Background Check by Visa Office


There are total 9 factors that can cause an applicant inadmissible to Canada during background check.

1. Criminality
2. Organized Criminality (Org Crime in GCMS Note)
3. Security
4. Human and International Rights Violation (HIRV in GCMS Note)
5. Health
6. Financial Reasons
7. Misrepresentation
8. Non-compliance with Act
9. Inadmissible Family Members

Here I explained only about the misrepresentation related background checks which is one of the major background verification faced by many FSWP applicants. I am using the word “Verification” here to relate the Background Check. CHC do verification not only for skeptical applications but also to the randomly selected applications.



Misrepresentation

An officer who suspects that an applicant may be inadmissible for misrepresentation should carefully document the reasons for the concern in their notes. The officer then forward doubtful cases to Economic Class Unit where it undergo different verification processes as mentioned below to find out fraudulent documents. Misrepresented cases are rejected under IRPA Section A40 Act. The reason behind the delay of processing of some applications can be directly attached with the involvement of Economic Class Unit.


Type of Verifications

A. Site Visit (Physical Verification)
B. Telephonic
C. Interviews
D. Supporting Documents Request



A. Site Visit (Physical Verification)

Site visit is found to be one of the important means to tackle frauds. Visa offices do site visit for the current employer and previous employers (In case of claiming points based on skill O, A or B) of the primary applicant. The visa officer verify applicant's identity from the person who issued the referral letter, HR Manager, Colleagues, Receptionist and why not even from the security person. Last year FSWP seen visits in Punjab, Gujarat, Delhi, Karnataka, Andrapradesh, Tamil Nadu, Kerala etc.


B. Telephonic

1. Employer

The visa officer can ring to the number given in the reference letter. It can be to the reception or to the person who issued you the reference letter. Officer will ask primary applicant's employment related queries to employer. The visa officer may treat application as misrepresentation if they find any mismatch between the answers given by the employer in comparison to that given in the reference letter.

2. Primary Applicant

Visa officer can call directly to your mobile or land line number to verify your employment, family relation etc. Most of the questions here similar to that in the interview.


C. Interview

The visa officer can call the applicant for interview if he/she is not satisfied with the documents submitted to CIO or not satisfied with site visit/telephonic interview. The officer uses interview to raise all the concerns relating to employment, family etc. Usually the visa officer disclose the applicant about his/her interview result just after the interview. In case of positive outcome the applicant can get Medical/PPR in few days time.

D. Supporting Documents Request

The visa officer contact the person in writing about the supporting or additional documents the officer required for further processing of the application. VO will give at least 30 days from the time of receipt of the officer's notice to respond. Commonly asked supporting documents are 6 months bank statement showing the PoF, relationship proof (marriage photos), employment related documents (3 months salary slip, offer letter, appointment letter, tax related docs, renewed referral letter) etc.


Few Examples from Last Year Applicants


A. Site Visit

Example 1 (Random Verification)

I have an very important info to be shared to all of the members. We are from Chennai. Members from NDVO came to my husband's office (who is the main applicant) for personal visit and had spoke to his boss who was the reference person and also one on one with my husband for about half an hour. 2 were foreigner guys and 1 indian girl. They came around 8:30 pm last night. They just walked inside the office. They wanted security and front office to identify my husband whether he was working over there and then asked for his boss. When they introduced themselves to his boss and the reason for their visit they had mentioned that it was just a part of the process and this time they have chosen 30 members and out of which my husband is one among them.
In fact this was also very shocking for us. They introduced themselves with their names and they had all our immigration related file details like the cat we applied, ref person name and number and also the consultancy details. our consultant is an ICCRC-CRCIC members based out in vancouver and they have branches in India.

Just keeping fingers crossed and hoping for the best...Rest left to God!!!


Example 2 (Targeted Verification)

I am in a very tricky situation got medical request ppr and rprf on .......
as my bad luck stuck me in a situation where I got a background check yesterday that went terribly wrong as i was on leave for 2- 3 months new staff and messed up all guys help CHC people left with the impression that I presented wrong employment information guys please help this is the only hope I dont know now whether to submit medicals and pp.
i am too numb to do anything i was thinking to leave this job for sometime and my employer knew it all there were some issues in the family as well so I totally overlooked and may be too ignorant once i received meds I was so relaxed it did not strike me that anything like this could happen my noc ....... and VO new delhi it seems to me that game over for me as they made to write my employer that she has done a favour by giving me the work experience letter they enquired like CBI OR FBI and literaally put words in my employers mouth and new assistant finished all for me GUYS.


B. Telephonic Verification

Example 3

My HR informed yesterday there was a call from someone 4-5 days back asking them to transfer the phone to me as they wanted to speak with me. Unfortunately I was out of office then so the HR informed them about the same. My HR had asked them repeatedly who they were and what their contact details were but they hadn't obliged and said they would call back again. Just, as a pre-cursor, they have called the receptionist, asked for me and she wasn't aware who i was, so she just transferred the call to the HR. No call again so far. Things looking bleak folks. Tensed!!! Really Tensed!!! Have my medicals tomorrow. This has to be from NDVO as nobody , not even my friends are aware of my plans.


