I have been in Canada for ten months, myself and my canadian partner did not realise that I had to leave after 6 months. We have lived together for the whole of this time and plan to get married in the near future. We was informed today that I must leave Canada immediately, is there any way I can stay in Canada with my wedding impending.If i was to drive to the states for a day would the canadian border control deny my re entry? what steps can I take to stop this happening, me and my partner are absolutely frantic with worry
 
who informed you that you had to leave?

where are you from and what ties do you still have to your home country?
 
I called the Canadian border agency today as we were informed I was illegal here, (by friends over dinner last night) they told m to apply for a visitors record immediately, which I the CIC and explained the situation, it was the CIC who said I must leave immediately. I am from the UK and the only ties I have there is my children who are grown and have their own lives. My mother and my grandfather both passed away last month so I really don't have anything tying me to my country of birth anymore
 
If you go to a Canada/US land border and leave - and then re-enter - it's possible you may be allowed back in or it's possible you could be turned away. Unfortunately this decision is up to the CBSA officer at the border and it's impossible for any of us to guess which way this may go.
 
Thank you so much for the advice..... I guess I will have to take my chances and pray to God that they allow me back in to continue my life with my partner and to get married

if you haven't started working on your pr application, start putting things together now and pay at least 1 fee to have proof to show cbsa if it comes up.
 
that's what I tried to do today, a visitors record is only $100.00, however they informed me that I can not even do this, I have to leave immediately is what they said. I wouldn't mind but I have lived on my savings whilst I have been here and never once asked the government for a penny, my partner is on OSAP as he is attending trade school

i am not talking about getting a visitor's record. i am talking about starting to get your Permanent Resident application started, so you can submit it after you get married and have legal residence in canada. there are fees to pay for this, and paying them ahead of time to show intentions of applying is acceptable. having this much is better than having nothing. it is VERY important to understand you currently do NOT have the right to live in or move to canada. right now, you only have the right to visit canada. in order to be able to live in or move to canada, you must be approved for permanent residency. if cbsa suspects you think differently or don't understand this, they will more likely than not deny you entry.

tough situation i must say . CBSA will question your quick return to Canada from another country other than yours , let it alone if they know about your overstay .
Since you have no deportation order I think its best to get married now and apply for a spousal sponsorship , or wait a couple of months to be eligible for common-law .

what made you think you can stay here indefinitely without documents ?

thats the thing, we didnt think, I have been living on my savings and time just escaped us. Neither of us realised we had to fill out paperwork and get acceptance for us to be togehter
 
hi bud, fellow UK here, hate to say it, but get your ass out of the country pronto, if you get a removal order that will cause no end of smelly stuff later down the line regarding PR, as it is you have an overstay, and ignorance is not a defence. the advice you are getting here is solid and can be trusted.

Just to clarify, the OP and his partner have been common-law for 10 months, is the advice to pay the first fee showing he intends to apply in 2 months time, if he tries to flagpole?
