Hi all,

my brother sponsored his wife and she recieved her PR and came to Canada in August 2022, within a month we noticed a lot of red flags where it was clear she only married for the money and PR status. My brother gave her a divorce on November 23 and luckily managed to send her back home. She does not have her PR card though. But she is trying to get that and fly back here.
Is there something we can do to make her not come back here ? Have any of you gone through the route of reporting marriage fraud to immigration canada ?

She can obtain a PRTD and a new PR card herself. You should submit all the proof you had that she entered a marriage of convenience. Instructions are available online. Very few cases are pursued. You would need concrete proof that this was a planned marriage of covenience and not a relationship breakdown. The best thing to prevent a marriage of convenience is not to rush into marriage, consider living abroad with your partner and see how that goes, etc. Your brother can not sponsor another spouse for 3 years and his ex-wife can’t sponsor another spouse for 5 years.

Yes we are aware she can obtain a PRTD and obtain and PR card. Unfortunately the proof we have is not concrete. She is a pathological liar. She stole money from my mom, stole valuable jewlery, sent money to her family back home, called cops 3x and told them she was “unsafe” but then she ends up coming back to the same house despite feeling “unsafe”. Told my brother verbally that if she wanted, she could have told the cops he was abusing her etc. but my brother also went to a psychiatrist and told him everything (don't know this this counts). At the moment shes also messaging all of our family back home and harassing them, trying to get them to talk to her. One month into the marriage she lied about being pregnant, sent fake ultrasound images, she gave us fake reports but the main report of her pregnancy dissolving, she does not have.

Isn't the fake pregnancy some proof of fraud?

Without taking a position on this: accusations on one side can result in retaliatory accusations that in the end don't benefit anyone.

I'm not qualified to give advice. But I've seen enough to know, your brother is not likely to achieve much by attempting to have her Pr status removed, and he likely has a lot to lose if things get nasty.

He should see a lawyer ot get real advice, and not be surprised if the 'least bad' scenario is to get a clean divorce (as clean as possible), cut all ties and move on.

His ex wife is in India now. The divorce has been filed with the Court. So thankfully that process is done and over with. We just dont want her to come back to Canada and make our life a living hell again and rip off our money. Just wanted to know whether its worth reporting this to IRCC in order to have her status removed as PR.

No one here can answer that question.

Whether IRCC investigates or not will depend on the strength of the evidence you provide to prove this is a MOC. IF IRCC investigates, your brother's wife will have a chance to tell her side of the story. Unless it's super clear cut with hard evidence on one side, the most likely outcome is that IRCC won't bother to look into it or will decide it simply looks like a relationship that went wrong vs a MOC. You should also expect it to take a very long time for IRCC to investigate and arrive at an outcome.

Again, it all comes down to the strength of the evidence you have. Your choice what you do.