C. Interview

Example 4 (Negative)

you are all very kind. here is a bit of history

I work in ............... in corporate planning and budget section. our daily activity is nothing crunching numbers and developing forecasts.

the VO was somewhat pre determined not to get me through, he did not ask for any documentation and when I highlighted he unwillingly took in my JD. the questioning started with bit of my history, I am a qualified CPA, ACMA, LFA and a masters in strategic management.

he asked me what I do, I explained a bit of my current role. my information was bit technical as well because it relates to oil and my previous role for automotive sector.

anyways at near end of the interview he said "we had a concern about your application as not in line with NOC ......... and I am not satisfied with your responses" I responded in asking which area can I explain further, he said " your answers are broad" I replied I am only answering your broad level question do you have any specific questions to ask for example you asked about capital management, do you want me to explain about individual perspective a corporate perspective or any product portfolio do you have in mind where I can be more specific. De had nothing to say.

he was typing everything I was saying, I asked him if you can read through what you have written !!! he had a good typing speed but when he started reading I felt the writing was very fragmented and not making any sense......I did make sense!!!!

well our interview last for more than one hour and 10 minutes!! I kept explaining and he kept writing...
at the very end may be because he did not want to give a bad feeling he said we will review and get back to you. at that moment he threw away my paper under his desk like rubbish. I said these are originals if he be kind enough to return and take photocopies instead...which he agreed !!!

so this is the unbiased version of the story. what I feel strongly is that we were not able to connect or may be I was too focused on explaining what I knew rather than what he wanted to listen....!!

I think the decision is final at his end, it was more or less the same case at the start of the interview ............. but this is all very confusing why did CIC accepted my application and why I was sent a confirmation letter. then all of a sudden an interview which was of the generic requirement as was sent o you all.....

I will request for a judicial review of the application and the scenario !!

Example 5 (Positive)

Well, about my interview experience

It was just a pleasant discussion. the man appeared to be just awesome, we made good contact during the interview and that is very important, I kept smiling and cool and answer promptly. I was prepared to discuss many points which I prepared BUT i couldn't get the chance to speak about it, so, if you are doing the same mistake by trying to make list of points to talk about FORGET ABOUT IT. it was bad idea.
All what you need to do is:
1. Prepare the files by your self
2. Make two files, primary and supportive
3. KNOW EVERYTHING ABOUT YOUR PAPERS
4. Bring anything you think that it would help
5. Stay cool and make personal contact and for sure always make an eye contact.
6. Put your hands on the top of each others on the table so that the man can see and judge your body language.
7. Bring samples of your work, it would help
8. The files with protected transparent plastic sheets is very good idea, arrange the documents in the order they requested in the interview letter

So, all my time went into JD discussion in general and paper check and questions to make sure that I am genuine applicant nothing more, although it went for around an hour because I have 4 employment experience.


As many said here, if you are the one who prepared the file and you are genuine in terms of you made the duties in your reference letters and for sure that JDs does match the NOC details then the interview will be such pleasant one.


Congrats to my colleagues who cleared it and best of wishes for the guys to clear it ISA soon.

FAQs


1.How many years of inadmissibility to Canada in-case the misrepresentation gets caught?
5 years ban and inadmissibility for the primary applicant and dependents for any kind of Canada visa(Previous 2 years has been revised to 5 years in the year 2013)


2.How many days it takes for my file to come out of the Economic Class Unit?
It can takes many months. However, based on the current immigration system we can expect the time require for this may not be longer than 4-5 months.


3.I have my sister in Canada but I am self sufficient with my own points and don't want to claim points under adaptability. Can I hide the relative details from CIC and tick the column corresponding to No relatives at the time I fill the FSW form?
No, if you hide the details you are making direct misrepresentation to CIC. Claiming adaptability points is your wish but should not hide the fact from CIC.


4.My site visit/telephonic interview went well. Still I haven't received any positive notification from VO after 2-3 months of waiting. Do I have to be panic?
You do not have to be panic if it takes more time to hear from VO about your application after the background check. Usually your file moves from one BF'd to the next BF'd. After your background verification CHC mark the next BF'd to give you medical/PPR or additional document request. It can be many months depending upon the complexity of your visa and visa officer.


5.Can the visa officer visit my previous employer if I am not claiming points from them?
There is very negligible chance CHC do verification for previous employer if you are not claiming points with that experience.


6.Are the files at VO moving first come first served basis same like in CIC?
Partially. Usually the files follow FIFO at CHC. But here are two cases which can hinder the cases of application.
1. If the application is forwarded for background assessment it divert from the FIFO queue.
2. Minister has the sole power to fast track processing of some NOCs or applications based of the changing labour market. Ministerial instructions also enabled CHCs to prioritize processing of applications such that people who applied to the skilled worker program after 2010 can expect their applications to be processed faster than those who applied before.


7.Can the visa officer reject my file directly without giving me a chance to explain my part?
No. Visa officer can not reject your file without informing you about the reason of rejection by writing or through interview. You will get a chance to explain your part at this time.


8.Can the permanent residency or the citizenship be revoked in-case the misrepresentation is found out in the future?
Yes.

