canadian! we have 100000 proofs about our relationship! 10 -12 letters from friends and family! we have hundreds pictures! we have joint bank account! we have phone bills, where its shows every our conversation, we goona print out our sms messages from phones!

our relations ship is true and honest and i would really love her to stay with me!

sorry for late reply .. i went visit my family ..back in Europe .. for one week and came back yesterday xD
we r still working on our application... its getting there..
i need do meds... but i already got police paper .. when i was visiting my family..

You can sponsor her inland, you are able to sponsor a spouse common law that is out of status, she can not work and the process will take considerably longer, or she can return to her home country, if immigration has not caught up to her yet, they will not know she has over stayed, so if she leaves and you apply outbound it will be fine and you would not have to worry about any issues about her expired visa, and the outbound tends to be considerably faster.

Since she will have to account for her whereabouts in her application, immigration will know she overstayed in Canada.

Sorry, I was not thinking of it in a sponsorship way, and of course you would have to disclose everything. I know a few people that over stayed, returned to thier home country applied for another visa and were given new visas, it seems they do not keep track of who leaves the country. But in this case, yes you need to be honest as possible, I apologize for my bad advice

no no its ok! if i would apply for work visa or something different - yes i could leave the country, and canada has no idea i overstayed, but in my case, we need to provide proofs and pictures, and joint bank accounts.... so I hope my honestly going to help me :)

It certainly will, I also know a few people that applied inland that were out of status and they have completed the whole process and been approved and are living happily in Canada now :) they were all honest that they had over stayed so I am sure you will be just fine :)
