Hello, I hope somebody can help and enlighten me. I am sponsored by my husband. My son is illegitimate bearing his fathers name and acknowledged at Birth certificate. Im not married to My ex partner. I already have imm5604 and affidavit of full custody signed by his father. Do I need court custody? From Manila, PH. Anybody who has the same situation... Please please help.

I suppose if you have affidavit of full custody signed by the father, then you do not need court custody. I think this (court custody) is only required if there is no consent of the father. CIC believe that the biological parent of a child should be aware in an event the other parent leaves the home country.
 
Would that be the same rule for all the VO?

I suppose a consent letter is sufficient together with the affidavit of full custody.
 
That should be enough for CIC.
The guide for the Philippines states that 'The Philippine government has certain travel requirements for minors traveling abroad. It is
you or your sponsor's responsibility to coordinate with the appropriate government agency to secure the required travel permit or clearance to
facilitate the minor child's travel abroad.' So you might need other documents for the Philippine government.

canadianwoman, hope you can help a friend with this question, he is been sponsored by his wife,
but at his divorce court paper it says that during his prrevious marriage he did not had children,
so what shuld be better, not to include the child on the aplication? couze they did but she declared as
single mother.

It would be better to declare the child. If he does not, the child can never be sponsored by him, even if circumstances change and he has no one else to look after him. In addition, if CIC finds out that he did not declare a child, his application for a PR visa will be refused and he will be banned from Canada for 5 years.
Why did the mother declare she was a single mother on the birth certificate? It would be much better for him to declare the child, include the child on the application (as non-accompanying, meaning the child can stay with the mother), and get a medical for the child. If the mother refused to cooperate, well, that will complicate his application, but it is still better to declare the child and deal with the consequences now.

thank you so much, well i see this case very complicated, the mother did declared the child without father as single mother at that time
couze she wanted so, so he does not have anything that can say thats his child, the mother of the child did refuse to give any info like
birth certificate or do the medical at all, to add complications to the case the interview is in a few days so should be better to tell CIC
at the interview?? couze as i told you he does not have any single paper that can proof thats his child, again thank you so much.