You can choose your visa office as CHC New Delhi or Singapore provided you have at least one year visa to reside in Singapore. R11 (1) Impact of CIC specifies all applicants must submit the application to the visa office responsible for:

A) The country where the applicant is residing, if the applicant has been lawfully admitted to that country for at least one year; or

B) The applicant's country of nationality, or if the applicant is stateless, their country of habitual residence other than a country where they are residing without having been lawfully admitted.

Note:- In rare cases for ensuring the program integrity (To do some or all the background checks given above) New Delhi can transfer your file to Singapore (If filed in New Delhi) and vice versa.

I wanted to understand would they do background verification for spouse too for all employments??

Also, I have not disclosed in my organization that I have applied for PR. If they do a physical verification, I might land up in trouble.

If your spouse is not the primary applicant there is really negligible or no chance that CHC do employment verification but will get verification related to security and criminality.

CHC usually disclose their purpose of visit to the employer. But no need to become nervous about it at this point of time. As I mentioned in the Q6 (FAQ) files at CHC also usually follow FIFO unless until your file is forwarded to Economic Class Unit. Just have a track with the MR of the other applicants in the forum who filed near to the same date as your's. If you find a considerable time delay between the MR of you and your forum mates, that time you inform your employer about your plan to Canada(70-80% of cases move smoothly without the involvement of this unit).

Excellent post.

I've a question on employment. I don't want to declare my current job(it is relevant to the NOC but I don't need the points). The reason being that I don't want my employer finding out. The immigration form itself asks for my current occupation. So I can't lie there. What can I do to prevent verification calls/visits to my current employer? They can do whatever checks they want with my previous employers. Any thoughts? Thanks.

You can prepare a cover letter for that particular job and request CIC to avoid the background check for your current employment. Explain in the letter the reason for the same and mention you do not want to claim points for that. Most probably they will accept your request. Provide as maximum proof/supporting docs you can, relating to your present position, then there is no question of background check (except random verification). Also I suggest you to submit any of your colleagues visiting card (whom you can trust). In-case they really want to do verification suggest them to call your workmate and not to the office (explain in cover letter).

Dear Friends,
I am FSW2014 applicant. I have some doubts regarding physical verification [BC] as my work is mainly on client locations, which changes frequently, than my original head office. My application contains details of my head office [no details of clients]. Now only I came to know about this physical verification part

1. Does every application from NDVO has to undergo physical verification?
2. If any one of the employee from my head office fails to recognize my photo, is that possible to redirect them to my current client location?
3. I claimed points for my previous employment and recently I moved on to another organization. So would they conduct physical verification on my current office or the previous office or both?
4. For NDVO, do we need to keep ITR forms and bank statements as additional docs?
5. My salary slip does not contain bank account number and does not contain the number of days worked in each month. So for previous 6 months I got same salary. Please advise, do i need a cover letter /affidavit from employer for these?

Here I explained only about the misrepresentation related background checks which is one of the major background verification faced by many FSWP applicants. I am using the word “Verification” here to relate the Background Check. CHC do verification not only for skeptical applications but also to the randomly selected applications.



Misrepresentation

An officer who suspects that an applicant may be inadmissible for misrepresentation should carefully document the reasons for the concern in their notes. The officer then forward doubtful cases to Economic Class Unit where it undergo different verification processes as mentioned below to find out fraudulent documents. Misrepresented cases are rejected under IRPA Section A40 Act. The reason behind the delay of processing of some applications can be directly attached with the involvement of Economic Class Unit.


Type of Verifications

A. Site Visit (Physical Verification)
B. Telephonic
C. Interviews
D. Supporting Documents Request



A. Site Visit (Physical Verification)

Site visit is found to be one of the important means to tackle frauds. Visa offices do site visit for the current employer and previous employers (In case of claiming points based on skill O, A or B) of the primary applicant. The visa officer verify applicant's identity from the person who issued the referral letter, HR Manager, Colleagues, Receptionist and why not even from the security person. Last year FSWP seen visits in Punjab, Gujarat, Delhi, Karnataka, Andrapradesh, Tamil Nadu, Kerala etc.


B. Telephonic

1. Employer

The visa officer can ring to the number given in the reference letter. It can be to the reception or to the person who issued you the reference letter. Officer will ask primary applicant's employment related queries to employer. The visa officer may treat application as misrepresentation if they find any mismatch between the answers given by the employer in comparison to that given in the reference letter.

2. Primary Applicant

Visa officer can call directly to your mobile or land line number to verify your employment, family relation etc. Most of the questions here similar to that in the interview.


C. Interview

The visa officer can call the applicant for interview if he/she is not satisfied with the documents submitted to CIO or not satisfied with site visit/telephonic interview. The officer uses interview to raise all the concerns relating to employment, family etc. Usually the visa officer disclose the applicant about his/her interview result just after the interview. In case of positive outcome the applicant can get Medical/PPR in few days time.

D. Supporting Documents Request

The visa officer contact the person in writing about the supporting or additional documents the officer required for further processing of the application. VO will give at least 30 days from the time of receipt of the officer's notice to respond. Commonly asked supporting documents are 6 months bank statement showing the PoF, relationship proof (marriage photos), employment related documents (3 months salary slip, offer letter, appointment letter, tax related docs, renewed referral letter) etc.


