As for passport, you do need a valid passport. Mine was expired since 2013. You can come to your embassy and ask for a new passport after you get the medical checkup done. They will give it to you for sure.
Not every country gives a passport without proof of legal status in the resident country, particularly countries where lots of their citizens claim asylum.

My embassy requested a valid legal status in order for me to obtain a passport as well! I was refused at first. And then, my lawyer submitted my PR application with my expired passport. After they requested me to do the medical checkup, I came back to the embassy - since I would not be able to do the medical checkup without the valid passport or ID (I did not even own a valid ID). I came back to my embassy with the letter from IRCC. And, after some interview, they will give the new passport.

Unless you are from the same country as OP, you can't say that they will get a passport. Their country may not allow that.

A country "similar or maybe worse than India" still does not mean the person will get a passport.

I’ve been in the dead-end situation where to get a new passport was impossible. At time, even my lawyer couldn’t come up with a solution.

That’s why, I signed up this forum right after I got my PR, just to give a little bit of encouragement to anyone that dealing with the same issue.

I'm not being negative. Your exact words were "They will give it to you for sure." You don't know that. Share your story but don't guarantee someone else from an entirely different country will have the same experience.

I am a Canadian citizen married to a illegal immigrant we have been married for last 3 years and applied for spouse sponsorship last year in December my spouse’s passport is expired this year in September. My husband overstayed his study visa from 2014 to till now but he didn’t received any letter to leave Canada not sure if he still is under removal order or can get deport.my husbands whole family is permanent residents here and living with us. My question is what are the chances of getting us approved ? Since he didn’t receive any letter when his study permit was denied,can he still get deported as he has been living illegally with me? I have been reading in cic website that despite the illegal status of immigrant can get permanent resident as long as the marriage is genuine and as i mentioned we are married for last 3 years so he can get his status back right?

I once was in a similar situation as your spouse. I overstayed my work visa and my wife successfully sponsored me after 5 years of me being out of status. If you need any help message me privately and I’ll try to help you the best I can. What province are you in by the way?

I was in exactly the SAME condition as your husband. I just landed as a Permanent Resident yesterday. It was a long battle for me, but it definitely worth it. Don’t be afraid to apply :)

In your case you met your husband in 2011 when you had legal status but in my case I met my husband after his status was illegal for 2 years . Do you think may be that’s why you get approved as you showed that you guys are genuine and known each other when you were legal in Canada. Do you think immigration can give us hard time because they will think we only married to get PR? Or am I just overthinking?

Yes there will be more scrutiny than other applications but it is possible to be approved. Present all your evidence and also admit to all the illegal things that has been done. Assume your spouse has been working for cash and not paying taxes.
