Thank you for your advise. Now that really worries me. Do you think it is still advisable to send OINP change in information form to add info of the child?

(Disclaimer : I am no expert , just trying to help. Please take professional advice from some Immigration law firm)

Once the child turns 19, he/she is no-longer considered a dependent

1) Either you will have to withdraw your current OINP application for now and apply again when OINP opens again somewhere around Nov-Dec 2016, then your step-child will be over 19 & hence not considered a dependent. Please research more as I am not sure whether he/she can then be dropped from the application.

2) You can send change in information form with a LOE explaining the mistake. Along with that you would need to send copy of dependents passport (bio pages), updated POF to cover additional person in your application (if earlier POF wasn't sufficient) and proof of divorce/no custody (or else I think they will ask for consent letter/form signed by biological mother that she has no objection).

Post ITA, dependent would need to under go medical test or again some documents/affidavit to prove dependent cannot accompany & you forego future sponsorship rights

Please check OINP/IRCC website so that you don't miss out on any other requirement.

IMHO, you should definitely write to them but you would be best served if you took the services of an immigration lawyer. Also, collect all document related to child custody which you can use to prove that the child is not in your partner's custody.

If your husband does not have custody of the child, then you must do your best to provide extensive documentation to prove the same. Yes, normally, the child does have to undergo medical test but in cases such as this, the parent can request that the medical exam for the child be waived (you need extensive documentation to show that you were not able to get the medicals done in spite of your best efforts because of reasons such : Ex has the custody of the child and she doesn't approve of the child getting the medical done) but this comes at a price - that child can NEVER EVER be sponsored by your partner. S/he has to come to Canada on his/her own merit. This is FYI.



However, if your partner's "child" is 19 years or older at the time of the application, your partner's "child" will no longer fit the legal definition of a "dependent child" according to IRCC.

As a consequence, you cannot add him/her to the application as a dependent child anyway. So, I suppose medical tests are not required in this case.

I suggest that you take the help of an immigration lawyer and get legal advice because this case is a little complicated.

Guys, it was a relief to know that my partner made a mistake! His son is no longer dependent when we applied last year, he was born on Aug 1996 instead of 1997, meaning he is 19 y/o last Nov when filled out our applications, he is no longer a dependent!! I am so relieved!! Thanks for all your advices..
Now, no need to include him in the application meaning no need for him to have a medical or police certificate right?

Nope - Not required. PCC and Meds are required only for "dependents" - Your partner's child was/will no longer be considered a dependent for the purposes of Canada Immigration!

You don't have to worry as he is over 19 now. Good luck :)

Hmmm, now, all we have to do is wait for our nominations.