Few Examples from Last Year Applicants


A. Site Visit

Example 1 (Random Verification)

I have an very important info to be shared to all of the members. We are from Chennai. Members from NDVO came to my husband's office (who is the main applicant) for personal visit and had spoke to his boss who was the reference person and also one on one with my husband for about half an hour. 2 were foreigner guys and 1 indian girl. They came around 8:30 pm last night. They just walked inside the office. They wanted security and front office to identify my husband whether he was working over there and then asked for his boss. When they introduced themselves to his boss and the reason for their visit they had mentioned that it was just a part of the process and this time they have chosen 30 members and out of which my husband is one among them.
In fact this was also very shocking for us. They introduced themselves with their names and they had all our immigration related file details like the cat we applied, ref person name and number and also the consultancy details. our consultant is an ICCRC-CRCIC members based out in vancouver and they have branches in India.

Just keeping fingers crossed and hoping for the best...Rest left to God!!!


Example 2 (Targeted Verification)

I am in a very tricky situation got medical request ppr and rprf on .......
as my bad luck stuck me in a situation where I got a background check yesterday that went terribly wrong as i was on leave for 2- 3 months new staff and messed up all guys help CHC people left with the impression that I presented wrong employment information guys please help this is the only hope I dont know now whether to submit medicals and pp.
i am too numb to do anything i was thinking to leave this job for sometime and my employer knew it all there were some issues in the family as well so I totally overlooked and may be too ignorant once i received meds I was so relaxed it did not strike me that anything like this could happen my noc ....... and VO new delhi it seems to me that game over for me as they made to write my employer that she has done a favour by giving me the work experience letter they enquired like CBI OR FBI and literaally put words in my employers mouth and new assistant finished all for me GUYS.


B. Telephonic Verification

Example 3

My HR informed yesterday there was a call from someone 4-5 days back asking them to transfer the phone to me as they wanted to speak with me. Unfortunately I was out of office then so the HR informed them about the same. My HR had asked them repeatedly who they were and what their contact details were but they hadn't obliged and said they would call back again. Just, as a pre-cursor, they have called the receptionist, asked for me and she wasn't aware who i was, so she just transferred the call to the HR. No call again so far. Things looking bleak folks. Tensed!!! Really Tensed!!! Have my medicals tomorrow. This has to be from NDVO as nobody , not even my friends are aware of my plans.


C. Interview

Example 4 (Negative)

you are all very kind. here is a bit of history

I work in ............... in corporate planning and budget section. our daily activity is nothing crunching numbers and developing forecasts.

the VO was somewhat pre determined not to get me through, he did not ask for any documentation and when I highlighted he unwillingly took in my JD. the questioning started with bit of my history, I am a qualified CPA, ACMA, LFA and a masters in strategic management.

he asked me what I do, I explained a bit of my current role. my information was bit technical as well because it relates to oil and my previous role for automotive sector.

anyways at near end of the interview he said "we had a concern about your application as not in line with NOC ......... and I am not satisfied with your responses" I responded in asking which area can I explain further, he said " your answers are broad" I replied I am only answering your broad level question do you have any specific questions to ask for example you asked about capital management, do you want me to explain about individual perspective a corporate perspective or any product portfolio do you have in mind where I can be more specific. De had nothing to say.

he was typing everything I was saying, I asked him if you can read through what you have written !!! he had a good typing speed but when he started reading I felt the writing was very fragmented and not making any sense......I did make sense!!!!

well our interview last for more than one hour and 10 minutes!! I kept explaining and he kept writing...
at the very end may be because he did not want to give a bad feeling he said we will review and get back to you. at that moment he threw away my paper under his desk like rubbish. I said these are originals if he be kind enough to return and take photocopies instead...which he agreed !!!

so this is the unbiased version of the story. what I feel strongly is that we were not able to connect or may be I was too focused on explaining what I knew rather than what he wanted to listen....!!

I think the decision is final at his end, it was more or less the same case at the start of the interview ............. but this is all very confusing why did CIC accepted my application and why I was sent a confirmation letter. then all of a sudden an interview which was of the generic requirement as was sent o you all.....

I will request for a judicial review of the application and the scenario !!

Example 5 (Positive)

Well, about my interview experience

It was just a pleasant discussion. the man appeared to be just awesome, we made good contact during the interview and that is very important, I kept smiling and cool and answer promptly. I was prepared to discuss many points which I prepared BUT i couldn't get the chance to speak about it, so, if you are doing the same mistake by trying to make list of points to talk about FORGET ABOUT IT. it was bad idea.
All what you need to do is:
1. Prepare the files by your self
2. Make two files, primary and supportive
3. KNOW EVERYTHING ABOUT YOUR PAPERS
4. Bring anything you think that it would help
5. Stay cool and make personal contact and for sure always make an eye contact.
6. Put your hands on the top of each others on the table so that the man can see and judge your body language.
7. Bring samples of your work, it would help
8. The files with protected transparent plastic sheets is very good idea, arrange the documents in the order they requested in the interview letter

So, all my time went into JD discussion in general and paper check and questions to make sure that I am genuine applicant nothing more, although it went for around an hour because I have 4 employment experience.


