Inviting my GF/Fiance to Visit Canada After a Ban

Hey All,

I have read through a lot of sections in this forum, I figured as my case is unique I should ask my own question.

I met my GF two years ago, I had barely graduated from university and was working in Canada at the time. We got introduced through a distant relative with the aim to advice her on gaining admission to a school in Canada and applying for Visa. In the process we fell in love and started dating. She also got admission to a college in Canada at the time and she applied for a study visa, I was actively involved in the whole process but we never disclosed anything about ourselves in her visa application as the relationship was barely three months old. The plan all the while was since she would be coming to Canada to school we wouldn't be in a long distance relationship.

However she got banned for two years for misrepresentation (her father provided false financial evidence) on her study visa application. We kept the relationship going and ultimately we got in a long distance relationship. We kept up communication, phone calls, emails and I have traveled back to see her twice within the two years and spent one month each time.

We have pictures together and can prove the authenticity of our relationship through emails, phone calls etc. Last month we went on vacation together to Dubai and again we have pictures, flight tickets, hotel accommodation etc.

While on vacation we talked about the possibility of getting married which she was open to but is concerned about the implication of the ban and was scared she might never be able to come to Canada again. We decided to apply for her to visit Canada when her ban is over which is in two months time.

We tried to get her a visiting Visa to the USA so we can meet each other half way and see more often but she got denied a visa there as well so we don't have a lot of options. I have purchased a ring but I haven't given it to her yet as I want it to be a surprise here in Canada. I have proof of the purchase of the ring and certificates as well.

I plan to invite her and sponsor her trip, provide accommodation etc. I currently own my home, and have a good job with a good pay so I am confident I am capable of inviting her.

My concern is does she have a good chance of getting a visiting visa? I know she has to proof her ties back to her home country, she is partly self employed and works with her mum in her company. She doesn't have a regular pay check but gets paid regularly sometimes by cash and inconsistent (part of the issue with working for a family member, she also owns an online business where she gets paid from time to time but it is online sales of goods so there are good and bad months financially but there is proof of payment).

We have also gone on vacation to Dubai together and she returned back to her country. Based on the information above what are our chances?

Is there any advise on what else we can do to improve her chances of coming to Canada. We would both like that guarantee before getting married and we would want to spend sometime actually living together to understand each other better before we get married.

The misrepresentation, together with the US visa and her relationship with mean the chances of approval are most likely very low. To increase her chances as much as possible, she should keep her trip short (e.g. 2 weeks) and provide strong proof of her ties to her home country (although unfortunately it sounds like she doesn't have much). You want to avoid putting too much emphasis on your relationship since all that will do is increase CIC's concerns that she has plans to try to use the visitor visa to move to Canada and live here (don't include stuff like proof you have purchased a ring - that will pretty much guarantee a refusal). There's certainly some chance she may be approved - but the odds are against her. Make sure she declares both the US and Canadian refusals in her application.

Thanks Scylla.

The US visa applied for with the aim of meeting each other instead of me having to travel all the way down to her in Africa.

I was planning to attend a wedding in the US at the time and thought since the weeding was that of a mutual friend she should apply and we can meet each other. I eventually did travel for the wedding in the US, I have proof of that as well. Does that explanation help to reduce the negative implication of the US visa rejection.

As for ties to the country, she does have a job as I explained and she can provide proof of the job, does the amount of pay matter for the job matter? Because if it's just proof she has a job we can provide that but I am worried if the pay isn't too much it might not count for anything.

They most likely won't care why she was refused by the US - it's the fact she has a refusal that will work against her unfortunately.

I would say her employment ties are relatively weak since she is self employed and also works for her months - and also due to the inconsistent and cash payments. Strong employment proof would be having an established role with a large employer where you receive depsited pay and have pay stubs - and where that employer writes a letter confirming the employee has been given a week or two of vacation leave. It would be ideal if she could also demonstrate property ownership or rental, proof of utility bills and/or bank accounts, etc. Effectively things that show she has ties to her home country that make it likely she will return.

I would apply with what evidence you have and hope for the best.
