So the time when my current working permit expires til i got the OWP (if I get it), I would be in implied status right?
Would I be able to continue work if i'm on implied status?
My understanding is that this is not the case for a fixed duration work permit (such as a PGWP) because it is not eligible for extension.

Hello, i'm new to here,

I sent in my application in Feb2012 (inland), and received my Open Work Permit on 6 Dec, 2012. Along with it, I got a letter saying they confirmed my eligibility of P.R. application, but decision will be granted after they completed all security ,medical background checking of all my family members in my home country. So does anyone hv the same situation before? Roughly how long will the process take? (My sponsor has already gained a separate letter confirming his eligibility of being my sponsor). I dunno if the time suggested on CIC can be taken as ref. becos it seems I am in the middle of the process?

one more question, does anyone know how would the days of entry be counted? cos I have left Canada for a trip home and returned to Canada in October,2012, my employer is not sure whether my Temp Resident status counted from the date of my entry (Oct, 2012) or the date I received my Open work permit, they said it would affect the arrangement of MSP covered.

Congratulations! They post 8 months as the time to complete stage 2 for 80% of applicants, but the time is unique to each case.

Note that health care is provincial issue, so the rules depend upon the province in which you live. Since you indicated MSP I'm guessing you are in BC as that is what the plan is called in BC.

According to MSP rules in BC, you are eligible as long as you are living with your spouse in BC and have an application in process: http://www.health.gov.bc.ca/msp/infoben/pdf/covering-a-spouse-or-child-who-is-an-applicant-for-permanent-resident-status-in-canada.pdf

Further, the rules are that a married or common-law couple should have a single account:

When you marry (or begin living in a marriage-like relationship - see the definition of spouse under Who is Eligible?), you should combine separate MSP accounts into one family account - see Adding a Spouse below. If one or both spouses are changing their names, follow the instructions for Name Change.
This has nothing to do with the date you received AIP or the date you received your open work permit.

Personally, I'd prefer to see something in writing - if they tell you something over the telephone that later turns out to be wrong, it will be you guilty of working without a work permit. As I said, this was my understanding based upon other cases, but I've never gone through this specific situation.

You r so great Computergeek~:)

I just hope my stage 2 wont take 8 months... does anyone have experience of it recently so I can hv a timeline for ref?

Once I got my "landing document", does it mean that I hv to leave the country and get back to officially "land"?

Btw, i may hv to get back home for my passport renewal and visit my parents in March 2013, if i hvnt been granted the PR yet, would my entry be affected and also my application? My husband (sponsor) cannot go with me so I worry about my entry. CIC said they cannot tell what will happen cos it depends on custom officer's handling... I dunno what to do.

I really hope I can get my landing document before March 2013 though it seems it's not likely as it says it takes 8 months -.-

For someone on an inland application you complete landing inside Canada (at a CIC office).

It's generally not recommended that you leave - the border officer could refuse you re-entry and that will lead to abandonment of your application, because an inland application requires you be living with your sponsor in Canada. This is an unlikely scenario, but it is definitely a possibility.

Are you at least from a visa-exempt country? If not, you'll have to obtain a TRV to come back.

8 months for 80% of applications. For many it means less than 8 months.

Yes, I am on 6 months exemption so I dun need a visa to get in. (I left the country in August for my wedding reception in my home country, and returned to Canada in October, but i was not sure if i get in as a visitor or a temp resident (though i guess i was on an implied status), and I got my return ticket to home , which expire in 6 months <- the max time i can stay as a visitor, so I just hope i can get back for my Passport renewal then after that I can stay in Canada without worrying anything with my passport.
and I'm missing my family so badly -.-

I now feel regret for not sending my application outland...-.- at least i can hv freedom to go home when i want to...
and I noticed that they updated the ECAS like this:

2012 Feb 27 Application received
2012 Nov Medical results received
2012 Dec 06, Open work permit issued, we start to process your application (I guess partly becos I didnt submit sufficient documents regarding our relationship and just sent them in Nov.)

Now i can just cross my fingers for a miracle fast action then i can go home safely~

(btw, how can I key in information on my profile? so that i can put my timeline for others' ref.?)

My friend applied spousal sponsorship inland a year and a half ago and he got AIP September 2012 but up till now hasnt received open work permit. (sent with application) , He received a lettter today thinking it was the open work permit but it was a letter asking for his passport/travel document. What does this mean?

Thank you for any input

Is this typical though? I thought he would just be having an interview landing letter instead of a passport request

I heard similar stories before. CIC is really unpredictable, when did ur frd file the application? and was there any correspondence sent my CIC?!:) maybe their application is so accurate with no worries arising, then everything goes so fast!!

i wish i can hv that luck too! but the fact was, i missed some documents and only received their request for additional proof... this really hinder the whole timeline...i bet i'm back to the queue , they may just be counting from the day they received my additional proof... long long way for me~

With a work permit, you have a status document. Unless you become inadmissible, they will allow you to return to Canada. You are still a foreign national, but you are a foreign national with a work permit.

That functionality is restricted until you have 10 posts on the site. Then you can set it up in the profile information area.
