I am not from a visa exempt country. I entered Canada on 26th of Nov but my visit visa expired on the 27th February, so I am staying here for less than 6 months. So is my status valid for 6 months from 26th of November even though my visa has expired?


I applied for an extension on 29th of January since I did not know the rules and yesterday I got a letter from Vegreville-

"No action is being taken to process your request for the following reason- Our records indicate you have received authorisation to remain in Canada as per the stamp in your passport on 26th November 2009."

They are also refunding the CDN $75 through a check that will be mailed seperately.

appreciate your opinions.

When you enter, did they stamp your passport and write how long you can stay?
If not, you can stay for 6 months, or until since date of entry.

Expired visa just means you can't use it to re-enter.

If the officer at the POE did not put any other date except your date of arrival, you can stay for up to 6 months after 26Nov2009.

There is no date written under the arrival stamp- that means the status is valid for 6 months.

Yes, that is why they are returning the $75. 00 you paid for extension because you probably asked for a date earlier than the expiry of your allowable stay.

Although CIC said they would refund my $75 fee- they actually issued the extension document and I got it on Friday, the 5th of March. So they retained the fee and no refund for me.

It took 28 days to issue the document and 36 days to reach my mailbox- pretty quick.

Interesting. I also was issued a Visitor Record but I received a mailed check because I did not need it anymore, but I wrote them of the fact that I did not need the VR before the date indicated on the VR approval. Anyway, your legally allowed to stay and receiving the VR eases your worries :) Yeah, pretty quick. Processing times had become shorter.

CIC have refunded the $75 to me, I got the check today. Since I got the visitor record, I thought there would be a $75 charge for it.
