A question:

Sponsor's status is separated but yet to be divorced. Principal applicant status is fine - in common law with the sponsor.

cic recognizes this as a genuine common law relationship and also is satisfied that the sponsor's previous marriage is broken down. Hence, cic approves the sponsorhsip application. Later the file is sent to the principal applicant's visa office for further processing.

Now, will the local office reject the application as the sponsor is not yet divorced? Since some countries do not allow common law for a married person, will the local country laws apply? Or the sponsor being a resident of Canada and the fact that Canada allows the sponsor to be in a common law despite not being legally divorced, will the principal applicant's file would be approved without any issues?

plz comment.

They will use Canada's laws.
