why don't you call them up and see what they say..if you have applied before that rule came into effect ...you might still be eligible

I have already called hotline and spoke to them about it .

They said if we have recieved your application before Feb 19th then you fall under old rule and if we have recieved it after 19th then new rule applies to you

Old rule - you need to be in USA on valid H1B when Alberta recieves your application
New Rule - you need to be in USA on valid H1B until ALBERTA makes final decision on Nomination

Mine is recieved by them before 19th so old rule applies to me

still i am trying to find any IT CONSULTANT to do my H1B transfer and stay in US while my Nomination comes

When did they recieve your application

They have modified the AINP a bit:

It says that now you need to have a valid H1B even when the final decision is made on your application, not just when you apply. I have a bad luck here too.

My package was received by them on Jan 22nd. So that might be a good sign. I am a mechanical engineer, therefore having difficult time to find some IT recruiter to transfer my H1B.

i feel your pain. i am in quality myself and have been always working for actual companies, never had to deal with these blood-sucking desi consulting companies. my first company refused to file for my green card despite working for ~4 yrs with them. then i started looking for a company that would. i had to struggle real hard, and finally found 1 manufacturing plant that said yes because nobody wanted to come work for them since they (we) are in the middle of freaking nowhere! anyway even though my us green card is filed, my highly qualified wife is wasting her talent at home, and i mean she is "genuinely" qualified in biotech - not those hydbadi "housewives" with 5 yrs of fake exp in india. if alberta works out, we will abandon the us.

i hate to give advise for doing illegal things, but you two just need to maintain h1 status until ainp falls through right? apply fpr a transfer before your h1 expires, and don't opt for premium processing. uscis will take it sweet time to do the paperwork and you still are not violating the law ( at least for 60 days after your last day of work)
i guess rash could try and find somebody to file for an h1 transfer in software quality? get an asq certification in software quality?

i know they are coming down hard on these desi companies, but i would think some are still in "business"

hey chow,

if i understand it correctly, you are only staying in the us for the cic process. hope you are still carrying an h1. i don't know if cic will ask us to prove current h1 status when they review the application.
did you explore the option of going to f1 just to maintain legal status in the us?

just wanted to clarify... if one has already received the AINP nomination, does it mean that you are already safe? meaning, you can go back to your home country, inform AINP of your current status and wait for CIC to complete processing of your application.

i am currently under the old rule. i got my AINP nomination last January 20, 2009.
