I have another question if change name on all id ,will it affect on my sponsorship process, because I applied with my old name ,
I think I should change on passport only because I will have to renew it due to expiration,on other id s I can change after my husband got visa
give me your advice?
You have to do Legal Name Change/Election of Surname procedure after getting new Indian Passport. (You can do both at the same time too)
When you get both (New Indian Passport with the new name and Legal Name Change/Election of Surname Certificate), you will have to apply for New PR Card with New Name.
There are some rules like.....have to inform and change in Revenue Canada within 60 days of name change. And you will have to change Name everywhere like Employment, SIN, Health, Banks, Credit Cards......Most of them can be done by making Phone calls or Sending copies of Legal Name Change/Election of Surname Certificate and new Passport.
You WILL HAVE to apply for New PR card as soon you get new Indian Passport and Legal Name Change/Election of Surname Certificate. For urgent processing (3-4 weeks) of new PR card, you have to submit proof of travel (return air ticket with its payment confirmation). Normal processing time of new PR with name change will be 3 to 4 months.
Name change on PR card is must (after changing name on Indian passport) to avoid problems in immigration and airline boarding while you return to Canada from India . Due to a mismatch in Surname, Indian immigration and airlines will/may say that you don't have a Valid Visa to go to Canada. And they will/may not accept Canada Legal Name Change Certificate.
If travle date is very near such that you can't get Name Changed on PR card, you can obtain "Travel Document for PR outside Canada" on your Passport from Canada High Commission/Consulates in India by paying CAD 200 and same set of documents you submit/submitted in Canada for PR Card Name Change. Application is to be submitted at VFS in India. This is a one-time travel document on your Passport to enter Canada when PR's PR card validity expires/is lost while they are abroad.
Name change will not create any problem in your ongoing Spouse Sponsorship, if your Sponsorship is approved (SA) and you inform CIC and NDVO with copies of everything. You are advised to send copies New & Old PR Card, New & Old Indian Passport and Legal Name Change/Election of Surname Certificate with a covering letter and other details like file number etc to NDVO too.
If it's difficult to do all of the above, you are advised to get renewed your Indian Passport by adding husband's name at Spouse Name space and without making any change in your Surname.
