Would anyone know about the background check time limit of three months? Is that from when they receive your package from Canada Post in their mail room at CIC and someone signs for it, or when they actually get to the file and you get that AOR? Just wondering when I should get my wife to do the background check etc?

Thanks! So when it arrives there by Canada Post and is signed for etc, cool 8)

If we finish a form and press the "Validate" button and print it, and by the time we get to mail it we recheck the gov site to see if there have been any updates to the forms??, can we redo them and Validate again?? Probably sounds like a dumb question but it crossed my mind that a person could easily send outdated forms if it takes a month or more from start to finish till they can all packaged and mailed etc..

Yes, it they update a form before you send the app, you must redo it and validate it again.

Thanks Canuck! I just wondered if when you validated it because of the bar code thing that maybe it was then set in stone, good to know! :)

It's not clear on some things. Can we send photo copies of marriage certificate, birth certificate etc and do all photo copies have to be notarized of those items?

Does my US wife need to take those two Canadian form requests with her to get her background check and fingerprints done, or just go to the FBI site and do it from there?

If she puts my email and address as her mailing address will that cause red flags? She is living at her address of residence in the US but wondered if it's okay for her correspondence to come my address and email in Canada?

1. photocopies do not need to be notarized. follow the checklists. it says specifically to send photocopies of everything except the sponsor's option c form and the fbi record.

2. you do not need to bring anything regarding canada to get fingerprints done. more likely than not, she can get them done at her local police department. she just tells them it is for immigration reasons. She will have to produce some sort of proof of identity, either her license or passport. once you have fingerprints, the application from the fbi site, and your form of payment, you mail it per the instructions on the FBI site.

3. she can put a canadian address as her mailing address if that is where she will be during the processing. doing this will not raise any red flags because it's perfectly legal for her to be in canada as a visitor. definitely put email addresses for both you and your wife, othewise you will have to depend on Canada Post to deliver your communication from CIC.

Thanks! Looking at the IMM 3910 country specific checklist it's not clear to me anywhere as to if copies are okay or not etc.. The guide 3999 is clear and unclear at the same time if that makes any sense :'( The background check wasn't clear either as it seems to allude to filling out two forms they have there and then hand them as instructions to the people doing the background check. She will only be living with me if they let her back in as a visitor again??? She left June 29 after 364 days here legally. We married June 22 just before she went back home. We are hoping that if we show our marriage certificate and the receipts for the fees that they will let her back in August sometime...... We are applying Outland and her home mailing address is with her parents in Chicago.. She has been having email issues so just needed to ask that question as to if it's okay to give my email and address here in Canada as the place to put down on her form for where all correspondence goes..

Also it would seem to me so far that they say to mail all the forms and info to your Sponsor (Me), but they are leaving out the form 1344 it would seem in their info for her? So basically a principal applicant from the US would do everything the instruction guide says and mail it off only to find out at some point when the Sponsor goes through their own guide that there is one more form to sign by the principal applicant, form 1344 etc.. It's no wonder many of these get sent back to people as incomplete :-\

It says right at the top of the checklist: Send originals of the immigration forms (items 1 to 5 below) and police certificates. Send photocopies of all other documents, unless instructed otherwise

I would suggest she put her own details. It's not hard to create a new gmail or hotmail account. Also, her mailing address should be the address where she is physically located, as that is where her Confirmation of PR will go. If she comes to Canada during the processing, she can easily change the address.

For IMM1344, it is the sponsor's responsibility to follow the guide and ensure that the applicant signs it. The sponsor is supposed to fill it out, sign it and send it to the applicant to sign and mail back.

Am I supposed to be on her form 5406? Or does that one not apply for me as the sponsor and her spouse? The guide and checklist do not make that clear to us.. I'm thinking no but??? Edit: Oops! rhcohen answered it for me on page 3. :)

It really could have been more clear on form 5406 as it sort of seems she should include me as I am her spouse.. They should just say right on that form "If your spouse is your sponsor do not include them etc" lol

Someone really should write one of those "For Dummies" books on all this Immigration and Sponsorship stuff for Canada lol, with online updates for every time Forms are updated etc.. 8)

i did put my spouse on that form even though he is my sponsor. since it was a missing form, i figured it was better to be safe than sorry. i have learned since it doesn't matter, since he is canadian.

Here's another example: On question 28 of form 5490 it says for her to click yes or no to indicate if you are currently living with your sponsor. If you answered "No" provide the date when your sponsor returned to Canada. It has a date space thing to fill out with no way for us to put N/A there.. I was never out of Canada as her Sponsor and there is no option to not provide a date lol.. We may just have to write "N/A in ink in the date area for that one. The guide instructs to provide the date when you returned to Canada.. Someone was sleeping when they came up with that one with no other option lol..

Yes, she should list your details on IMM 5406.

The forms are very generic and many questions don't apply to everyone. For the majority of people, question 28 makes perfect sense. The answer is usually yes, they are living together. For the couples that aren't living together, the majority were married or together outside of Canada and are now living apart because the sponsor is a PR and was required to return to Canada during the process or the sponsor came back to Canada ahead of time to prepare for the spouse's arrival. Your situation is the minority.

Anything that you can't properly answer, just explain on a separate sheet. Select No, put N/A for the date and explain.
