Im from baguio city here in the philippines so my agent is locally based... She is giving us sept 22 for $1875 plus rebooking fees for me any daughter via phil airlines mnl-toronto. Its a good price if only the visa is on hand already. So i had second thoughts and reserved the 29th instead... I guess that was a wrong move... I would try to get back the 22nd tomorrow if it is still available for us and keep my fingers crossed that the visa will be with us within the week.

Good luck Iris. I suggest calling DHL immediately to follow up. They just might expedite it a bit if they know you are keeping a close eye on them.

Hi Isisgirl, here are excerpts from my notes while working as BSO:

ENF 1 Inadmissibility

The residency obligation in the Act is based on a period of physical presence in Canada
with provisions for prolonged absences from Canada (three years out of every five
year period for any reason). In certain circumstances, permanent residents including
accompanying family members, are allowed even longer absences when they are
employed abroad. Humanitarian and compassionate considerations, including the best
interests of a child,
will be taken into account in all residency obligation status
determinations and, when justified, will overcome any breach of those obligations that
may have occurred prior to the determination (A28(2)(c)).

You seem to belong in this category. I highly suggest contacting the embassy before making any other arrangements. A simple phone call and perhaps an official letter from them might solve all your grief.

IT ONLY TOOK FROM THE AUG 28 TO AUG 31 TO GET THE VISA TO MINDANAO,,,,,,,THE VISA WAS STAMPED THE 28 AND RECEIVED AUG 31,,,,,,,,, :o WHY DO YOU HAVE TO REGISTER HER WITH CFO :o ,,,,,MY WIFE IS BRINGING A 4 YEAR OLD HE WAS NOT REGISTERED THERE,,,,,BUT WE WERE REQD TO GET HIM FULLY VACCINATED BECAUSE HE IS SCHOOL AGE,,,,

Tagum your wife has to do the pdos and your child registered with cfo to get the stcker on the passport to be allowed out of the philippines. My daughter does not need the pdos but i need to register her to get the sticker

If i get a flight before the 25th, thats before my 3 yrs is up, will there be a problem?

I think i got the information here in the forum. Better check tagum before they get held up at the airport... In the website it says children should also be registered. I did not know that also until i came across it in the forums

Yes maybe tagum. Me i dont need to do pdos bec i have my pr card already. I guess i would be doing it ahead of you so i will let you know what cfo says.

I left that job back in 2007 when I started working for my current job, but I still keep in touch with my former colleagues. I just dont want you to get in trouble when you cross the border nor face any unnecessary surprises. They said the best way to solve your problem is to book a much earlier flight. Otherwise, you have to prepare to explain and back your story why you werent able to comply with residency requirements.

The CBSA enforcement (enf series) manuals are now available online. Please go over ENF1-Inadmissibility and ENF23-Loss of Permanent Resident Status. My former colleagues said you have a strong case with the BSOs when you cross the border under Humanitarian and Compassionate Grounds. But as the manuals state, the onus is on you to prove your case to the BSO. Gather all the required documents to prove your case. Study ENF1 and ENF23, especially section 7.7 of the latter. That will prepare you for the unavoidable interview with the BSOs at your port of entry.

Oh wow that is quite overwhelming and a bit scarry. I know that the residency requirements to maintain a pr status is 2 out of 5 years... So i guess i really have to take the sept 22 flight since i landed sept 25, 2010.

Sounds like an attempted shake down to me.

there's no appointment needed for cfo .. as for the visa as soon as they send it .. call wwwexpress and tell them to expedite the package .. it will arrive within 1 to 2 working days .. at a higher cost but worth it ..

you have to get your daughters passport to cfo for sticker .. and probably might even good to ask them if they would just put sticker on it ... show your passport that you already had the sticker and just need sticker for your kid .. since kids are exempted to the seminar .. you might get a free pass and just pay for the fee..

also .. if you booked independently .. or on an travel agency .. you might not need to re book your plane ticket .. and just search for the same flight details in one of these ..
