Hi,

My work permit (NOC - B) is expired on Dec. So my employer applied LMO to extend my work permit, but my employer said it would take minimum of 13 weeks.
That means that I can apply extended work permit after expiration day. my question is

1. Is there no problem to extend my work permit if I apply with LMO after the expiration day?

2. Can I extend my work permit at boarder?

3. Is it possible to get LMO in less than 13 weeks?

I'm little bit nervous now if this processing affects my staying and work.

Hi,
1. If your work permit is expired by the time the LMO is processed. You can still apply for a renewal. However because you are now out of status because of the expired permit you will need to send a restoration of status payment as well. (You have to check the choice that you are applying for restoration of temporary resident status as a worker.) You have to do this withing 90 days of your work permit expiring otherwise you won't be allowed to restore status. The catch is that it is an extra $200 on top of the $150 for the work permit And you will not be allowed to work until you get the new work permit.

2. If it is a restoration or renewal I do not think they will process that in the border. I am not 100% sure about that. Maybe someone else knows better.

3. Lmo's take up to 3 months, there is no rush processing. Believe me I have done my fair share of waiting.lol.


Hopefully you can hope for the best and get your LMO atleast 3 days before your permit expires. This way you have just enough time to send in a renewal application. If they receive your renewal just before the permit expires, you don't have to restore it (just a normal renewal process) and You will be on implied status until the new permit comes. Goodluck!

my employer issued the LMO request, my WP is going to expire on April 30th so most probably we will not get an answer before the expiry date.

MY QUESTION IS: can I apply for the work permit extension with the number id of the LMO request?(even if I do not have the confirmation yet)

Hi,

I was on the same situation before, I advise you to Extend your Work Permit 30 days before it will expire. You can ask a letter from your employer saying that LMO is on process. You can apply using the Paper Application so you have an implied status for 2 months while waiting for the POsitive reply from Service Canada for your LMO...

You have to restore your status once your extension was refused, you have 90 days to do it.

If your from visa exempt country, you can go to the border and extend your work permit.

The LMO takes ages these days, If you can see on the thread, sometimes it takes more than 13 weeks, from which province you are applying for it? Sometimes, it varies from province to province...

Don't use online application if you don't have Positive LMO on hand since they will refuse it after 2-3 weeks! Do the Paper Application instead so, you have an ample time to wait for your LMO being processed..goodluck!.
