My husband possibly committed marriage fraud. Advice/opinions?

Hi all. My husband was approved for Canadian PR the end of November 2013. He arrived December 2013. Since he has been here, he has changed. He became jealous, and abusive towards me. I have found things on his phone (looking up escorts, and calling them).. And just 2 Saturdays ago, he was apparently out with his buddy's. I received numerous text messages from another woman (I texted the number one day because our daughter had his phone, and was calling it at 6 in the morning) I apologized, as my husband said it was his friends wife. This woman finally Text me back today. She said she feels sorry for me, and my daughter, and that my husband is repulsive. She said he followed her off the bus, insisting on going for drinks. She did go with him. She said he told her that he does not like me, that he is here to make money, and for the papers. He also said that he doesn't like having s*x with me, that he is forced to do it. He offered to have an affair with her, and he will help her with money. I confronted him.. He said she is lying, and I should know how women are. He basically brushed it off, and told me to pack up and leave. I'm 11 weeks pregnant. What can I do? It makes me so angry that he is playing me, and my family!! I paid a good lawyer to get him here, and to hear he is using me... It breaks my heart! He doesn't deserve to stay.

Get a good divorce lawyer and take everything. There's nothing you can do that will get him kicked out I don't think...but you shouldn't stay with him.

It's a pity it's been over 2 years and his conditional PR status has changed to full PR. Because if it wasn't yet 2 years and he decided to tell you to get out then you wouldn't be cohabiting And he would be subject to deportation. Get a really good divorce lawyer. If he decides to go you'll be ok as long add he doesn't collect any govt benefits. He will get what's coming to him soon enough.

You'll need to tell us when his application for PR was received by CIC. The specific date is very important and will determine if he falls under conditional PR or not.

Did his COPR document have Condition 51 written on it? That's the two-year conditional PR thing. How long were you married before you applied? Did you already have a kid together when you applied?

If you and your husband were married less than two years on the day that CIC received his PR application, or you did not have a child together before that date, he should in fact have Condition:51 on his PR.

Since his CoPR was issued Dec 4, 2013, the question now is: When did he actually land as a PR?


IF he in fact does have Condition:51, he must continue to live with you, and continue his conjugal type relationship with you (living as a true married couple), until two years have passed from the day that he landed. After two years, he's free to leave.

Since he told you to pack up and leave...why don't you! You can then contact CIC and report that you and he are no longer cohabiting and that he is now in breach of his Condition:51 requirement! HA! That would serve him right!!


Proving [now] that this was a marriage of convenience for him may be very difficult. I wish you and your daughter all the best in moving forward.

The conditional measure only applies to permanent residents whose applications are received on or after October 25, 2012—the day that the amendments came into force. So he still is under term of 2 years and please, do so, contact CIC, and kick him out back to his 3rd world where he belongs.

That only applies if he in fact has Condition:51 on his CoPR. Since we don't yet know how long they were married, or whether or not they had a child together before he submitted his application, we're merely guessing.

Let's keep in mind that sponsors do not have the ability to kick people out. That decision rests with the CIC with enforcement up to the CBSA. All the OP can do is report the marriage breakdown to the CIC.

Sometimes they act on it. Just remember, you are responsible for 3 years.

anyone can be played and that's why wait times are so long !

what are the ways to cancel spouse's PR card? is there any way i can cancel my husband's PR? my husband came here in May 2013.. and i tried to adjust with him but he just used me to come Canada and now its hard for me to live with him but i want to cancel his PR (the reason he married me)

No. Best you can do is report him to the CIC and hope they take appropriate action.
