hello . I wanted to ask that i applied for spousal sponsorship in mid September im done with biometrics then my spouse received a letter of ineligibility besause she was in receipt of social assistance which she cancelled after that. My question is IRCC disnt say anything about her PR status or non declaration of marriage prior to receiving her PR. What does this mean? Will we receive other ineligibility causes later or they are only concerned with social assistance? Waiting for ur guidance
Just to add to my post above... Normally the ineligibility regarding your spouse failing to declare you would come up later, after the sponsor has been approved and deemed eligible, and once IRCC is assessing your eligibility.

Yes, it's possible you may receive further ineligibility later.

What did the letter of ineligibility say regarding social assistance? Was it a PFL?

Normally IRCC will refused an application if the sponsor was on social assistance at the time they applied and a new application needs to be submitted once the sponsor has stopped taking social assistance.
it was not PFL it was a letter from IRCC stating sponsor is ineligible because she is in receipt of social assistance. As we opted the option stating if there is any ineligibility application should be continued for PR so its sent to canadian high commission in London for consideration. We have not received any reply after that from IRCC

I highly appreciate your detailed reply. Investor visa seems to be something that is doable. Preference is ontario but i can opt for any province that has comparatively less requirements. Is there a thread on investor programs ? Thank you
One more thing to larify, if i apply spousal sponsorship on humanitarian grounds , meanwhile can i apply for study visa? Investor visa?
Why would your wife applied for social assistant if you have the money to even consider investor programs for immigration?!
To be eligible to sponsor family, she needs to be off any social assistance to show that she as a sponsor can support her family.
She shouldn't even apply before getting off welfare. And I think the agent is checking sponsor eligibility first before going forward to check relationship or PA.

Your case is now even MORE complicated.

OK - I see. It would have been better to have opted to say "no" to the question on sponsor eligibility given she was taking social assistance. But it is what it is at this point.

Make sure she stays off social assistance entirely going forward until you have a final decision in the application. It was a mistake for her to submit the application while taking social assistance. I'm not sure I understand why she did that.

Not being on social assistance is a basic requirement to sponsor that is very clearly outline in the application guide.

You may be best off hiring an immigration lawyer to help you.

She is your wife! Did she not discuss that she is in financial difficulty living in Canada?
You need to be in pretty bad situation to apply for welfare.

Anyway, what is done is done. I agree that your case is too complicated to get any opinion on a forum.
You need an immigration lawyer.

I gnerally prefer not to be overly negative here, but the answer is pretty simple: they thought they could get away with getting extra money from the system.

Seems like it's all catching up to them now.

Thanks for the guidelines and suggestions. If i apply for student visa which state takes international students easily. As the spousal sponsorship is getting harder, wife doesnt want to leave canada and cant leave as she has applied for PR. However kids want to reunite. Is there any organisation working in ontario that helps with such cases? Or any law that helps in reunification of father and kids?

Study permits are approved by IRCC which is the federal government, not by individual provinces. Given your wife has sponsored you for PR, the chances of getting a study permit approved are likely very very low.

Once your children are adults and working, there may be an option for them to sponsor you. Until then, you need to qualify for PR on your own.

If you want assistance with the process, you and your wife can pay for the services of an immigration lawyer or consultant to help you.
