Hi guys,

FYI lang. Information below was posted in another forum. It was a response from CEM. Ang masasabi ko lang, *whew* at nakalusot my current app that they have the passport with them already. Otherwise, it seems that my first old FSW app (2007 which I've withdrawn already) and this current one could have ended up on the same timeline if based on the response below by CEM. Lol!

Looks like those FSW NOC38 applicants who have submitted their full docs to CEM but haven't yet been requested to undertake medical exams would need to wait a few years more (1 to 3 according to the other forum) before their applications will be completely processed.

"This is in response to your request for a status update. Your federal skilled worker (FSW) application was received in our office on 11 January 2011.

Changes to immigration law in 2008 allow Citizenship and Immigration Canada (CIC) to set, through Ministerial Instructions (MI), the number and type of applications considered for processing each year, and the order in which these applications will be processed.

Under the first set of instructions (MI-1) CIC used this new authority under immigration law to control the type of applications received, but not the number. The number of applications received exceed the ability to process them in a timely way. CIC introduced caps on June 26, 2010 on the FSW program as part of the second MI. CIC has limited the intake of new FSW applications to better match the number CIC can actually process within the annual levels plan tabled in Parliament. FSW applications under the second MI are processed on a priority basis.

CIC has received enough FSW applications since February 27, 2008 to reach immigration levels for the next two years. Unfortunately, it will take longer to process those submitted under the first set of instructions (between February 27, 2008 and June 25, 2010) than originally projected. Hay Lord have mercy on us...waiting for PPR...konting konti nlang..if they want the in demand occupation in labour market?...why not process us?...we have the same NOC din nman with the post june applicants?...nurses are also in the second MI....badtrip cla!

Yes, priority po talaga applications under the latest ruling (makes sense because of their labour market needs as they say). Even though caught in bureaucracy talaga those FSW38 and previous apps with NOCs that are listed too in the current NOC29 jobs but so happens to have been submitted before the current ruling came in effect.

And, opo, I think basta nasa CEM na FSW38 applicants' passports right now (submitted in 2010), safe po these particular FSW38 applicants. (*crosses fingers* nga lang since some of us still haven't got them back yet. Lol.).

I'm not sure for other cases though like those who've had their medicals already but no PPR yet. Tingin ko may chance safe rin sila like what we've had 'cause sayang yung medicals and may expiry in relation to the visa. The only difference I would assume would be unlike us, their passports would be requested later but the visas released in a month's time, just when CEM is actually ready to release them. Rather than the passports requested early but released several months later (like what happened to us).

In relation to my last sentence, previous paragraph: I sometimes think the VOs who requested our passports right away at that time were mabait since parang hinabol nila for us (knowing what we know now), if you get my meaning? 'Cause I remember when my medical request was being prepared/sent, the VO called me about it and even emphasized to me to get it done and delivered to them as soon as I possibly can once I receive it in the mail (...parang may hint na sila or something...). I mean when it comes to such things, such an advice would normally need not be said anymore. Pero binanggit. I don't know. Feeling ko lang naman. hahaha!

The most uncertain or rather, affected, by the CEM information I would think are FSW38 applicants who haven't had their medical exams yet, and the the pre Feb.-2008 applicants (like 2004 onwards). But that's just my conclusion out of that CEM feedback.

Si 2010 lang po kasi talaga sure ako and mas nakaka-relate. I didn't say anything about 2011 submissions not being safe. hehe! Only that those FSW38 who haven't had medical exams yet probably aren't. So if naka medical ka na, most probably safe ka whether or not meron nang PPR or passport with CEM.

And again, opinion ko lang po yan based on my interpretation of that CEM feedback. Bottomline, VO decides. Lol. And that feedback is a guide since they've already stated it like it's their policy.

I got the information from the p2c forum. One of the forum members received that feedback and posted it. And I shared it here, + my interpretation. hehe.

hehe! Sorry po if I confused some with my statement re 2010 passport submission.

So anyway, it's 'cause medical exams have 1 year before expiry and this date is the basis of visa expiry that's why I assumed that if one has undergone their medical exam already, then your app has a year in which you get your passport back with visa and hence shouldn't be affected by the said CEM information. Kumbaga parang syang guarantee that one has a year left to be in 'Pinas before moving to Canada vs the timeline that can be surmised out of that CEM feedback -- for FSW38 and earlier applicants who haven't had their medical exams yet -- due to CIC's prioritization policy.

Good luck po sa ating lahat. ;) Talaga po atang lumiliit na ang window to migrate to Canada as time passes. Should be fantastic once we all make it! 8)

hehe! Sorry po if I confused some with my statement re 2010 passport submission.

So anyway, it's 'cause medical exams have 1 year before expiry and the date of medical exam is the basis of visa expiry that's why I assumed that if one has undergone their medical exam already, then your app has a year in which you get your passport back with visa and shouldn't be affected by the said CEM information. Kumbaga parang syang guarantee that one has a year left to be in 'Pinas before moving to Canada vs the timeline that can be surmised out of that CEM feedback, for FSW38 and earlier applicants who haven't had their medical exams yet due to CIC's prioritization policy.

Good luck po sa ating lahat. ;) Talaga po atang lumiliit na ang window to migrate to Canada as time passes. Should be fantastic once we all make it! 8)

Thanks badtzmaru for this informative feedback, I felt for those who will be affected of the new rulings and I hope and pray that our passports w/ PR visa will all soon be released dahil matagal tagal na rin na hintayan lalo na for us residing and working abroad. :D

Yes.. I feel for those affected too. And it's also why my reaction for my own application/case was also *whew* with matching wiping of sweat on the forehead. Lol!!
