Hi Everyone,

I have one question from members of this group.

I applied under express entry with my spouse. I applied under CEC inland and my wife is back home and she has never been to Canada. We got passport request last month and I sent my passport to Ottawa and she sent her passport to local visa office back home and we both are waiting for our passports.

She is expecting and due date is in August and now I think airlines will not allow her to fly because this is her almost eight month. I just want to know that if she delivers the baby back home then what is the next step? because my baby will need Visa to travel to Canada.

What are the steps to get the visa ?

Kindly give share your experiences and give your valuable advice.

If she does not land in Canada before she gives birth, then you will need to amend your PR application to include your new born. This is the same procedure that your spouse went through: medical exam and passport are needed.

If she lands before she gives birth, then you can choose to sponsor the child for PR.

There is absolutely nothing you can do until the child is born. If the child is born before the primary applicant lands, then you will need to amend the application before anyone can land.

I'm not sure of this case. If the baby is not born in Canada and is born before you and your spouse have landed, then you will have to amend the application. One of the questions at landing is "has your family composition changed?" This question is asked to each applicant individually. So there can arise a situation where the primary applicant has landed and become PR, while the spouse gives birth and must add a new dependent. I am sure you are aware that the ideal immigration solution is to give birth to the child in Canada. Also, your spouse can fly on most airlines with a doctors note. My wife flew from Vancouver to Toronto when she was 36 weeks pregnant.

If you land before the child is born, you will NOT be able to add the child to your PR application. Your app will be closed.

Either you hold off on landing and add your child to the app after the birth or you land now and sponsor your wife and child later on. Note that sponsorship can take up to a year or more, you must be residing in Canada throughout the entire process and the chances of your wife and child getting TRVs to come to Canada during the process are low. If you choose this option, you need to be prepared to be apart from your family for the duration of the sponsorship process.

Your best option to have your family with you sooner is to hold off on landing and add the child after the birth.

Depending on what province they land in the wife also will not have coverage for the delivery. Best to stay at home. Most airlines won't accept someone so far along for an intercontinental flight. Huge risk to mom and baby on top of that.

Your wife can't land after birth of the child without the child being added to the app; since you will have already landed, that wouldn't be possible.

I gave you your options: either you put off landing and add the child after the birth or you land and sponsor your wife and child later.

I've seen some people saying on the forum that adding a new dependants before landing takes a couple of months. In the case of the newbborn, the issue may be documentation. If birth certificates and passports won't take time, then you can expect the process to take up to two months sometimes plus. Andd this is in case your other documents don't expire. Because you may need to take other medical exams for example.
