My lawyer tried emailing them a month ago and still no response either.. are they keeping my passport on their desk for dust or what like this is so so annoying what can i do?

That's why I have two US passport - which is legal for exactly this type of exigency. Indeed, when I submitted my passport to LA last fall I included a copy of my upcoming travel itinerary and requested they return it by that date. But I wasn't losing sleep because I have a second US passport. This is allowed under US law (they print the exact CFR in the second passport, actually) and it is only valid for 2 years even though it costs the same as a 10 year passport. I first got my second passport because I needed to submit my passport to the Indian Consulate to obtain a visa for India and they wanted it for three weeks - and between my trip to the UK and my trip to India there just wasn't enough time to make it all happen.
At this point though, you may just want to claim your original passport has been lost or stolen - you can say that you submitted it two months ago for a visa and the consulate to which you submitted it no longer responds to inquiries
and you need to travel. Hopefully you have a copy of your old passport's bio page, so you can submit that along with an application for a replacement passport. Then you have a new passport.
If LA ever bothers to send you the COPR and your old passport, you can advise the state department your old passport was returned (though by then it has been canceled). The COPR will work, even with a new passport provided the bio data matches up (though I'd be tempted to take the old passport along as well and say "well, they took so long I had to cancel it and get a new one...")
Yes, this is all a hassle, but if you have no other choice you CAN do it - and you can get a new US passport fairly quickly. If you are in Canada now, you should be able to work with a US Consulate (or the Embassy in Ottawa) to obtain a replacement passport.
Another option is if you need to go to the US you can just proceed to a land border crossing. There are protocols for verifying you are a US citizen even if you do not have your current passport - e.g., a copy of your passport plus other id, etc. They can interrogate you but realize once they have verified you are a US Citizen the CBP cannot refuse you entry, as the right of entry is guaranteed to all US citizens. But that won't get you anywhere other than the US.
