The original guy is not from nigeria he is from the middel east.
Sask just go with your heart go get consultation from people that can help you get out of the mess or tell your husband if he really wants to be here you will sponsor him but he needs to do it from his home country.I know you say he has no country to go to but he was born somewhere,and if all else fails get a lawyer.

My husband was born in Iraq and this is his country. You all are aware of the situation there. They fled the country in mass groups, during and shortly after the invasion. They then had to survive and had to make their ways according to and depending on the available options. If he stayed there or if he followed the rules there or somewhere else he could have ended in graveyard, like millions of Iraqis who lost their life. No need for further details but my instinct is clear and my heart is clearer. I could not go to marry in USA for reason explained earlier. He could not claim for refugee in border knowing that he could have been detained and returned back to US, and who know what could have happened after that.
I have already taken some advices and consultation from within the local community. We have made the decision that he should exit Canada soon and be back. He will try Jordan or Egypt first. If he is accepted there then we will be fine. If not he will make his way to Iraq, taking the risk and knowing that every human will die at one specific moment of a day, a minute and a second. We will start apply this plan from as early as tomorrow morning.
New worries were revealed:
My Ex husband has been watching our news and situation. He is still living in our neighbourhood. He, I strongly believe, is the one who was using me. Once I arrived to Canada to live with him I discovered too many things that he was hiding from us. Simply and to make the long story short, he was not honest. I signed a blank document for him that I did not want any of his properties or belongings. I was aware of my entitlement and rights but I just wanted to live in peace, to protect my young daughter and even go back to my native country. I did not go to the welfare system, though he threw us out in minus 25 C. I lived for 18 months on student loan that I am paying back right now. The undertaking period has expired last November. So he should be happy and leave us alone. I have now got concrete evidence that my Ex has (very recently) reported my current husband to the immigration and other relevant organization. I am scared to death right now. I hope we will manage to get him out of Canada soon.

Yes i feel for you this is a hard situation,but i think your doing the perfect thing,lets hope he does not have to go to Iraq.Lets hope he gets into Jordan.Even so you will be doing an outland app and it will go to the visa office responsible for Iraq and he will have to go there for his interview.
Refugee claims in Canada—Who can apply
Canada offers refugee protection to people in Canada who fear persecution and are unwilling or unable to return to their home country. People who are subject to a removal order cannot make a refugee claim.

Eligibility
Some people are not eligible to claim refugee protection in Canada. For example, if you entered Canada at a land border from the United States, you will not be able to claim refugee protection in Canada. Sometimes there are exceptions (such as those who already have family in Canada).

Definitions

Convention Refugee

Convention refugees are people who are outside their home country or the country where they normally live, and who are unwilling to return because of a well-founded fear of persecution based on:

Person in need of protection

A person in need of protection is a person in Canada whose removal to their home country or country where they normally live would subject them personally to:

•a danger of torture;
•a risk to their life; or

And being sent back to the US he will not,if they do send him out it will be to Iraq and did you look into the refugee claim as they will not send him back to Iraq as they know he will loose his life read through the upper post carefully and see if you can get him a claim of refugee.Like i said there is always a way.

He cannot be deported to Iraq right now. Canada has a temporary suspension on removals to that country.

A lawyer you visit to ask for legal advice cannot and will not report him. Lawyers are obligated to maintain client confidentiality and to not act against their clients' interests. Once you visit a lawyer and obtain legal advice you have entered into what is called a "solicitor-client relationship" and you are protected. This is something that lawyers take very, very seriously. You don't need to worry.
