Ok I guess I should have read your post a little closer lol sorry so I should still do the FBI clearance and medical before I submit the application or did I miss understand you? lol sorry please excuse me if I miss anything I don't sleep good any more.
Yes, make sure you have done it all, before you apply (So you dont loose time).
About your passport, (just put your marriage certificate with the application) they will go out from that.
But its always good to update your passport now, so your done!

Make sure you save 1500 dollars (thats the fee they going to ask you to pay when they do a passport request when approved!)
The 1500 dollars is the money they payed for you when you flew back to the states.

Maybe becouse you are from the states, they ask less, but i have to pay 1500 dollar.

Save some 1100 more, becouse the family class sponsorship application cost you and your spouse money too, ontop of the 1500 dollar!

If you have more questions, just ask me.. im going trough the same process right now.

I'm not sure about the passport name, perhaps someone else can answer, but I believe that you have to send in your police clearance and medical at the time you apply, or else they will send your application back for being incomplete. If they don't, you are still looking at lengthy delays, since they will have to request that information from you, which will slow your processing.

I'm am very sorry about your situation btw, I hope everything works out.
Have a questionn for you sidkrose,

Did you got the AOR by email, or by snailmail?

They didn't have to fly me home my husband was with me we they gave me the exclusion order and him and I drove back together. I am really hoping I can apply for resident while waiting on my FBI clearance and medical because I really don't want to wait another 18 weeks before I can even apply to become a resident. I can go Monday morning and apply for my FBI clearance and can't I sent in my application and explain to them that I applied for my FBI clearance so they can at least start the process of the application?

You can always send out the FBI check later, but my advice would be"Make sure you have it all together". When you send in your application, it gets put aside in the postroom at CIC the first couple of months. So it means that, when you send out your FBI check later, they have to get it into your file (lots of hussle). If you want to send your FBI check later than your application, i would wait till they going to ask you than by letter for it. Is it going to make a difrence in time than?? I dont know. Maybe other people did send out there FBI check later, and can answere you beter in it. I did it all together, to not getting the hussle of mixed up pappers etc.. If you dont get it in order, they just let you wait onother months to get your stufs together, or just sending it all back to you! Make it them as easy as posible, and you will see it goes fast. Anyway in your case, its going to be more than a half year (just count on that).

I know you want to get back as fast as you can, i think thats the case of all of us here on the forum.
Just remember. When the love is strong, you have to make time your friend. If you dont, you will get insane.

Dont rush the application, make sure you have all the proves you need, letters of staying on the same place of your husband, letter from family, Evrything what was in your name, when you were in Canada, Photos, etc etc..

How long did the whole process take you before you were able to return to Canada from start to finish? I am praying I am home soon being how I am living apart from my whole family. I am going to send out my application and a letter for an ARC goodness I hope it doesn't take 6 months longer before I am home with my husband. I NEED SLEEP lol. Maybe if I tell them that they will speed up the process joking. I was going to hire a lawyer but they are so costly did you all have lawyers involved with your application or did you do it on your own?

I think there is a thread on here for timelines of people getting FBI clearance, or you could ask the buffalo thread.

@Marco - AOR was by email, sent to sponsor/representative. We got it a couple of weeks after sponsorship approval.

Couldn't I apply for Temporary Resident because I think the time line on that is faster just so I can get home sooner then apply for permanent resident later I wonder if that would speed up the process.

I was for 2 weeks at the imigration holding centre in Torronto, and talked a lot to people from imigration DONT PUT IN A ARC!!!!! Its going to F up your application!
It are 2 processings near eachother when you do that. Your ARC is dealt with within your family application. If you going to send out a separated form for ARC, they will drop your family class application! The chances they will give you a aproval for the separated ARC is 0%.
Just let it go within your family application.

Im still in process, my wife got approved for sponsorship, now waiting for the PPR from my visa office. look at my stats on the side, if you want to see how my app is going.
No need for a lawyer, he cant do anything for you right now, just start filling in the application your self!

You can apply for Temporary Resident, But than you need a separated ARC, but your chances are 0% you will get a approval for ARC. Just start the family class application. Thats the best you can do!

You can apply for a seperate ARC but it will cancel out your application for PR and the process will take a year for an answer. You will be over your ban by then. Your best bet is to apply through regular family class where the ARC will be dealt with within your application. This is your only chance of getting back to your husband sooner.

