Hi Myrah,

I am Dec 2013 applicant and I just received my AOR on Jan 10 2014 (still waiting for SA).

I heard that NDVO nowadays has changed its procedure and that it does not request PP in 15 days but that it has delayed PPR to 2 or 2.5 months from the date it gets the file transferred from Mississauga. Is this true?

The reason I ask is- If I get SA around Jan 15th 2014 or so, I thought my wife (in India) will get PPR around Feb first or second week or so? Is this no longer true.

Pl advise.

Yes i think it has changed to 1.5 or 2 months from the date the file transferred to New Delhi. You could get it by second week of feb or third week. It depends from ppl case to case. Some missed ppr and didnt receive ppr yet so make sure to check your spam folder by email or mail letter. Hopefully you will get ppr so soon.

You can check this link too.

It is not exactly true. Yesterday the President of the Canadian Association of Immigration Lawyer called me. He told me that someone is resident in Canada when live minimum 6 months on Canadian soil each year. So someone can also take 1 month vacation during this period and HE IS STILL resident in Canada...

Yes, that is absolutely true but as we know, immigration sometimes refuses cases based on bogus reasons. If the PR in question had sponsored his spouse for PR and immigration finds out, possibly when trying to contact him that he has actually been outside Canada for the last few months, they will likely deny his application based on him not residing in Canada. Legally he might still be residing in Canada and of course he can appeal but I'm only saying, maybe you are better off trying to avoid having to appeal. It is safer to make short trips only so that the visa officer will have no doubt that the person is residing in Canada and not leave it up to the visa officers definition of how long you can be away to still be considered a resident.

6 month each year in a single go or it may be in fragments?

what I have read is if a citizen or PR card holder lives overseas and applies for spousal visa, he/she has to provide proof that they intend to go back to Canada..proof in the form of owning a house, job offer etc...I am a PR holder and have been living overseas for the past three months and I don't think it is a problem

Hi ,

This is according to cic from instruction guide 3900. now experts has to say this sponsorship eligibility holds on for only one stage or 2 stages of application. In general if its for only one stage which is sponsorship stage any PR can come stay for 1 month after getting all documents submit gets sponsorship approval and leaves canada.

One doesnt need to work also if he can satisfy cic that he/she is capable of taking care

Sponsorship eligibility

In order to sponsor, you must…

be 18 years of age or older,
be a Canadian citizen, Registered Indian or permanent resident,
be sponsoring a member of the family Class,

live in Canada or provide evidence, if you are a Canadian citizen living outside of Canada, that you will live in Canada once the person you are sponsoring becomes a permanent resident.

sign an agreement with your spouse or common-law partner confirming that each of you understands your obligations and responsibilities,
sign an undertaking promising to provide for your spouse or common-law partner’s basic requirements and, if applicable, those of his or her dependent children,
prove that you have sufficient income to provide basic requirements for your spouse or common-law partner’s dependent children. To do this, you must provide documents showing your financial resources for the past 12 months. This requirement applies only when dependent children who have dependent children of their own are included on the application.

did you check how many days sponsor is allowed to leave canada during sponsorship ?.I read somewhere its 15 days.I know ppl visit and stay for some time but with out knowledge of cic. if you are sending passport stamps you are giving proof to them that sponsor violated condition . Thats my opinion decision yours

noo.. i dont think so, your spouce revisit to you n doesnt matter how long you live together after submitting your application before issues visa !!
thnxx

i know so sad of this long waiting. I dont think that you have to redo UK PCC this time so only indian pcc if it has been one year then they might ask to redo pcc for indian only. I hope they dont ask you and give you an extension for a month because your medical expiry date is in one month and half. NDVO are still working on june applicants too. Im pretty sure you will get great news soon before your medical expires. :) :D

it's really getting a bit confusing here and risky to send more proof regarding revisit of sponsor......so i think i should drop my idea on sending more proofs...... :-[ :-[ :-[
