Thank you Mitesh. Still unclear on Point 2.

As my company already filed a WP, unless i cancel it, i will not be able to join another employer. Correct?

Also, when will i be able to accumulate points for Canadian Work Experience Category? I believe its after an year. So in the mean time, is there any other way to get the PR faster?

Please advise.
Hello Dear,

Both of your above understanding are correct. Please go ahead...............

thanks Mike it was a great detailed response - I did some research on this.

Am sitting at 439 in the EE pool
BC EE seems like a good option - i went thru their program guide and for that, youre right, 1 year experience in BC is not required but a job offer is mandatory as it seems from there. So a viable option is to get intra company transfer (my case) - as my company operates in Canada and also in my current country of residence. and once im in Canada i can start applying for the BC EE since ill have the job offer and location of work which BC EE guys look into apart from language etc.

does the above seem in line with your experience? i am a bit confused when you said "you dont need an employer and or Canadian experience (but it helps)" - from the program docs of BC EE you do need at least a job offer (but no experience is ok) - is it correct? thanks for your opinion!

Hi,

I read through your forum and looks like you did a good research with the help of some very good supporters in this forum. Have you received your PR?

Friends, I am In a similar situation and need your guidance.

Few details:
1. Moved from US to Toronto - Ontario in Jul 2018 through ICT-WP valid for 3yrs.
2. Have active EE profile with CRS score sitting at 338.
3. IELTS score - L7.5, R:7.5, S:8, W:8
4. Wife has open Canadian work permit and searching for job in ON
5. Employer sponsors PR only after 2yrs of Canadian experience

Considering need good guidance on our PR prospects. Quite demoralized currently as have no chance in EE.

Can you guide:
1. I will get 50 points after finishing 1yr Canadian experience but does ICT job offer (LMIA excempt) gives me any points now.
2. Will I have any chances under ON PNP program? Or any other province ?

Really need good guidance here pls - thank you

Hi! I am owner and CEO of IT company in Eastern Europe. We have been in operation for about 5 years. I would like to come to Canada with ICT program. However, I have not yet established Canadian company.

How can I substantiate my application? The work permit application requires to demonstrate a link between the actual operation and Canadian company.

Please advise, if anyone can.

Thanks

You can't do an Intra Company Transfer to a company that doesn't exist yet. You need to look at other programs to come here.

Yes, the Start Up program is one of the other programs I was referring to.

You have to first apply under the Start Up visa program. This has very specific requirements.

https://www.canada.ca/en/immigration-refugees-citizenship/services/immigrate-canada/start-visa/eligibility.html

Once you have successfully applied, you can then apply for the work permit based on your start up application. Details on how to do that here

https://www.canada.ca/en/immigration-refugees-citizenship/services/immigrate-canada/start-visa/work-permits.html

Once you have received a Commitment Certificate and Letter of Support issued by a designated entity may be considered for a short-term work permit. The designated entity must support the request for a work permit.

Well, the links I sent refer to the ICT category. Not a start-up visa category, which is a different program.
Under ICT, apparently, it is possible to come to start-up your own company.
canadavisa.com refers specifically to ICT:

"
Canada has created a special category for foreign businesses that want to set up new operations in Canada through the Intra-Company Transfer (ICT) category.
The ICT Start-Up Program allows key staff members of a foreign business to travel to Canada on a temporary basis to open a new office and begin doing business.

That's the same thing - getting accepted into the Start Up visa program then allows you to get a Work Permit under the ICT program to come to set up the company.

If you read through this - https://www.canada.ca/en/immigration-refugees-citizenship/services/immigrate-canada/start-visa/work-permits.html

It tells you specifically how to fill out the Work Permit form so that you can do an ICT.

I spoke with a lawyer. There are two different programs:

1. Start-up visa program - you go to designated accelerator organizations or secure funding from Angel investor / venture capital funds, in order to be able to apply for start-up visa.

2. ICT transfer:
A) say, you have a company in Poland, it's been functioning for more than a year, you have a number of paid staff, etc. Now, you as an owner and CEO, want to move to Canada to start-up your company.
or
B) You are working for a company which already has office in Canada, and you are being transferred to Canada office.

My case is 2A. Important footnote: A company must be incorporated in Canada, before one can apply for ICT transfer visa. It is possible without coming to Canada, one caveat in Ontario - the director has to be Canadian citizen or PR. After this, it is easy to show a link between your company in Poland (or anywhere else) and in Canada, if you have at least 50% shares in each.

Will share my experience, once I apply and hopefully complete the process.

Hi, does the duration to apply/obtain PNP varies for each state? If yes, may I know which state has the shortest time. I read that someone obtained the PNP in 4 weeks for British Columbia.

Hi,

I have landed in Canada (Toronto) in May under ICT work permit, valid for 2 years. My company primarily operates out of Ontario and not in any other states withing Canada.
I am already in the EE pool now at 389 score card and my points would reach the 467 mark if I add the 1 year work experience (for which i would have to wait for another ~7 months to reach).
Now, I would like to get some of your valuable opinions to this,
- if it would possible for me to select options of "Holding a valid job offer with LIMA exempt " and increase my score to 439. OR
- Would it be best for me to wait for 7 months and apply with 1 year Canadian experience.

Please do let me know if there are any better suggestions that I would need to consider as well.

Thanks.

- No. Not possible. You have to work in Canada for your employer for a full year before you can claim job offer points.
