Calgary, June 28, 2012 — Citizenship, Immigration and Multiculturalism Minister Jason Kenney today announced the latest step in re-designing Canada’s economic immigration system.steelz said:MI5 ----> PLAY !
Effective July 1st, 2012, Citizenship and Immigration Canada will place a temporary pause on new applications to the Federal Skilled Worker Program (FSWP) and federal Immigrant Investor Program (IIP).
“We have been making lots of changes to our economic immigration system,” said Minister Kenney. “We will take the next six months to do a lot of the heavy lifting to get us closer to a fast and flexible immigration system.”
The pause will allow CIC to make important changes to its economic immigration programs before accepting more applications. This is an important step in moving towards a faster, more flexible immigration system, while immigration levels are at a historic high.
Since the launch of Canada’s Economic Action Plan 2012, Minister Kenney has announced a series of changes to CIC’s economic immigration programs. They include:
eliminating the backlog of old FSWP applications;
improving the selection of FSWs;
creating a new Federal Skilled Trades Program;
modifying the Canadian Experience Class to help transition successful skilled temporary workers to permanent residence;
changing business immigration programs to target more active investment in Canadian growth companies and more innovative entrepreneurs; and
moving towards a new application management system, to develop a pool of skilled workers who arrive in Canada ready to begin employment.
“This temporary pause on new Federal Skilled Worker applications will allow us to set the program on a new course as we intend to launch revised selection criteria soon,” said Minister Kenney. “The pause has no impact on the number of workers Canada admits into the country, as CIC continues to process applications already received. Current immigration remains at historically high levels.”
Application intake is expected to resume in January 2013, when the proposed FSWP regulatory changes – which will be published in the Canada Gazette in the coming months – are expected to come into force.
The Immigration and Refugee Protection Act allows the Minister to issue special instructions to immigration officers to enable the Government of Canada to best attain its immigration goals. Since the 2008 Action Plan for Faster Immigration, four sets of “Ministerial Instructions” have been issued relating to Economic Class applications.
Under this fifth set of Ministerial Instructions, CIC will also introduce a pause on new federal IIP applications. This pause will remain in place until further notice, allowing the Department to make progress on processing its existing inventory.
As Minister Kenney announced earlier in April, CIC will be consulting with provinces, territories and stakeholders on ways to reform the current IIP in order to maximize the economic benefit to Canada. The Department is also consulting on whether to create a new investor program on a short-term basis, to promote growth in the Canadian economy.
The temporary pause on FSWP applications does not apply to candidates with offers of arranged employment or those applying under the PhD eligibility stream. The full set of Ministerial Instructions will be available online in the Canada Gazette tomorrow.

guys there is no end cheer up ....think like this consider the status of prejune 2008 now ...they applied and waited for almost 4 to 8 years and suddenly this man mr jason came and said one day your application i am going to return

mr kenney just merely following the Australian immigration rules if free just go through them it might come useful for us
1) if ur occupation comes under regulated one they will sure ask for assessment from them
2) update your ielts score if its too low becoz 100 % they going to change that
3)try to learn french it will come handy in new rule
4) finally pray God he will not let us down ,even though its temporary setback for all of us,,sure some new things always waiting at back of us which is very good compared to what we missed today

It should hv been done much earlier. energy of those hundreds rushing pillar and post, those who were waiting from two-three years to make it to 67, saving money and cutting expenses to have POF be good conditions, compromising with present job offers and denying local opportunities, not making any progress for just a canadian dream that was not theirs. . . .. . . . Federal plan to dump immigrant backlog on hold as lawyers prepare lawsuit
OTTAWA — A plan to return $130 million in fees and toss 280,000 applications from would-be immigrants — part of the omnibus budget bill that's poised to become law late Friday — is on hold for at least three months, according to lawyers planning to challenge the move in court.
For several weeks now, a legal battle has been brewing as lawyers across the country prepare what they hope will become a class-action lawsuit aimed at reversing the controversial decision to quit processing federal skilled worker applications received before February 2008. That's when laws were changed to give Immigration Minister Jason Kenney more power to determine eligibility.
A handful of lawyers, who between them represent about 700 applicants, say they successfully negotiated a 90-day reprieve with the federal government that would give them time to file their applications in Federal Court.
In that time, Citizenship and Immigration will not be able to destroy the files or proactively offer applicants refunds even though the bill allowing them to do so will have passed. Negotiations are said to be ongoing over whether and how the government should and could notify affected applicants about the pending litigation.
A spokeswoman for Kenney was more vague. Alexis Pavlich said the government looks forward to Bill C-38 coming into force "as scheduled" and that there are "no plans to change the timeline" for processing refunds and eliminating the backlog.
"This process of refunds and backlog elimination will unfold over many months once Bill C-38 becomes law," she said in an email. "This lawsuit will not affect that process."
Had they not received a reprieve, lawyers were prepared to head to court on the first business day after the bill received royal assent — probably Tuesday — to seek an injunction to temporary stop CIC from tossing the applications and refunding the fees.
"Our intent is to prevent the government from implementing the legislation to terminate all the files," said Lorne Waldman, a Toronto lawyer who brought forward a similar challenge back in 2003 that ended with Ottawa agreeing to process the visas and cover about $3 million in legal fees.
Waldman admits the situation is a little different this time as the government has sought to eliminate the backlog through an amendment to legislation approved by Parliament rather than through a regulation that simply changed eligibility criteria.
While he understands officials have tried hard to ensure its plan would not be subject to a court battle, it'll be up to a judge to decide whether there are legal grounds to challenge the decision.
"I think there are problems. I think there are flaws and I think there are legal arguments why this particular bill, as it's drafted, does not in fact achieve what the government wants it to," Waldman said, adding he's reluctant to get into exactly what those legal arguments are before the bill has actually passed.
"The legislation, as it's currently drafted, shouldn't be interpreted in a fashion that is to terminate the backlog."
Toronto lawyer Mario Bellissimo, who represents about 200 litigants, calls the legislation "ill-advised." He asks "why now", when the government has been boasting about how successful it's been at cutting, by more than half, the skilled worker backlog that stood at about 600,000 when the Conservatives first took office.
Noting just six per cent of pre-February 2008 applicants were contacted when the eligibility criteria changed to see if they wished to withdraw their applications and reapply under the new, expedited rules, Bellissimo argued the government could have done more to inform the group of their options four years ago. It might have reduced the backlog then as well as the heartache applicants are facing now, he suggested.
"We've made our way through hundreds of thousands (of applications) in four years so the timing and this sudden necessity to get this done is very curious to me," he said, noting the government should have been "straightforward" about its plans.
"Give these people a chance to be a partner in the process. Treat them with some dignity."
Bellissimo said he understands the government's concerns about wanting to make sure the skilled workers Canada accepts today meet current labour market needs and that applicants in the years-long backlog may now be past their best-before dates.
But he argues the legislation as it exists allows the government to refuse admission to someone who meets the eligibility criteria and scores the minimum 67 points on the skills checklist if it's determined that they would "likely not become economically established in Canada."

I think the issue here was that CIC should have treated those aspiring to apply with dignity by making the announcement regarding the changes earlier like what AU immigration did (i.e. Skillselect). Most or some of those who were waiting for the new MI shouldn't have incurred unnecessary fees (e.g. preparing their docs.) or have foregone other opportunities if this kind of change was announced a few months in advance.Ayan Nadeem said:
