Can a chartered accountant (who can usually certify things) notarize my statutory declaration of common law? If so, who does it fall under.
You are given three options.
1. Notary Public
2. Commissioner of Oaths
3. Commissioner of Affidavits
Can I use my chartered accountant or do I need a lawyer?

Is your chartered accountant register with the province as a notary public or commissioner of oaths? If not, the accountant cannot notarize/commission legal documents.

$10 at a notary public . accountant can't notarize .

OK thanks, also, I need some clarification with this particular form (5409)
on the website it clearly states:

This form must be completed and signed by the sponsor and common-law partner, only if the latter is a co-signer on the application

I am not a co-signer, I am simply being sponsored, but Ive read some people on this forum have been requested for it anyway when it has not applied to them, is there anybody here that has any experience with this recently?

There is no co-signers in the family class spousal sponsorship . you need to send it as a proof of genuine relationship . if you chose not ,they may or may not ask for it later .

They asked for it in our application, even though I added a page on why I didn't add it in the first place

According to the rules you quoted, you do not need this form. However, many people are asked for this form anyway, so my advice is to send it in with the application. If the visa officer doesn't want it, it will not hurt your application. If he or she does want it, not sending it in now will delay the application.