As many said here, if you are the one who prepared the file and you are genuine in terms of you made the duties in your reference letters and for sure that JDs does match the NOC details then the interview will be such pleasant one.


Congrats to my colleagues who cleared it and best of wishes for the guys to clear it ISA soon.


D. Supporting Documents Request


Example 6

Hey guys I did my medicals on ........ and submitted my ppt,fees ,required documents n marrage pics on ........ consultant got call from embassy to send the marriage pics again which reached on .............since than no information and no decision made...


FAQs


1.How many years of inadmissibility to Canada in-case the misrepresentation gets caught?
5 years ban and inadmissibility for the primary applicant and dependents for any kind of Canada visa(Previous 2 years has been revised to 5 years in the year 2013)


2.How many days it takes for my file to come out of the Economic Class Unit?
It can takes many months. However, based on the current immigration system we can expect the time require for this may not be longer than 4-5 months.


3.I have my sister in Canada but I am self sufficient with my own points and don't want to claim points under adaptability. Can I hide the relative details from CIC and tick the column corresponding to No relatives at the time I fill the FSW form?
No, if you hide the details you are making direct misrepresentation to CIC. Claiming adaptability points is your wish but should not hide the fact from CIC.


4.My site visit/telephonic interview went well. Still I haven't received any positive notification from VO after 2-3 months of waiting. Do I have to be panic?
You do not have to be panic if it takes more time to hear from VO about your application after the background check. Usually your file moves from one BF'd to the next BF'd. After your background verification CHC mark the next BF'd to give you medical/PPR or additional document request. It can be many months depending upon the complexity of your visa and visa officer.


5.Can the visa officer visit my previous employer if I am not claiming points from them?
There is very negligible chance CHC do verification for previous employer if you are not claiming points with that experience.


6.Are the files at VO moving first come first served basis same like in CIC?
Partially. Usually the files follow FIFO at CHC. But here are two cases which can hinder the cases of application.
1. If the application is forwarded for background assessment it divert from the FIFO queue.
2. Minister has the sole power to fast track processing of some NOCs or applications based of the changing labour market. Ministerial instructions also enabled CHCs to prioritize processing of applications such that people who applied to the skilled worker program after 2010 can expect their applications to be processed faster than those who applied before.


7.Can the visa officer reject my file directly without giving me a chance to explain my part?
No. Visa officer can not reject your file without informing you about the reason of rejection by writing or through interview. You will get a chance to explain your part at this time.


8.Can the permanent residency or the citizenship be revoked in-case the misrepresentation is found out in the future?
Yes.

I would advise you to take any route other than USA. They are agressive and will search youlike you are entering their land. Take KLM , British airways . Because the US immigration are very strict and it will be stressful for your family. Also you will need a transit visa because you have to claim your load and enter again

WHAT TO TAKE ALONG WHEN TRAVELLING:

Depending on your preferred flight carrier ......you should be fine.
As much as possible ,avoid any Arabian carriers because of your babies.
Get some form of temporary jackets for them......even though the tolerance level is low but it's good to have for their temporary use on arrival before you get suitable ones for them.
Make sure you have shoes for them that will temporarily shield the winter at the airport for them too before you get winter shoes for them after arrival.
Medications .....medications ......have them handy even if you have to look like a chemist/pharmacist .This is necessary before you get your health cards depending on which province you land.....it will be mostly needed in provinces where it takes 3 months from registration date to get your health cards.
Even if you're going to provinces where the health card will be available for you immediately (i.e Alberta ),you still need drugs for immediate attention to your babies for cold,cough and catarrh .
Just like you said,you and spouse can endure but be careful not to expose them unnecessarily because their immune system to cold,catarrh and cough may still be low.
I think you should go with handy food for your kids too especially through out the duration of the flight........prepare well for this stuffs if you're taken any Arabian carrier because of their long flight periods.
For EUROPEAN carriers ,the cumulative flight period is around 16hrs and should be fine for you guys to deal with as opposed to average of about 30 cumulative flight time for Arabian carriers

You were asked in a letter sent on November 20, 2014 to provide evidence that you had available funds in order to immigrate to Canada. This letter informed you that your application would be assessed on the basis of the information that was already before the officer and we also gave you the opportunity to respond to our concerns. I have received the requested proofs of funds and I have determined that you are not eligible to Canada as a foreign national by virtue of the fact that you do not meet the Financial requirements necessary for a family of 4 persons ($22, 170) as outlined in section R76(1)(b) of the Immigration Refugee Protection Act and the Regulations:

The skilled worker must

(i) have in the form of transferable and available funds, unencumbered by debts or other obligations, an amount equal to one half of the minimum necessary income applicable in respect of the group of persons consisting of the skilled worker and their family members, or
(ii) be awarded points under paragraph 82(2)(a), (b) or (d) for arranged employment, as defined in subsection 82(1), in Canada.

Your bank statements indicate large deposits which are considered questionable and do not reflect your regular income and savings you would have made over the past 3 years. I am not satisfied all those funds belong to you.
Subsection 11(1) of the Act provides that a foreign national must, before entering Canada, apply to an officer for a visa or any other document required by the regulations. The visa or document shall be issued if, following an examination, the officer is satisfied that the foreign national is not inadmissible and meets the requirements of this Act.

