It could be a blessing in disguise. Go with your spouse, copy of your application, AOR if any, proof of payment to CIC .If the officer believes you are in a bona fide relationship you might be allowed to stay until a decision is made on the sponsorship application. The best to you !

I am so sorry to hear this. I can understand why you would be freaking out! Can I ask if you have a failed refugee application and that is why your application being in place is not enough to keep you here until a decision has been made? Or if you just don't have status? I have heard that sometimes the border agents will contact CIC to expedite your application if there is a removal order. CIC could then fast track your application for a decision on stage 1.

I agree with susana; this could be a good thing...hopefully!

Take a look at this document:
http://www.cic.gc.ca/english/resources/manuals/ip/ip08-eng.pdf

Pay close attention to the information in section 5.27 and section 12

Unless you had a removal order in place BEFORE your PR application was received by CIC, you should be ok.

It's possible that they will need you to post a bond and report to them weekly while your PR application is being processed.

Good luck!

I read / see this cic news - The government of Canada has launched a pilot program issuing open work permits to certain spouses and common-law partners of Canadian citizens and permanent residents in the Spouses or Common-Law Partners in Canada class (SCLPC). Applicants making an Inland application (i.e. while residing in Canada) for permanent immigration to Canada may now be issued open work permits before the ‘approval in principle’ decision has been made on their application.

So what this means that inland sponsor spouse can apply now even no 1st approval for the application hows that work or is there a form for the spouse for OWP? Please help or any advice , thank u very much:)

Hi Rosalee an immigration consultant on our facebook page says that you can submit an outland application without having to leave Canada. So depending on the processing times for your country, it may be faster going the outland route. Just a suggestion...wish someone told me this before I applied inland

Oh ok, I understand now. So AOR means only that cic received the application but all the background checks etc. (also sponsor eligibility) I will only receive after a few months (first stage approval). Thank you Sophie for your answer.

Ok, So i have a question.

How long are people actually waiting for first stage approval inland.

The website says 16 months at the moment but obviously this happens sooner for a lot of people.
Now, my Irish IEC visa runs out in June and we applied in October for the Common Law Application. We also have a baby on the way in the next few months, so i guess my question goes to someone who has been in a similar position, what did you do?

The express entry application has now opened for CEC so I've been looking at this avenue also. Any advice would be great... ;D

People are waiting basically 17 months for first stage of inland approval. Outland is where the posted times are maybe faster.

Hi All,

Little about me and my Luck!!!!

I came to Canada on a Study permit and after finishing my school I received a OWP for 3 yrs. Within that time I got married to a Canadian Citizen and applied for my PR through Inland Spousal sponsorship. At the time when I applied for my PR I was on a valid work permit and at that time processing time was only 6Months (Oh god!!) due to that and also at that time I was not aware that I should sent in my work permit app in order to gain implied status. SO basically I didn't include OWP with my PR app (My Bad luck) now my work permit has expired :-[ and Im out of status in Canada. I did apply to restoration of status as a visitor (with in 90 days) but haven't heard any thing back from CIC.
I am from a Visa exempt county (England).

What do you guys recommend ? Can I stay in Canada without legal status while PR app is in process. Every time I call CIC I get different answers from different agents.

I hope someone can help. If any one is in similar situation as mine ( I hope not).

Thank you and Happy New Year.
