Hey guys! Good day! I badly need your help as I dont know where to start

So me and my boyfriend are living now for a year. Im a Permanent Resident and he is "lack of status" here. We have a baby and were planning to process my partner's sponsorship as soon as possible.

Were getting married this January and as I was reviewing the requirements, I dont know how to provide some of it.

Like:

1. Proof of joint ownership ( we dont have this one as we are just renting)

2 Rental agreements with both names on it ( we can provide this one)

3 Proof of joint utility account ( i dont know how to provide this one. We have an internet plan under Rogers and I called Rogers if they can add the name of my partner on the monthly bill statement but they said, they can only put one name on it, and its the one who applied- and thats me. Same thing with Virgin as our phone plan is under Virgin. Its just, I have 2 account under my name on our phone plan bcs he dont have a credit card so he cannot apply a phone under his name. so the main applicant again is me. Regarding the gas, hydro and all, we are just renting at the basement so the pay were giving to the landlord, everything is there already)


4. Do i need to be working before we process the sponsorship? I was working before as a Child Care provider, but when I gave birth, i resigned and currrently still on my Maternity Leave.


5 theres also a an option here regarding documents of evidence of financial support between us like shared expenses? how to do that?

Anyone here who just processed their papers? Can you please help me. Pls pls pls.

Please consult an immigration lawyer or consultant. Although I don’t recommend using them since everything can be done by yourself, it’s a good idea to seek their advice, even if just for a consultation, to guide you in the right direction. You can also get excellent advice from online forums, but if you’re unsure, consider seeking professional help to ensure your application is submitted correctly.

3. Just include a letter explaining this with your application.

4. No, you do not need to be `back at work', but you do need to show that you will support him (for 3 years) and cannot be on social assistance; Maternity leave is not social assistance, so you're fine, though I was unaware that a person could resign and take Mat leave.

It's important for your partner to understand that the Public Policy that is in place that waives the requirement to have legal status to apply for SCPLC (Inland) spousal sponsorship, is not an absolute guarantee. Time is of the essence, so be sure to get the application in ASAP.

Because he is out of status, and it will take time to get your marriage license after tyou are married (which would be a required document to submit). You could apply now if you have truly reached the Common-Law requirement of a minimum of 365 days cohabiting together.

Yes we have been living together for a year now but my problems are the documents that we need to submti. We only have the lease agreement and a driver's license that has the same address as proof.

We were planning to hire a consultant / lawyer,but it was so expensive. thats why, I want to gather documents already so whenever our marriage certificate is available already, we can submit all the documents right away because I know how stressful gathering the documents for immigration purposes.

Thats why I want to have some idea what are the documents you guys provided. It will really be helpful.

Time is of the essence . You do not need to be married to apply inland .

You only need to tick two boxes in the section you are referring to. Is your partner a cosigner for anything maybe a car or something else he had to provide his address for?

Your partner will need to provide a police certificate as soon as possible. So I advise getting on that so the application is not delayed.

To me it sounds like you have most of the documents needed to show that you are common law (if you have been living together for more than 12 months). Note that you presumably have / will have a birth certificate showing your partner as parent (and while that doesn't 'prove' common law it is supporting evidence.

Also, when you apply common law, you can provide information about getting married after you submit the application, and they MUST take that info into consideration.

In other words, if you submit your application now/ASAP (or before you have the marriage certificate available), and then submit the marriage info later, you run effectively zero risk that the application will be turned down because of insufficient evidence of common law relationship.

Normally I would say this is not worth the effort to apply earlier if getting married that soon, but think it does in this case as your spouse is out of status.

So submit when you have the application and docs all pulled together, send the form (I forget the name) the officiant provides after the ceremony in due course (with note that marriage certificate to follow later), and then send the marriage certificate to IRCC when you receive it.

Note, in your application, you can mention in appropriate space you plan to get married later but are applying now as common law as you meet the criteria. No need to go into a lot more detail. IRCC probably gives very little weight to people saying they plan to get married later. Neither is it a negative to get married during the process - again, they'll have to take that into consideration.