Based on the information that is available, I am not satisfied that you meet all the requirements under the Federal Skilled Workers Class and I am therefore refusing your application.

Really commend your courage in moving ahead against all odds.
I must also congratulate you and the whole family for your current status.
Regarding the time frame given at Passport request for onward submission,Accra will normally give 15 calendar days for the submission of your passports documents...this means that the passport documents must get to Accra facility of the Canadian high commission latest on the 15th day after your receive the passport requests.

I just stumbled on this and felt to share to you here maybe it can help

God Forbid ,If you get a letter in the mail from Canada Immigration advising you that your application for Canadian immigration was refused, do not panic! You have options.

You may be eligible to Appeal your Canadian Immigration Application Refusal to the Federal Court of Canada within a certain period after you were notified of the refusal by Canada Immigration.
You may be eligible to Appeal your Canadian Immigration Application Refusal to the Immigration Adjudication Division (IAD) within a certain period of after your application was refused by Canada Immigration.
You may be able to make a request for Restoration to the Case Processing Centre (CPC) after being notified if the refusal.

Which option is right for you:

It depends on a number of factors such as the nature of the case. Is it a Skilled Worker Application, Canadian Sponsorship Application or Canadian Work Visa refusal?

And it also depends on where the Canadian immigration application was filed and processed. Was your Canadian immigration application filed within Canada or at a Canadian Consulate or Embassy outside of Canada?
Why did my Canadian Immigration Application get Refused?

Generally refusals for Canadian immigration applications do not just happen. When applications for Canadian immigration are submitted to Canada immigration, an immigration officer is responsible for reviewing the application and making an assessment about whether the application should be approved or denied. The immigration officer has guidelines for making decisions on immigration cases. These guidelines are found in the Immigration Regulations as well as Immigration Manuals.

When applications do not meet the various standards and criteria set out in the Immigration Regulations and Manuals, then the likely result is a refusal. It can be devastating to learn that your application to reside in Canada has been refused.

APPEAL OPTIONS (CANADIAN IMMIGRATION)

The formal place that immigration appeals are made is the Federal Court of Canada. Most people choose to be represented by a lawyer at Federal Court.

The Federal Court is a court that has judges who are lawyers. Federal Court is strict, formal and has more complicated procedures. Federal Court involves a two step process. The first step is to file an appeal to get leave which is done by arguing your case by filing documents with no actual appearance at the Federal Court. In order to get leave to appeal you must prove there was a serious mistake made by the visa officer at the interview. If you succeed and get leave, you get the permission of the Federal court to go to step two which is the actual appearance at Federal Court in person to argue the case.

A typical case would be a skilled worker or business (investor, entrepreneur, self-employed) immigration applicant who goes to the interview at the Canadian Consulate or Embassy overseas, meets with a visa officer and fails the interview. The visa officer will issue a rejection letter setting out the reasons for the rejection. The applicant has a limited number of days (60) to respond and file a notice to commence a court action to appeal the case. If you miss the deadline generally you are not able to file an appeal. There are certain special circumstances and legal arguments that can be made that will allow you to continue even if you miss the deadline.

The general procedure for a Federal Court appeal is after the applicant files the Notice to start the action, the Respondent who is Citizenship and Immigration Canada (“CIC”) files an appearance confirming they will oppose the appeal. The applicant receives a copy of the visa officer's files containing documents filed and most importantly a copy of the interview notes made by the visa officer that have been inputted into the government computer. After a review of this material the applicant will file an applicant's court record containing the written argument, photocopies of legal cases and law supporting the argument and the applicant's affidavit that is a written document telling the applicant's story.

The respondent CIC is represented by the Department of Justice (“DOJ”) and they file their argument. The applicant has a chance to respond to the points made by the respondent in the respondent's argument.

If leave is granted the Applicant gets to go to Federal Court to actually argue the case in person. This usually takes approximately 12-18 months from the date of commencing to appeal to get to Federal Court to argue the case in person. If no leave is granted the appeal is ended.

If you fail at Federal Court, you can also appeal to Federal Court of Appeal. If you fail at Federal Court of Appeal, you can also appeal to the Supreme Court of Canada. For both Federal Court of Appeal and Supreme Court of Canada you first must get leave to appeal.

Identification Number

Each identification type will have its own unique identification number. To find this number on your correspondence or official document(s), refer to the identification type below for assistance in locating the identification number.

Client ID Number / Unique Client Identifier

You will find this number, also referred to as a Unique Client Identifier, on official documents issued to you from a Citizenship and Immigration Canada office, Case Processing Centre or visa office where you submitted your application. Immigration File Number /Application Number

Citizenship File Number

Receipt Number

You will find this number on the document that was filled out and stamped when you paid your fees at a financial institution or on the official receipt you obtained when you paid your fees on the Internet. Record of Landing (IMM 1000) number

You will find this number in the remarks; section on the bottom right of the Record of Landing document issued to you by a Citizenship and Immigration Canada office or by the visa office where you submitted your application. Your Record of Landing number starts with a W; followed by nine numbers. (Example: W 000 000 000).

