I am very confused after looking at the government website as I'm not good with all that stuff, and I have no idea on where to start first? If someone would be willing to walk us through the process that would be very kind.

Quick facts: She came to Canada to visit me on June 30 2013 with a one way flight for a 6 month visit. We got government approval to extend her stay for another 6 months. She just left this past Sunday June 29 2014 one day before the June 30th deadline on a one way flight back to Chicago, and we were married on Sunday June 22 2014 just before she left. I really need to get her back here as her living situation with her family is not so great right now and we miss each other and want to be together as husband and wife.. I am working, own a humble little home, and really want to get this all started so she can get back here asap.

We are thinking that applying Outbound would be best as it's faster and she could still come back and stay here for the duration we hope?

She has our marriage certificate with her. If she flies back here in approx a month after being here for a year previous what do you think are the chances she will be let through? I read about exclusion orders and that would just be horrifying to be banned for a year. If they said that they are doing this to her next time through, she could say she is withdrawing her intentions or something to cancel the order they're making can't she?

apply for sponsorship through OUTLAND. it is the ONLY way that makes sense for us applicants. She can potentially be IN canada while it's processing, enter and extending just the same as last time. While in canada as a visitor, she can NOT work.

There is little chance someone who is married to a canadian is going to be given an exclusion order. Generally, they give those to people who are NOT married and have not started the legwork for PR. My sugesstion is if she plans to come back is for her to show proof of all the paperwork you are working on, paying at least part of the fees, and yes bringing your marriage certificate. They tend to ask for those if there is no record of a PR application in process. If she's denied at the border, they most likely will just allow her to withdraw her application to enter, and she can freely try again with the proper documentation they are asking for. For me, it's always important to carry proof of home ties like my lease and paystubs, because it's commonly asked. Some people aren't asked to prove their ties, some are.

Unfortunately, no one is going to tell you for sure whether she will run into trouble at the border because of her being there for 12 months already. It's very specific by border and the agent you meet. An agent *may* see she's been there for a year, and only back in the states for a short time and get suspicious about her overstaying. THIS is why submitting a pr applicaiton asap or at least compiling all the informaiton to show them true intent on applying is vital.

As for step by step approach. The checklists are pretty straightforward with what you need. My suggestion is to research this forum for threads about US applicants, or clicking on my name and reading my past posts. Plus, it seems you've been posting long enough to get a good understanding of the process. A lot of times people overthink the applicaiton, and get overwhelmed. If you print out all the forms and checklists, you will see it's pretty easy to compile the information. Yes, it's going to take time to do it. It's really not that complicated. The biggest area people have questions is providing proof of relationship. Really it all starts with the checklists on the CIC site. Look for the application links for sponsoring a spouse OUTSIDE of canada.

It's important to note the FBI record is only valid for 3 months, and the medical is valid for 1 year, so it's recommended to time getting those with when you will be sending the application. Current wait time for FBI records is about 1 month, do NOT go by the timeframe listed on the CIC site, as it doesn't update. The FBI site updates regularly about processing results. Medicals are also cheaper in canada, so i would recommend getting it done there. The cic site and applicants guide will point you to the list of approved panel doctors in your area to call to get an appointment.

Current processing time for sponsorship approval is about 2 months, and applicants are landing 4-8 months after that. No one can say for sure why some people have shorter processing times than others. Theories include completeness of applications and the efficiency of the agent handling the file.

Thank you I will try my best.. It may seem simple to many on here but I am drawing a blank and it's all jumbled to me.. I guess it's stress and anxiety over the whole thing and being apart now, and it's not so clear to me as there are so many different links for forms etc.

Start with just ONE document . . . The GUIDE (IMM3900). Actually download and PRINT it (even though it's 40 pages or so long). Then just follow it step by step, one step at a time. You could also read the very first post at the top of this category, it's very helpful.

I feel your pain! Toner just ran out on my 'personal' LaserJet printer. Price of those gouge us worse than gas stations. It's only "ink".

I can't get IMM1344 or IMM 5409 to work for me although 5409 doesn't apply to me.. I assume I need to include 5409 anyhow and just put "NA" through the whole thing?

So it would seem from Guide 3900 that I need to do: IMM 1344, IMM 5491, IMM 5481, IMM 5540, IMM 5409, IMM 5476, and IMM 5401. Does that seem okay and submit all whether they are applicable to our situation or not?

Also that doesn't include all that she will have to do as it seems to note in a section I can't seem to find again right now lol..

You do not need to include forms that are not relevant to you, but you MUST write N/A (or similar) for that form on the document checklist. Otherwise, the person that opens your application package may think that you failed to include them.

It's all here http://www.cic.gc.ca/english/information/applications/fc.asp. Under Part 3, you need to find the country specific checklist for the US.

You don't need IMM5409 or IMM5476. As said above, no need to submit unneeded forms, just put N/A on the checklist.

Follow the guides and checklists.

Thanks everyone and yep it seems simple but it's taking me a bit to get all the red tape and links etc etc.. It says it feels like 104F out, so that's my Canada Day excuse :D Also I can't seem to get some forms to view.. It says I need an updated version of adobe on the gc site but I have XI with no updates available it says :(

Well that first form won't work for me, doh! Even googled problems viewing IMM1344 and saw a posting here from 2012 with the same issue. The link provided wont work and says the same thing lol.. All I get is this:

try using a different browser (like IE) or download the pdf file first on to your computer and then open it.
