Hello,

I'm an international student who's married to a Canadian. We submitted our inland application august 26 ish(late august) we haven't heard anything, which I guess is normal. My question is, if processing takes on average 12 months, and my permit expires august 2018, if I leave because i can't legally be here anymore how do I go about doing that?
Do I call them and tell them I have to leave now, and do they then switch my application to Outland processing?

Thanks

Tamra

Did you include an open work permit with the application?

No, I understood that I had to be in the country on a valid permit excluded the open work permit option

No - that's no the case. You should have included an OWP with the inland application. This would have given you implied status and allow you to remain in Canada until a decision was made.

I'm not sure about the process for submitting an OWP after the fact. I'm sure someone will drop by and give you these details.

You should always maintain a valid status in Canada during you inland processing. This can be achieved using different ways. One of them, is to maintain your status as a student, so applying to extend your study permit before this one expires (if you plan to continue your studies after August 2018). This is actually what we did for my wife, she was a full-time student for whole duration of the sponsorship process. Another option, if you plan to finish your studies before August 2018 is to have status as a worker. In your situation, you can apply for an OWP as an inland applicant in the spousal sponsorship category (about 4 months of processing time) or you could apply for a PGWP (post-graduation work permit) if you are to graduate before August 2018. For the OWP, you can apply anytime now and get it in about 4 months. I'm not too familiar with the PGWP procedures, but I know this is also a possibility. However, my guess is that the OWP would be the easiest solution for you.

I know you can include items with your application after submitting the application

Does anyone know if this is included with the OWP?