Confirmation of Permanent Residence number (IMM 5292 or 5509)

You will find this number in top right corner of your Confirmation of Permanent Residence document issued to you by a Citizenship and Immigration Canada office or by the visa office where you submitted your application. Your Confirmation of Permanent Residence number starts with a "T" followed by nine numbers. (Example: T100000000).

Apologies for not posting this earlier....

It was partly due to some of our collective concerns for some of our colleagues having pending issues to sort out with AVO especially the resolution of the POF issues and I'm hoping we have taken the right step in the appeal case....I enjoy all of us to always pray for a positive resolution of the appeal to favor them.
Apologies for not virtually joining the eagle's meeting last Saturday....I tried my possible best as may have been communicated to you by the organizers but you guys were too engrossed in your pep talk that I could not get noticed. For many on the Whatsapp group also, I'm sure you know I'm a passive member....apologies for not been active in chatting....I'm lazy and can't keep up with your chat pace....but I have very good buddies who knows how to bring me out of my shell....funny enough, I seems to monitor all the events in the WhatsApp groups. I have too many of us as friends so it will be selfish of me to mention their names by leaving the rest out....I'm used to all the dramas in the house now.
This is just a brief synopsis of the pre and post landing preparations and my personal advice/opinion and I'm sure most of you can contact me here on the thread,via PM,via whatsapp chats especially if you are landing around my vicinity for me to offer my small piece.
British airline was my option of flight despite knowing the benefits of Qatar airline financially. It involve a 6-hour flight to Heathrow airport with a waiting time of about 8 hours. Another 9hrs flight to YYC Calgary international airport followed. Arrived in Calgary at exactly 5.50pm in Calgary to a rousing welcome by the CBSA officials. A declaration form that will be given to you aboard the airline is expected to be given to them once you land. It's in this for that you will first write your Canadian address where your PR cards will be sent to while in Canada. You are also meant to indicate if you coming in with up to 10,000CAD or not. Other personal information are also asked including the type of goods accompanying you into Canada. I gave this form to the CBSA officer who after welcoming me on sighting my COPR and passports, still verbally confirm if I'm with illegal goods or not....this took about 1 or 2 minutes. I was directed to another officer who confirmed the address I want the PR card sent to again and asked me to check if my details were corrected...and I signed the form off.POF question isn't a routine question here to be asked so nothing on cash was discussed. None of the accompanying luggage was checked even though the 2nd officer accompanied me to take the luggage off and once again, welcomed me to Canada. Some forms on information regarding permanent residency, its renewal, citizenship and qualification in later years were handed over to me.Service Canada had already closed for the day so I could not get Social Insurance Number (SIN) immediately. From my experience and in most cases (unless new sets of pictures is been requested for your preparation of PR cards), you can be sure that the PR card will be ready exactly 6 weeks from your landing date and posted by mail to you.
Winter at my arrival time was the best Calgary have had in about 40 years as confirmed by Calgarians even though it was -17 degrees....and -21 degrees real feel. I was told its meant to be between -21 and -30 degrees at the minimum. Coming from a temperature range of about 30degrees, the skin felt the impact as the tolerance level in the winter for your body will just be 5mins before your body start reacting. The good thing about Calgary weather is the “Chinook wind” which is literally called the “Snow-eater”. Its basically a warm wind that eats snow away which makes Calgary weather very unpredictable. The snow partly melt and partly evaporates in the dry wind. History has proved that Chinook winds can raise winter temperature from about -20 degrees to like 10degrees within hours and when the wind isn't blowing again, it's vice versa. In Calgary ...Calgary is so blessed to have this warm wind, I guess most of our kids will know about it in school since they know everything about Canada.The SIN was done the following day with little or no stress after which the nearest registry was located to get the Alberta health card numbers for health coverage which start immediately.
Once you have a date you intend to travel....I will strongly suggest you make plans on accommodation on arrival even before you leave Nigeria know most of us wants to do soft landing with our friends and relatives...it's a good thing but it should not be over-exploited.You need your friends/relatives for better things than accommodation when you land so don't use accommodation as a hindrance to it.
Please get this form (http://www.cbsa-asfc.gc.ca/publications/forms-formulaires/b4a.pdf) and fill it to be shown at the port of landing.On POF issues, it's a generally knowledge that they do not ask but I don't want you to relax because of it.The POF for your family size will actually help you settle down in Canada so if possible, bring more especially as this time is not much of good news for workers in Oil and Gas.The Gospel truth is that companies are not recruiting and it may be until end of the year or early 2016 before things start coming into shapes.This does not say you cant get work....but you need to have reality at the back of your mind.Bankers may find it a bit easier and other professions in sales and marketing but please,prepare for the worst.From statistics,new immigrants takes between 2 to 5 years to settle down in their professions....please don't ask me how I come about it but it's the truth.That been said,some are so lucky to get their desired jobs under three months so who says it can't be you?
If you are landing with friends/relatives, make plans to move out under 4 weeks especially if you have kids. Enrolling them in school in your temporal address may create issues when you get a new accommodation that is not in the same area. Changing your address also entails a lot in Canada so it's better to figure your accommodation out within a month.
Personally have a bosom friend who I can stay with and also an arrangement from my Church for soft landing on arrival but it didn't stop me from securing accommodation before leaving Nigeria was able to make my security deposit before leaving Nigeria (700CAD) for a two-bedroom apartment of 1400CAD monthly. If you are a new immigrant, you will be asked to pay for 3 months because you do not have prior history of rent in Canada (or maybe it's in Calgary).
