Hi guys,

I had another question. My current work permit is valid until November 2017, and my employer is giving me an updated offer until December 2021. So do I need to apply for a work permit extension before entering the EE pool? Because mine is a LMIA exempt closed work permit, my employer will have to pay the employer compliance fee again if I need to apply for a work permit extension. Or is it okay to leave the work permit as is, and claim 50 points based only on my offer letter, and submit the PR application early next year (I will hopefully have an ITA, my score is around 520) assuming that I will obtain the PR before my work permit expires?

Thanks
Janaki

Hi guys,

I am currently working as a postdoctoral fellow and I will be completing 1 year work exp in Canada in January 2017. So I will be eligible to enter the EE pool soon after that. My original contract was until December 2017. After the changes in the CRS system, I spoke to my boss and she has agreed to give me an offer letter until December 2021. However my salary comes from research funds and the nature of the field is such that we don't usually know the funding scenario in advance. So the offer letter states that this contract is subject to availability of funding and satisfactory performance. Will this be considered a valid job offer by CIC? Can I claim 50 points based on this offer letter?

Thanks
Janaki
Hi Janki,
How's your application going? I guess you have already got your PR card, right? Have you claimed the job offer for 50 points and do they approve this job offer valid?

Is your employer currently on your work visa or is it an open work visa/post grad visa?
Hi,

My situation is close some how to Janaki. I have received a postdoctoral fellowship contract for two years starting March 1, 2018. However, i have an open work-permit visa (i.e., post-graduate work-permit).

My question is, will my 2 years postdoc contract be considered as a valid job offer under the federal skilled workers program ?

Can I claim the valid job offer points ?

P.S. my position duties is only research based without any teaching hours.

Thanks.

No. You cannot claim the points for a valid job offer while working on a PGWP.

Thank you DelPiero for your response. Can you provide some more details ? Like why I can’t claim the points ? I thought that my job description (that does not include teaching duties) would be the problem not the PGWP!
In other words, what is the difference between having a job offer while being on a PGWP or on a closed work-permit ? As far as I understand both are the same in terms of allowing me to work legally in Canada.
Thanks again for your time and assistance!

It's not about being able to legally work in Canada. Simply put, those with LMIA exempt employer specific work permits (closed work permits) are able to qualify for the points for a valid job offer while those with open work permits cannot.

I see, but my position (according to my letter of appointment) is also LMIA exempt. Also according to the following CIC link (
https://www.canada.ca/en/immigration-refugees-citizenship/services/immigrate-canada/express-entry/become-candidate/eligibility/offer-employment/lmia-exempt.html)
, it says that only a valid work permit is needed without specifying whether the work permit is open or closed. I haven’t seen a clear statement on the CIC website which says that a valid job offer requires an employer specific work-permit. I would appreciate if you could share any links which discuss that specific point.

Thanks.

Below is another relevant link which I just found that supports my understanding that even on a PGWP I can get the valid job offer points:

if you have a valid work permit for a NOC 0, A or B job that is exempt from needing an LMIA, and you:
  • are currently working for an employer specified on the work permit
  • have one year of full-time work experience (or an equal amount of part-time work) for that employer
  • have a valid job offer from that employer for at least one year after we issue your permanent resident visa"
