Issues with Application Outside Canada - Vienna Office

Hi everybody,

I have couple of questions concerning my application for permanent residence.

First I will tell my story in short...

My wife and I have applied for permanent residence in October 2010. after we got married (summer 2010.). Application is been received and accepted by Quebec and Canadian authorities sent it to Vienna where it had arrived on late November 2010. and they started to process it middle January 2011. Meanwhile I am visiting Canada on the tourist visa 6 months which is expiring in August 2011. Still there is no answer from Vienna and online it says in process,medical received and everything is fine. What is concerning me is following... I made my medical exam on 2.September 2010 and it is expiring in a less then a month from now.

1.Can I do it right now again or i need to wait for Vienna to contact me about it and if my visa is been approved tomorrow can i pick it up even after my medical expires?

2.I have also applied for tourist visa extension and still waiting(late June 2011.).Do i have the right for implied status or not?And what implied status includes ?

3.I wrote Vienna email asking if everything is fine cause i heard a lot of stories when letters get lost and time expires, example interview and medical request.Should I call them or wait for response...it is been 2.5 weeks since I wrote email.

4. And finally I have a question about landing after PR is approved (Still hoping!).
Can I by the law, if I am still in Canada while PR is approved somehow get my permanent residence while here in Canada. I mean is there a way to get PR visa here or the only possibility for me is to fly to Vienna and get it. Like i send my passport for stamping and receive it here in Canada or something like that.

So in general I am still waiting for response from Vienna for PR, wait for email response from Vienna,wait for tourist visa extension, waiting for my medical to expire, waiting , waiting....waiting for a world to change. While war criminal are walking on the streets under false names and stolen passports! It is so frustrating!

It says Vienna waiting time 8 months and I wait already 8 months and 10 days.

I can give you a bit of information!

1)My husband had the same situation with medicals, we did his again prior to being asked and I think it speeded up the whole process. His expired in May 2011, we did it the end of April and he got his PPR on June 17. I'm sure if we hadn't done it that it would have added another couple of months to the process.

2)As long as you've submitted your visitor visa extension application you can remain here until you get a decision from them (regarding the visitor visa) with implied status.

3)No idea

4)When they ask for your passport, you send it to the Vienna office, they put the visa in and send it back to you (here in Canada). Then you have to leave the country and come back across the border to "land". You can just drive to one of the border crossings (but check to make sure the one you go to does immigration stuff!) cross over to the US and then immediately come back into Canada to land. You don't have to travel to Vienna to get the actual visa. My husband's passport is currently in Paris, we're just awaiting its return and then we'll drive down to the border to "land".

It is very frustrating, some offices seem to take much longer than others - we were lucky, my husband got his PPR in 4 months 28 days, so we were fortunate. Hang in there!! At least you're here with your wife :)

Hi there Kaycee1!

I understand everything what you have said and it really make some sense now...especially this sending passport thing. I have called Call Center for Immigration questions and there i spoke with a guy who had told me that the only way to pick up my visa is to go to Vienna, but I knew that wasnt true...it is probably the way they are instructed there to advise people picking up visa personally, like it is more safe...so I am glad to know that!
For medicals...I have found here on the forum some people complained that they have tried to do medical before it expires and they paid and did it but it was a waste of money cause Office did not recognize their medical because it was before Office has asked for it. Anyways I am glad that everything went well for you guys and for sure I will try to do the same.

For implied status...if for example immigration denies my extension how much time do I have to leave Canada... And is there a limit for Implied status! ;D,

Yes you and your husband were lucky!
Baffff...my situation isnt that bad....Ive read here some scenarios-crazy as hell...poor people.