Searching for accommodation can be funny on arrival as some prefer you to have a pet than having kids....some do not want under 18 living in their apartments......some wants to see an evidence you are working in canada......some wants references from previous landlord....some does not want children...e.t.cthis is just for you to prepare what you meet on arrival while searching for apartments.
Your choice of apartment also matters but the best time to rent an apartment is during Winter....because you will know the full properties of your apartments. AS much as possible, get an apartment that have most utilities included in the monthly rent (especially water and heat).Mine apartment is/was a good bargain even though you may say its expensive. Water and heating is included, internet and TELUS cable is also inclusive. The washing machine and drier is coin operated with 2CAD each for every wash and drying....expensive but it makes you plan ahead not waste resources have all the major malls infront of where I live so its just like when I lived in Ketu few years ago and I can always run into the market to get things for every meal....it saves time to have mall beside/around you.Bus stops are littered around me also and its just a 5 mins bust to Brentwood/Dalthoutse train station.
As much as possible (especially if Calgary is your destination), download “Calgary transit” on your android/iphone fone pre/post arrival because it is needed(other cities have their apps too)....google map also helps alot. Once you have data on your phone,you can never get lost in Calgary. This brings me to choice of fone to use. There are ranges of good networks(between to 1 per month) to use when you arrive Canada but from my investigation and personal experience, wind network comes good for a new immigrant based on my comparative analysis to others.Like I have told some people that landed after me,please don't take mine as a rule of thump.
You will need a network that the monthly package comes with fairly good data usage on it.You will need a line through which you can call Canada and USA for free as part of the monthly charges.You will need a fone to send international txt messgaes and and also call some of your friends back home.”Wind Network” at /monthly gives you 5GB data monthly,unlimited text messages to any mobile number in the world, Canada &US wide calling, free 200 minutes call to any mobiles aside US and Canada on monthly basis...the list is endless.Since you do not have a credit card history, they will get a deposit from you to be refunded back to your line after 6 months since you are on contract with them.You can either bring you unlock phone (provided it works with their network) or better get their phone(which I think is best).For both options,the monthly cost is same so why not get the phone?You can get good smartphones (Samsung or Huawei) with / month and if your taste of phones is higher,you will surely get but with higher monthly charges....Personally,I think you will love their services.
Banking options,from investigations,seems RBC have a soft landing for immigrants in their services and I have found them to be good. Though I know some of us are looking for ways to open one before you land but I am not really in support of it because anything on the issue of money prefer you to be in your right senses at your final destination while signing the forms.Once you open your account in RBC bank,you get to have your temporal debit card immediately pending the posting of your original client (debit) card to your home address within 10 working days.You will also get a credit card with a credit limit posted to your address too.
Schools – Not sure I need to spend too much time on this since we all know kids 5 years and above can get schools as soon as they arrive. Vaccination records are good to bring along for 16 years and below so I advice you this form filled with you when coming (duly signed)...(www.chinacanada.ca/ss/down/immunization.pdf) . For kids under 5,you can just bring their immunization records if it is available. You may need to put kids under 5 at pre-schools at a cost which depends on what you want. Your children are going to enjoy schooling in Canada because they will be virtually competing with the best brains in the world.
Getting a family doctor is easy as ABC here so you need not worry yourself much about it.
Driving – I know most of us are so anxious about driving here which is why there is always concern of using your license to drive for three months on arrival. You can use your Nigerian/international driver license for 3 months but you will still need to surrender it later.Personally,my opinion is to get synchronized with Canadian system by first taking their knowledge test (Class 7).This is like a learner permits which is valid for one year before you can qualify to do a road test.The good thing is that with your Nigeria driver license, you don't have to wait for one year since your license will be verified after you pass the test and you can/will be qualified for a road test within a month and become an expert Canadian driver. The knowledge test consist of 30 questions and you need to score 25 to pass it.The questions are simple with preparations. Job Search – I will advise us all too be prepared for uncertainty especially if you are in EPC,Oil and Gas sector as the fall in the price of crude oil is having a negative effect on employement.To be realistic, most companies are laying off their staff....last week,about 1,000 staff were laid off by Husky Oil coy.The crude oil price is a circle which will soon be favorable again but the truth needs to be told now that currently, it's not favorable some of us. As much as possible, let everyone of us have a backup plans B,C or even D so you don't get disappointed. Some sectors are doing fine but please let us have our plans to set it rolling on arrival. The best way to seamlessly enter into the Canadian system/workforce is to get their certificate. Settling down pace is different for individuals...very few gets settled quickly but they are just few. The bulk of immigrants will take time to settle professionally...it hurts but that is the realistic truth. Survey has shown that it takes between 2 to 5 years for immigrants to settle down professionally so if by chance nothing comes up professionally on your arrival...just know it's a learning curve that will soon straightened with time......don't also forget the God factor for each of us.I'm saying this to encourage us prior to arrival so that couples wont regret ever leaving Nigeria to come here with no realistic professional opportunities in a year!
