Posting the above subject and hope to get answers from anyone with similar concern as mine. I did make some research and somehow found a post that is somewhat related but I am still quite confused.

Hubby and I got married Feb this year and we are in the process of putting together all the necessary documents before sending our application for Family Class Sponsorship to CPCM.

I have 2 children and both are illegitimate. My eldest' birth certificate (BC) father's info was left blank. Her bio-father though, died when she was only 2 years old. My youngest BC shows the father's info but he is using my maiden name. In short, both of my children uses my name as their Lastname. Both of them have not received a cent from their bio-pa and have been in my custody since birth. I already have an Affidavit made for Illegitimacy and Sole Parental Authority that will be included in our application.

My question is: You think that the IMM5604 of Declaration from Non-Accompanying Parent will still be required for my youngest?

As mentioned earlier, despite the acknowledgement of the bio-pa on the BC, my child's name on his BC was registered using my maiden name.. If the said form may still be required, I really have no more contact of his bio-pa since before his 1st birthday and he is now 3 years old.

Would really appreciate feedback from anyone.

You will need proof from a court that you have sole custody in all areas for your children before Canada will accept your application.

Thank you Sous2. Philippine Law and Family Code clearly states that an illegitimate child is under sole parental authority by the mother. Hence, no court order is required. That is why I asked a lawyer to make me an Affidavit of Illegitimacy and Sole Parental Authority. Also checked with Department of Social Welfare and Development (DSWD) and they also stated that no travel clearance is needed if the travelling minor is illegitimate and going with the mother.

Oh well, I'm still doing my best to somehow get a hold of the bio-pa wherever he is. Just in case, I hope he won't make a big deal signing the required form. He has not supported nor seen the child since birth.
 
You could also get your lawyer to write a letter explaining and citing the Philippine law that grants sole custody to the mother in cases such as yours.
 
Thank you CanadianWoman. Yes, my lawyer already told me that he will give me another document in support to the Affidavit that I have.
 
Just sharing an update about this post I had before. I already got the IMM5604 signed by the birth-pa of my youngest child.

Meanwhile, I have a question about my eldest birth certificate. Anyone here whose dependent child's BC does not show the father's name? This is the case for my eldest. The birth-pa though, has died when she was 2 years old and I already have the PSA original copy of the Death Cert. You think that an immigration officer will be satisfied enough with the DC to be attached and as one of my supporting documents? Or, the BC might still be questioned why the father's info was blank?

Any input please??
 
Any senior members here or sponsors with spouse in Philippines and a dependant's BC father info is not mentioned or blank?