I was wondering what are the chances after I submit my application and I get a letter stating they started the process where I will have poof that I applied and done everything I was suppose to do if there was a chance at that point that I would be allowed to cross the border with my husband and my daughter to go back to Canada with him. Its just a thought though not sure if its a good one. BUt I heard you could apply at the border for an arc but as long as I have proof that I paid and submitted my application I would think possible I would be allowed to return with my husband. The they is I never over stayed I always went by the rules because I didn't want to ever get banned from Canada and I was planning on becoming a resident of Canada but I had to wait to see if my AMerican children where allowed to visit me in Canada before I started the process and when I went to court in June of 2011 I won my case and my children were allowed to come visit me in Canada. So me not reading the court papers went through the border or tried to on July 8th 2011 and they read the court papers and in the court papers it stated mother is living in Canada. SO thats what cause me to get my exclusion order just because of a letter. And I could prove to them that I was planning on becoming a resident of Canada in the near future I was in the process of relocating to Canada where I was going to submit my application.

ALso when I was at the border the one officer really wanted to just to go and applied for resident then be able to return without a exclusion order. But the head officer said they had to give me a exclusion order and I had to wait one year before I could return but then when I was about to leave they handed me a note saying go and applied for resident and an arc so I could return that was off the record of course but so I think I may possible have a good chance after I have applied.

I am really hoping someone else maybe in the same or was in the same boat as me and could give me some inside on this so I know if there is a chance I would be allowed into Canada before Feb.

I got a wedding gift from my brother inlaw he got my husband and I hockey tickets to go see my Flyers play in Canada and I know thats not a must that I have to go but its been a dream of mine to be able to go see my Flyers play lol. Oh crap maybe I should tell them its to go see the Habs play being how thats a Canadian team joking.

Hello punkinspice,

I am in the same situation as you (i have a exclusion order to!, mine started in march 2011 till march 2012).

Dont listen to PMM (he cant read! and he dont get it).

1* dont bother your passport, you have time!
2* Fill your application as outlanded.
3* Do the FBI check and medical (there is no negative effect).
4* Just follow the normal procedure for Family Class Sponsorship if:
You have a exclusion order (not a deportation order).

This is the fastest way to get back to your spouse!

The exclusion order is doubt within the context of your application.

In other words, there is no ARC needed if you follow the Family Class Sponsorship application.
TIP: Make sure when you send your application to Mississauga put a copy of your Certificate of Departure in it.

More info!!
http://www.cic.gc.ca/english/information/inadmissibility/arc.asp
(
If you are applying to come to Canada for any reason, (visiting, studying, working or immigrating),you should not submit a separate application for an ARC. If your application is approved, the ARC will be dealt within the context of that application. You will simply be asked to submit the fee.
)

I hope this will help you!
1. I think I can read better than you and I do "get it"

You may wish to read the following statement from OP 01 (the processing manual if you didn't know) Which the OP will get if the application is received prior to the one year.

http://www.cic.gc.ca/english/resources/manuals/op/op01-eng.pdf page 70

Further, section 225 of the Immigration and Refugee Protection Regulations provides that an
exclusion order obliges the foreign national to obtain written authorization in order to return to
Canada during the one-year period after the exclusion order was enforced (or two years in the
event the exclusion order was enforced as a result of misrepresentation).

"Our records show that you were ordered excluded on [or about date], and that this order was
enforced on [date]. As you were previously excluded from Canada, you are currently inadmissible
to Canada and require authorization to return to Canada if you wish to continue with this
application for a [permanent resident/temporary resident] visa. The earliest date at which you will
not require authorization to return to Canada is [date]."

Also I was wondering about how much the medical was since I may have to do the medical in the states since I can't be back home until I am approved to go to Canada. Unless I can do it after I am able to return to Canada not sure if they will make any exceptions being how we really need this done asap so I can be back with my child and husband :(

I am also wondering if there are any other steps I am missing that could speed up my whole process. The reason I am asking this is because a baby shouldn't have to ever be away from her parents for any given time my husband has missed so much with our daughter all ready once he is finally with her again its going to be like meeting her for the first time. He has missed her first steps her first sickness her first boo boo I hope this people have a heart because as I sit with my daughter every single night in tears showing her pictures and videos of daddy my heart feels like it is being tore out of my chest. He talks to her on the phone all the time she doesn't understand why she can't see daddy. And now something is wrong with her legs and we have to put her into braces I don't want to do this alone its going to kill me. I hate being a single mother its not fair when her father wants to be apart of her live so badly it hurts. Sometimes we just sit on the phone talking while I am crying and he is doing and saying whatever he can just to make me smile. My husband is honestly the greatest man I know he has been there for me so much when he is hurting just as bad if not more because he is missing his little girl grow up. He missed her first words even I mean ok I can't think of all the bad stuff but its killing me so if there is anything at all that I have missed or anything I can do to speed up this process please let me know.
